President urged to intervene under Section 92 of J&K Constitution to impose Governor Rule in J&K

Prof.Bhim Singh, Chief Patron of National Panthers Party urged President of India, Shri Pranab Mukherjee to intervene under Section 92 of J&K Constitution (that is his exclusive right) to dismiss the deserted government of the state which is lost its absolute authority and defiance by the civil society has crossed all the limits provided in the domain of the Constitution of J&K. Prof.Bhim Singh who is also Executive Chairman of State Legal Aid Committee & Senior Advocate of the Supreme Court of India urged President of India to exercise his powers vested in him in exclusive terms as he is the only authority who opted his subjective satisfaction can intervene into the affairs of J&K to restore normalcy and bring to an end all actions/activities endangering the security of the state and the life and liberty of the citizens of India residing in the State of J&K.

          Prof.Bhim Singh also urged Govt. of India to understand that there is a grave threat to the security of the state fomented by th enemies of the country to need to be tackled immediately without any further delay. Prof.Bhim Singh said that it is only the President of India who has been vested power to deal with such situation as has arisen in J&K and has reached nearly two months causing a grave threat to the physical survival of the general public because all communications are broke, all public and private institutions including colleges, schools, hospitals even the courts including the High Court have been put out of work and function causing desperate situation for a common man and the public at large. Prof.Bhim Singh said that he had experienced all the situations during his three-day stay in Srinagar, almost in hiding and managed to interact with the people of the civil society placed at different levels in the city of Srinagar.

          Prof.Bhim Singh in his urgent appeal to the President of India hoped that Shri Pranab Mukherjee may be pleased to act at the earliest in the interest of national integrity and national integration. Prof.Bhim Singh said the proposed visit of Members of Parliament from New Delhi to Kashmir shall be futile exercise of the BJP leadership of Delhi to find out a way to save the RSS government in J&K functioning for the first and last time under the PDP cover in the state. He said that President of India has a great responsibility and therefore it is hoped that he shall exercise his power under the command of Article 370 of the Constitution of India.

NPP activists held a protest demonstration at Jantar Mantar, New Delhi demanding Governor Rule in Jammu and Kashmir State to save the crown of India from devastation. The hundreds of Panthers Party activists led by Prof. Bhim Singh Chief Patron NPP and other senior leaders including Delhi Pradesh President, Shri Rajiv Jolly Khosla, Vice-President Shri Romesh Khajuria, General Secretary Mr. Beig and others made a strong protest at Jantar Mantar also five hundreds meter away from the Parliament House demanding imposition of Governor rule in the interest of general public and national interest without any delay.

The NPP demonstrators called on the President of India, Shri Pranav Mukherjee to exercise his exclusive power under article 370 of the Indian Constitution which empowers him alone to command Governor of J&K under section 92 of the J&K Constitution to impose Governor Rule in J&K by dismissing the state government in the national interest and security of the state.

Prof. Bhim Singh appealed to the Parliament of India and the national leadership to support this voice for the security and safety of the entire nation which is under a serious threat today. Prof. Bhim Singh also declared that Panthers Party shall sit on fast in front of Prime Minister House if Governor Rule is not imposed within 24 hours.

NPP Supremo urges President’s intervention to save J&K from death and destruction

Prof.Bhim Singh, Chief Patron of National Panthers Party urged Shri Pranab Kumar Mukherjee, President of India for his intervention as constitutional head of the Union of India and the only intervening authority vis-à-vis the constitutional crisis in J&K under Article 370.

          NPP Supremo described the present situation in J&K as alarming as there is no governance at all as the Governor cannot exercise his executive or administrative or legislative power as the Govt.of India has created a dangerous situation by proposing a coalition government with the state political party PDP. He blamed Modi government for the present chaos, lawlessness and the dangerous situation that emerging in J&K because of no governance. He said that nearly three months have gone and no government could be constituted in the state because of the BJP’s intention to become a partner in the government to share the loot in the state.

          Prof.Bhim Singh said that the Modi government is responsible for the present situation that has emerged in the state of J&K. He said that the President of India is empowered to intervene in the situation to save the state from total chaos by his intervention under Article 370. He said that the Constitution of India does not allow the Union of India to interfere or intervene in any crisis prevailing in the state of J&K. Without going into the merits or the merits of the command of Article 370, Prof.Bhim Singh said that national interest is more important than the RSS/BJP’s interest because a nation is the first priority and deserves immediate attention in the interest of national integration.

          Prof.Bhim Singh while addressing the advocates, Legal Aid Committee at Jantar Mantar urged the President to intervene under Article 370 and go for dissolution of State Assembly so that fresh election may be held without delay. He said that Article 370 provides full power to the President of India to intervene in the situation to save the unity, integrity and sovereignty of India. He said that sub-clause 3 in Article 370 has become infructuous for the reason that there is no constituent assembly present at the moment. Clause 3 has become infructuous and has to be considered as dead letter. It is therefore the President of India by virtue of Article 370 who can intervene in the same way and with the same capacity as the Viceroy of India enjoy power and constitutional authority.

          Prof.Bhim Singh appealed to the intellectuals, secular and democratic political leadership in the country to support this motion in the interest of National Integration and the secularism.

President urged to intervene for dismissal of J&K Govt. in the greater national interest & integration

Addressing a huge gathering of activists from different parts of the country and different political schools of thought, Prof.Bhim Singh urged Shri Pranab Mukherjee, the President of India to intervene under section 92 of J&K Constitution and Article 356 of Constitution of Indiawhich makes it obligatory for the President of India to assume to;

(a)          himself all or any of the functions of the state and further

(b)          declared that powers of the Legislature of the state shall be exercisable by or under the authority of Parliament.   

This is the absolute power vested in the President of India and it is in the interest of unity, integrity and the security of the country that the government in J&K be dismissed and the Governor of the state should be given all legislative and executive powers as provided in Section 92 of J&K Constitution.

This situation has arisen for several reasons mainly because of the collapse of the present government in J&K due to health condition of phentermine while he is under care in the intensive care center in AIIMS (All India Medical Institute, New Delhi). The enemies of the country across the Indian borders have been indulging in gross violation of international borders and Line of Control across J&K with an intention to sabotage peace in J&K thus endangering the security of the country.

Prof.Bhim Singh urged Shri Pranab Mukherjee, President of India for his urgent intervention by dismissing the present government in J&K and imposing Governor Rule under Section 92 of J&K Constitution read with Article 356 of Constitution of India in the interest of security of the entire nation which stands threatened. Pathankote episode is a living example.

Prof.Bhim Singh in his appeal to all the political parties in the country urged for the support in favour of Governor Rule in J&K (President’s rule in J&K cannot be imposed in J&K Constitution of India does not apply to J&K directly). The President’s rule can be extended six months’ after the Governor Rule.

Prof.Bhim Singh called all the political parties in the state including the Hurriyat Conference to support this move in the common interest of all the residents of the state so that peace does not suffer any casuality in the sub-continent. He also appealed to the Panthers Party activists to take this movement on the streets in J&K in the interest of peace, progress and security.

Legal fraternity welcomes Justice Thakur as new Chief Justice of India

State Legal Aid Committee, J&K today welcomed the new Chief Justice of India, Justice T.S. Thakur who enjoys tremendous credibility as a jurist and popularity as a justice. Prof.Bhim Singh, Sr. Advocate & Executive Chairman of the State Legal Aid Committee also presented red-rose flowers to Chief Justice, Mr. T.S. Thakur who was administered the oath of office at Rashtrapati Bhawan this morning by the Hon’ble President of India, Shri Pranab Mukherjee in the presence of members of the lawyers fraternity from all over the country.

Several lawyers also came from J&K and presented flowers and bouquets. They included M/s. H.C. Jalmeria, O.P. Sharma and others.

Prof.Bhim Singh while addressing the members of the State Legal Aid Committee expressed hope that the cases shall be heard on the basis of urgency to ensure that justice is not delayed or denied. He in a welcome letter addressed to the new Chjef Justice of India hoped that the State Legal Aid Committee in the Supreme Court shall be activated so that justice is not delayed as it has been happening for the past 10/15 years. He said that all cases concerning human and fundamental rights of the citizens shall be taken on priority. He also hoped that the cases pending in the Supreme Court concerning human rights and civil liberties shall be taken on priority. He appealed the revolutionary Chief Justice to take up all human right cases including those connected with fundamental and civil rights of the citizens as well as others within the meaning and scope of Article 21 of the Constitution of India which applies to the citizens of India as well as to the non-citizens.

Prof.Bhim Singh hoped that the revolutionary Chief Justice shall come true to the expectations of the wretched of earth and the penny-less justice seekers in the country.

Prof.Bhim Singh has been fighting in the courts and the streets for the poor, helpless and penny-less human beings and made a history in the field of human rights and speedy justice for those who could not dream even entering the doors of the High Courts or the Supreme Court.
