A set back to BJP-PDP Govt. in SC As it rejects J&K Appeal in beef row

 A Division Bench of Supreme Court of India presided by Justice Mr. H.L. Dattu, Chief Justice today rejected the SLP (Special Leave Petition) filed by J&K Govt. against two separate notices issued by Jammu Wing of J&K High Court dated 8.9.2015 and Srinagar Wing of same High Court dated 16.9.2015. The Jammu Wing of the J&K High Court had directed the police administration to ensure enforcement of the law as laid down in the Ranbir Penal Code (Indian Penal Code is not applicable in J&K) which prohibits slaughtering a cow or bovine animal in the state. The Srinagar Bench issued a notice to the J&K Govt. on another writ petition filed in Srinagar Wing of High Court challenging the validity of Section 298(A), (B), (C) & (D). The State of J&K instead of filing counter to the writ petitions (both PILs) chose to move an SLP before the Supreme Court of India on the ground that such notices have created law and order situation.
          The SLP was heard this morning by a Division Bench headed by the Chief Justice of India which refused to entertain the SLP filed by the Govt. of J&K. In the meantime, Prof.Bhim Singh, Sr.Advocate submitted before the court that the two orders were neither contradictory nor such notices had created any cause of action for the Supreme Court of India to intervene. He also welcomed the decision of the Supreme Court of India to return the case back to the High Court of J&K with a direction that the Chief Justice of J&K shall constitute a 3-judge bench to hear both the writ petitions (PILs). The Chief Justice of India made it clear that the court was not staying the notices or orders issued by the two benches at Jammu and at Srinagar. Prof.Bhim Singh said that the Supreme Court clearly stated, “We are not staying the orders/notices.” The court said that the notice of the Jammu Bench is being kept in abeyance temporary till the new bench is constituted by the Chief Justice of J&K. The court also refused to interfere with the order of the Srinagar Wing of the High Court and observed that there is no reason to interfere with the powers/jurisdiction of the legislature.
          Prof.Bhim Singh said that the Supreme Court did not use words contradictory orders as were used in the SLP of the state. The Supreme Court did not interfere with the provisions of the Ranbir Penal Code either.

Geelani is as good Indian as Dr. Karan Singh or Dr. Farooq Abdullah, passport is constitutional right of every citizen

Prof.Bhim Singh, Chief Patron of National Panthers Party in a scathing attack on the power that be in Delhi or in Srinagar said that granting/issuing a passport in favour of any Indian citizen is no favour rather it is a constitutional right of every Indian to have passport. Refusing passport to Mr. Ali Shah Geelani or questioning his integrity as a citizen of India amounts to defamation and state cannot be absolved from its responsibility to let every Indian get his passport whenever he/she wishes and wherever they intend to go (unless a visit to that country is prohibited/banned by an Indian Law).

The news items appearing in a section of press that an Ex-MLA, J&K, 84 years old Geelani has been refused passport are highly undesirable and unacceptable to any nationalist or Indian because every citizen unless he is disqualified as a right to obtain a passport.

Prof.Bhim Singh accusd the State and Centre agencies for coining some prominent/known political activists as ‘separatists’ only to suit their marketing in J&K. He said every permanent resident of J&K State is unquestionably citizen of India. What is the wrong if Mr. Geelani swears to uphold unity, integrity and sovereignty of India which is required under the Passport Act. How his right to obtain a passport can be denied, he questioned. It did not matter where the passport holder intends to go.

Prof.Bhim Singh questioned Prime Minister, Mr. Narendra Modi whether he considers all opposition leaders or critics of his RSS-PDP run government as separatist? He asked Prime Minister Modi to spell out the meaning of separatist and stop the vested interest from maligning the national residents in J&K who are no less citizens of India than others.

 

BJP must prove its credibility before bargaining for power in J&K

Shri Bansi Lal Sharma, Advocate and Spokesman of JKNPP has questioned the bona fides of the State BJP leadership in seeking power with PDP in the State on the claim that it has 25 MLAs out of 37 in Jammu Pradesh.

Mr. Sharma asked BJP to prove its credibility and the work done by theBJP in the past six years having 11 MLAs in the Assembly. He asked BJPleadership to make it transparence on the question of expelling 7 out of 11 from the party and then readmitting them on the eve of Assembly poll. Does it mean that seven tainted MLAs when shared the loot with the leadership their expulsion was withdrawn yet they were not fielded in the Assembly elections. That remains unanswered.

Mr. Sharma wanted to know from the BJP leadership that Shri Vajpayee as a Prime Minister inducted Omar Abdullah as a Minister in the Central government who enjoyed power for two years.

The NC and BJP remained thick friends for over a decade and neither of the party found fault with each other. He asked how suddenly BJP has decided to change its horse from NC to PDP? Mr. Sharma also asked the BJP to let the people know if the BJPleadership is going to divorce talks (dialogue) with Mufti sahib because Mufti had a secret parley with Hurriyat Spokesman namely, Prof.Abdul Ghani Bhat only yesterday. Mr. Modi had shut his talks with Pakistan even refused to shake hand with Pakistan Prime Minister Nawaz Sharief when they attended the same conference in Kathmandu, Nepal. Prime Minister Modi reached this stage of total boycott with Pakistan on the ground that Pakistan High Commissioner (Ambassador) in Delhi happened to meet same Hurriyat leaders in New Delhi who met Mr. Mufti yesterday.

Mr. Sharma questioned the double standards on the part of Prime Minister Modi and invited him to hold a debate on the double standards and the failing policy on the part of Prime Minister Modi vis-à-vis Jammu and Kashmir on an open platform with Panthers Party Supremo Prof.Bhim Singh. Shall he do so? Shall he continue dialogue with PDP? Shall he choose some other horses to ride power in J&K?
