Bhim Singh calls on J&K Governor, interacts with stakeholders and NPP leaders in Srinagar

Prof.Bhim Singh, Chief Patron of National Panthers Party and fighter for human rights and peace arrived Srinagar today. He was received by several Panthers Party leaders at the airport who briefed him about the ‘explosive’ situation that has been flooding in the Valley for the past 52 days and remained unabetted.

          Prof.Bhim Singh drove from the airport straight to Raj Bhawan and met Shri N.N. Vohra, the Governor of J&K. Prof.Bhim Singh discussed the present turmoil with J&K Governor and urged for his intervention under Section 92 of J&K Constitution so that peace is brought back in Kashmir and confidence of the people is restored.

          Prof.Bhim Singh also held an urgent meeting with the senior leaders of the Panthers Party in Kashmir including Shri Masood Andrabi, Vice President-NPP, Shri Manjoor Ahmed Naik, General Secretary, Shri Farooq Ahmed Dar, Provincial President (Kashmir Province), Shri Maqbool Malik, State Secretary, Shri Mehboob Illahi, Press Secretary and others.

          Two hours indoor meeting of the Panthers Party leaders discussed the role that Panthers Party is destined to play to restore peace in the state of J&K so that confidence of the youth in the system is restored. The Panthers Party leadership in Kashmir Valley is of the view that all kinds of violence and violation of law should be stopped forthwith and the minor youth detained/arrested should be allowed to return to their homes. Prof.Bhim Singh that Constitution of India does not allow children/minors to be detained in the jails/prisons/police stations.

Prof.Bhim Singh expressed hope that the Governor Rule shall be imposed in J&K which shall be in the interest of the people of the entire state at present. The Panthers Party also made an appeal to the people of the Valley particularly the youth and students to ensure that violence is completely kept out of the movement and peace is given a chance.

Prof.Bhim Singh said that he would like to visit all the important places in the Valley including Karnah, Kupwara, Baramullah, Pattan, Mattan, Anantnag and all other places which have been affected by violence. Prof.Bhim Singh assured the people of the Kashmir particularly the youth that the Panthers Party shall continue their fight democratically from Srinagar, Lal Chowk to the doors of the Supreme Court seeking justice and equity for all and end of guns may they be ballot or bullet. The Panthers Party urged the Governor to intervene within his authority to ban use of all kinds of guns and bullets against the children and the youth.

Prof.Bhim Singh shall be meeting the prominent leaders of Hurriyat Conference during his stay in Srinagar. Panthers Party appealed to the bleeding youth of Kashmir that love is the most important weapon when the battle is for human rights and justice. He assured the people of J&K that Panthers Party shall continue its battle from the streets to the Supreme Court to ensure that justice is delivered to all whether in Ladakh, Kashmir or Jammu

Sub:- Your Excellency’s intervention is needed to avoid disaster in J&K.

Your Excellency, Sir,
The political ‘quake’ in Jammu and Kashmir following unfortunate and sad demise of Mufti Mohd. Sayeed has disturbed the political and social combinations and permutations in J&K. There is no political party which is having even one-third’s of MLAs in the Assembly. The disgusting alliance between the PDP and BJP could not enjoy acceptability of the people of J&K for many reasons. It was the personal initiative of Mufti Mohd. Sayeed that ‘hawks’ and ‘doves’ could be caged together and thirst for power was the biggest factor.
After the departure of Mufti Mohd. Sayeed from the political scene there is no ground/reason which will help the two parties, PDP and BJP to go together in J&K. There are several factors which need no further elaboration vis-à-vis the political instability in J&K. The important point is that there is no single party which has a strength of one-third even in the Assembly of 87.
The PDP headed by Mrs. Mehbooba Mufti, Member Lok Sabha has only 27 MLAs and there is no political equation or understanding with BJP which has 25 MLAs. The two parties ruled in J&K and that was possible only with the political wisdom of Mufti Mohd. Sayeed who worked as Union Home Minister with the government of Shri V.P. Singh. Now the situation stands changed. There are three vertical divisions in the PDP. The BJP is also a divided house. BJP has been supporting the government only to swallow their share in the loot which was possible only by sharing power in the state.
One group in the PDP is controlled by a lobby hostile to the Constitution of India. Another group in the PDP is opposed to Mehbooba Mufti for different reasons. The BJP has lost its base in Jammu Pradesh because the people realized that BJP had no commitment to uphold the national cause or the Constitution. There is a way and a strong way in support of reorganization of the state of J&K and the BJP has lost its credibility among their own supporters and voters. This is the reason that the BJP leadership in J&K has started licking up the shoes of the Kashmiri leadership.
I am making this submission to Your Excellency to request for your urgent intervention in the interest of unity, integrity and sovereignty of the entire nation by your personal intervention to save the situation in J&K by your kind advice to the Governor of J&K to dissolve J&K Assembly by invoking Section 53 (2) (b) of the Constitution of J&K. Section 53 (2)(b) has vested power in the Governor of J&K to dissolve the Legislative Assembly. This exercise was challenged in the High Court of J&K when Shri Jagmohan, the then Governor dissolved the Legislative Assembly in 1990. The High Court in its judgment upheld the power/authority of the Governor to dissolve the Legislative Assembly. The situation today demands that the present Legislative Assembly needs to be dissolved without any delay as Legislative Assembly is not capable to function and deliver.
This is further requested that the delimitation process was throttled by the previous governments and there has been delimitation of the Assembly constituencies since 1995. In J&K the life of an Assembly is six years and there has been no delimitation of the Assembly constituencies since 1995 though four districts were added in Jammu and six in Kashmir Valley. There are several Assembly constituencies which fall in two districts which is against the mandate of the Peoples Representation Act. Similarly, seven constituencies are reserved for the SC only in Jammu province. They have been under reservation since 1996 and there is no hope for the rotation of reserved constituencies for another 30 years. The reserved constituencies throughout the country were rotated in 2001 by a National Commission appointed by the Parliament of India under the Chairmanship of Justice Kuldip Singh. This was unfortunate that this commission was not extended to J&K.
The President of India is empowered by Article 370 of the Constitution of India to amend any part or provision in this Article. The Hon’ble President is empowered to make any amendment in Article 370. This is the right time that Article 370 is amended by the President of India who enjoys exclusive power to do so. It is urged that President of India should amend Article 370 so as to establish Indian state of J&K as confederation of J&K. The President may be pleased to reconstitute the state as confederation of J&K by establishing twin states namely, Jammu State and Kashmir Ghati State. The Ladakh region may be brought in the list of Union Territories after seeking the opinion of the Ladakhies. This is also pertinent to mention that each state within the confederation should have controlled over the subjects enumerated in the State List. The concurrent list may be shared by both the states. The state can continue as twin states with one Governor and one High Court.
Your Excellency I hope and trust that you shall be gracious enough to consider my suggestions I have mentioned above after a living experiment of 50 years in the political battlefield of J&K. Your Excellency has been entrusted full power/authority by the Constitution of India to deal with Article 370 of the Indian Constitution which was introduced on 26th January, 1950 to deal with J&K where Monarchy was not abolished (what reasons, this is not right time to discuss this fact). Monarchy was abolished by the Constituent Assembly on 20th August, 1952 under the leadership of Sheikh Mohd. Abdullah. This brought an end to Article 370. It trailed behind due to the failure of the Parliament of India at that time. Article 370 had lost its existence at that time only. It is now a dead snake having no legal effect or constitutional validity.
I am sure Your Excellency may be pleased to go through by submission and take appropriate measures as the President of India having full authority and competence to deal with Article 370 and integrate the entire state of J&K with the Union of India w.e.f. 27th October, 1947.

Bhim Singh’s tributes to Mufti Mohd. Sayeed

Prof.Bhim Singh, Chief Patron of National Panthers Party paid tributes to Mufti Mohd. Sayeed, the Chief Minister of J&K who died at AIIMS, New Delhi this morning, describing him as an undaunted nationalist leader from J&K who was the only Kashmiri Muslim leader who rose to the position of the Union Home Minister of India when Shri V.P. Singh was the Prime Minister.


Prof. Bhim Singh said that it was Mufti Mohd. Sayeed the Pradesh President of Congress Party who served the state for over 20 years. He expressed his gratitude to Mufti Mohd. Sayeed for allotting him Congress mandate in Chenani (Udhampur) Assembly Constituency in 1977 when he (Bhim Singh) was among the seven Congress MLAs in J&K.

          Prof.Bhim Singh said that Mufti sahib had written a political history of J&K with his courage and commitment to Indian nationalism by signing an Accord with RSS controlled BJP in J&K. He said that this was a calculated yet grave risk that Mufti sahib took to form government with BJP (RSS) in a Muslim majority state facing heavy knocks and pressure from all his friends and secular parties with whom Mufti sahib had lasting commitment. It was this Union which made him to suffer from a shock in the last week of the last month of 2014 in Srinagar. NPP Supremo said that in spite of several differences with Mufti sahib, he continued admiring Mufti courage, commitment and nationalist outlook which he carried all his life and during his undaunted struggle in political life.

          Prof.Bhim Singh in his condolence message to the family members of Mufti sahib and to his admirers and supporters expressed a deep shock on the death of Mufti sahib which certainly has created unimaginable gap in the political arena of Jammu, Kashmir and Ladakh.

          The NPP held a condolence meeting at Jantar Mantar, New Delhi where Panthers Party office in exile has been functioning now where the party activists paid rich tributes to Mufti sahib and expressed sympathies which Ms. Mehbooba Mufti, MP and other members of the family.   

CPI (M) repeats blunder of 1942 on J&K, repeats its commitment for separate J&K

Prof.Bhim Singh, Chief Patron of National Panthers Party & Sr. Advocate in the Supreme Court besides Executive Chairman (Hony.) of State Legal Aid Committee has demanded an apology from the CPI (M) leadership for inciting the Indian citizens in J&K for secession by declaring,

“We (CPI-M) reiterate our stand that the nomenclature of constitutional positions as defined in the Article 370 is irrevocable and the changes brought in during the last few decades are not only arbitrary but ultra vires to the Constitution of India and Jammu and Kashmir.”

Prof.Bhim Singh reacting sharply on this declaration of CPI (M) which claims to be a nationalist party said that the Communist Party has been playing havoc with the unity of the country. He said that it was Communist Party in 1942 which passed a unanimous resolution asking for independence of Jammu and Kashmir. Prof.Bhim Singh said that the Communist Party leadership dissected USSR into more than 15 States. This was its own commitment to their own motherland. He said that the Communist Party has no commitment to the national unity or national integration which is obvious from the stand of the CPI (M) vis-à-vis Jammu and Kashmir. Prof.Bhim Singh said that the people of J&K irrespective of their religious or regional affiliations stood for India and have been working as loyal citizens of India in spite of international interference by CIA, ISI and other anti-India agencies. He questioned the CPI (M) about the party’s loyality to India and charged CPI (M) as a co-partioner with the Anglo-American Bloc to dissect India in the North and in the East which has come on surface once again in 2015. Prof.Bhim Singh demanded that CPI (M) should be de-recognized with an immediate effect and all its Legislators as well as Member of Parliament should be subjected to take public oath declaring their full faith in the Indian Constitution as well as in National Integration.

Prof.Bhim Singh said that Article 370 was a transitory and temporary when it was inserted in 1949 into the Indian Constitution for the reason that J&K was allowed by the Constituent Assembly to continue as a Monarchy under Maharaja Hari Singh. Prof.Bhim Singh said that it was on the resolution/recommendation of J&K Constituent Assembly headed by Sheikh Mohd. Abdullah that Monarchy was abolished on August 20, 1952 and J&K became an integral part of the Union of India like other over 500 states. Prof.Bhim Singh reminded the CPI(M) and other adventurist parties that Union of India admitted Hyderabad and Junagarh into the Indian Union in 1950 when Constitution was formally launched on January 26, 1950. He said that the Congress and the Communist had committed a blunder in 1950 by keeping J&K out of the Union List. He said that this issue was resolved when the Monarch was removed on August 20, 1952 by the J&K Constituent Assembly. Prof.Bhim Singh questioned the validity of Article 370 and asserted that Article 370 was provisional, transitory and temporary that was abolished by the J&K Constituent Assembly under the leadership of Sheikh Mohd. Abdullah.

Prof.Bhim Singh asserted that J&K has been an integral part of the Indian Union like any other state. He said that Baroda (Gujarat) acceded to the Union of India in 1948 and was recognized by the Parliament as the Constituent of the Indian Union how J&K could be termed otherwise.

Prof.Bhim Singh said that J&K is integral part of the Union of India and the dispute is only about the areas of the state which are under the illegal occupation of China (20,000 sq. miles in Ladakh region) and over 32,000 sq. miles under the illegal occupation of Pakistan which include 4600 sq. miles of our territory which Pakistan calls as ‘Azad Kashmir’ besides 28,000 sq. miles of our territory under the illegal occupation of Pakistan (Gilgit-Baltistan). Prof.Bhim Singh also expressed shock that nearly 5000 sq. miles of J&K’s territory has been under the illegal occupation of China (Karakoram Highway) since 1963 when the occupied territory was handed over by Pakistan to China.

Prof.Bhim Singh gave a call to all the nationalists, particularly the youth, students and intelligentsia to launch a movement throughout the country against the enemies of the country. J&K deserves (legally and geographically) to be reorganized into three states, Ladakh-Gilgit, Kashmir Vally and Jammu Pradesh (from Kathua to Gilgit). He said that half of the population of the state living under illegal occupation of China, Pakistan should be given a choice to choose their future.

Prof.Bhim Singh said that the people of J&K (India) are committed to live and die as Indian citizens and continue as peace-loving, secular and nationalist souls. Prof.Bhim Singh said that the so-called judgment of J&K High Court this week defining Article 370 as a lasting weapon for the enemies of the Union of India should be condemned. He demanded immediate removal of the High Court judges from J&K who have been giving shelter to the enemies of India and provoking the innocent citizens against the Union of India. He said that entire State of J&K is India and anyone, may it be High Court, trying to incite the people against the Union of India must be dealt with laws of the country.

Reorganization of J&K is the only way out for lasting peace & National Integration

Addressing a rally of political activists from different parts of the country at Jantar Mantar, New Delhi this afternoon, Prof.Bhim Singh, Chief Patron of J&K National Panthers Party & Member of National Integration Council advocated with strong note and compassion that the resolution of J&K lies in the reorganization of the state and reconstituting all the three regions namely, Ladakh-Gilgit, Kashmir Valley and Jammu Pradesh on the basis of geographical, cultural and ethnic basis to ensure that the citizens of India in J&K enjoy social, cultural and political freedom and also strengthen their cultural bonds as nature has entrusted in the people of each region since the establishment of each region. NPP Supremo has been advocating for the reorganization of J&K ever since the establishment of the Panthers Party in the state.

          Prof.Bhim Singh said that the leaders in J&K irrespective of their political affiliations have been acting as agents of political hawks since 1947. He said that Ladakh-Gilgit has its own cultural identity and entity and nature has confined them in a different situation in the Himalayas. The Kashmir Valley has its own identity and geographical recognition with its language and cultural unique entity. Kashmir’s merger was a unique contribution of the Dogra Maharaja Gulab Singh assisted by General Zorawar Singh with Jammu State (Muzaffrabad to Kishtwar) in 1942.

          Prof.Bhim Singh said that in 1947, hundred years after the Treaty of Amritsar signed in 1846, J&K was established by Maharaja Gulab Singh Kashmir and Ladakh (Gilgit) became parts of J&K. That India was reorganized and this process continued for years and still continuing. Gujarat later was divided into Gujarat and Maharashtra. Assam was divided into seven states. Punjab, Bihar and other states were also reorganized on the linguistic, cultural, geographical and other disciplines.

          Prof.Bhim Singh said that the situation in J&K could not be addressed for several factors. 28,000 sq. miles of India’s territory (Gilgit-Baltistan) is under Pakistan’s direct control. 4,500 sq.miles (Karakoram) of J&K’s territory is under the illegal occupation of China. Nearly 5,000 sq. miles is under Pak occupation, which Pak called as ‘Azad Kashmir’. China has been occupying nearly 20,000 sq. miles of J&K territory in the Ladakh region. Mathematically speaking India does not have even one-half of the territory of J&K which was established by the Dogras under their unique leadership of Maharaja Gulab Singh, General Zorawar Singh, General Baaz Singh and others.

          Prof.Bhim Singh accused the Delhi leadership, may it be Congress, Communist, Jan Sangh (BJP) or others for keeping the entire nation in dark about the history and geographical situation of the State of J&K that was founded by the great Dogras between 1817 and 1846.

          Prof.Bhim Singh called on the members of the Parliament and the political parties all over the country to initiate a debate/discussion on the socio-cultural and historical background of J&K so that the new generations shall understand the meaning and significance of J&K.

          Prof.Bhim Singh declared that he shall associate the intellectuals and the progressive youth leaders from all over the country to go around India with a message of national unity and integration. He said J&K is as an integral part of the Indian Union as is entire North-East (Assam and other states in the region). He said that the Parliament of India, unfortunately, has not been able to understand the political, social and historical roots of Indian nationalism vis-à-vis J&K, North-East and other regions which form lasting parts of India. Prof.Bhim Singh strongly advocated for the reorganization of J&K by establishing Ladakh-Baltistan as northern unit, Kashmir Valley and Jammu Pradesh as its integral constituents, so that the Ladakhies, Kashmiries and the Dogras shall enjoy their regional entity and identity.  

          Prof.Bhim Singh hoped that Prime Minister Modi shall try to understand the geography, the history and the social standards of the people of India from all over the country; Kashmir to Kanyakumari and Dwarka to Kohima (Nagaland). He said that the Panthers Party shall start this movement for integration of the country in April, 2016 from Kanyakumari to Kashmir and Nagaland to Gujarat. He invited all those who are interested in this movement, National Integration from the roots.
