Sub:-Petition to the Hon’ble Speaker to introduce amendment in Article 370 for the safety, security and integrity of the nation.


Hon’ble Speaker, Madam,

Jammu and Kashmir National Panthers Party is submitting the following amendment in Article 370 of the Constitution of India to be introduced and carried in the Constitution of India in the interest of national integrity, security and unity of India.

It is submitted that a temporary provision under the name and style, “Temporary provision-Article 370” was inserted in the Constitution of India as a temporary faith at the time of promulgation of the Constitution of India on 26th January, 1950. This Article was temporary and heavily defended by the Chairman of the Constituent Assembly Dr. Bhimrao Ambedkar. This was assured that this provision was temporary and would not continue long.

The blunder committed by the Constituent Assembly cannot be ignored by keeping State of J&K out of the Union of India and the State ruler Maharaja Hari Singh was forced to continue as Ruler. J&K was only state which was not merged into the Union of India by the Constituent Assembly. This blunder has proved a disaster for the national unity and the Parliament has not till date declared the merger of J&K with the Union of India.

That Article 370 has turned out to becancer’ in the heart of the Constitution of India and the responsibility for this tragedy lies on the Parliament of India which has failed to take appropriate action in 67 years or so.

The Panthers Party urged on the Hon’ble Speaker to introduce amendment in Article 370 in the Constitution of India by deleting Clause (3) of Article 370 which bars the supreme power of the Parliament to amend any (a) provision of Article 370.

It is submitted that India is one from J&K to Kanyakumari and therefore one nation cannot be governed by the separate Constitution. The Parliament of India is fully competent to amend Article 370 and extend the domain of the Constitution of India from Kashmir to Kanyakumari with one flag and one constitution.

demo-370The Panthers Party would like to submit before the Parliament that the Parliament should act boldly in the interest of unity, integrity and sovereignty of India from J&K to Kanyakumari. The power of Parliament to legislate in respect of the subjects mentioned in List-I of Schedule-VII should be restored in respect of J&K which acceded to the Union of India under the seal and signatures of the then ruler of J&K, Maharaja Hari Singh. This decision of the ruler of J&K was in accordance with the dictates of the Instrument of Accession. Similar Instruments of Accession signed by 577 Rulers/Maharajas/Nawabs of their respective states were accepted by the Constituent Assembly keeping J&K away but expelled the Maharaja from J&K state for personal vengeance.

            The Parliament of India must exercise its supreme power to amend temporary provision of Article 370 which is possible only by a majority vote as this is an ordinary amendment to amend only a temporary provision. Parliament of India under the leadership of Prime Minister Morarji Desai removed right to property (Article 31) from the Chapter of Fundamental Rights. If Parliament can amend a provision relating to fundamental rights, what stops that Parliament to amend/remove a temporary provision (Article 370) which was inserted into the Constitution for only avenging the ruler of Kashmir for personal vendetta.

            The Panthers Party would like to make a strong appeal to Hon’ble Members of Parliament to take this most needed step to ensure that there is one Constitution and one Flag for the entire Union of India from Kashmir to Kanyakumari and Gujarat to Nagaland. The people in J&K have been suffering for want of fundamental rights which are not applicable to the residents of J&K as the fundamental rights are not available in the so-called Constitution of J&K.

            This is strong submission by J&K National Panthers Party that the residents of J&K being citizens of India may be extended all fundamental rights without any delay. There is a need to dissolve the present Assembly in J&K, dismiss the Government in the state and invoke Section 92 of the J&K Constitution so that the Governor Rule is imposed without any delay to ensure return of peace and fundamental rights to every citizen of India residing in J&K.

Bhim Singh calls on nationalist forces to support NPP Bandh Call on 7th April to demolish anti-India seedlings

Addressing a huge rally at Jantar Mantar this afternoon, Prof.Bhim Singh, Chief Patron of National Panthers Party called on nationalist forces, groups and students and youth to jointly support the Bandh Call on 7th April, 2016 in Jammu Pradesh given by J&K National Panthers Party to strengthen the secular, nationalist and progressive forces in the State of J&K which is facing a serious threat by the anti-national, anti-India and communal forces in the state of J&K.

          Prof.Bhim Singh strongly condemned the state machinery in J&K for its total failure to silence the voice against national integration to please a handful of elements who are supported, sponsored and financed by frustrated, anti-national and corrupt elements in the state. Prof.Bhim Singh said that he has been hearing all these nonsense from 1957 when he joined GGM Science College as a student. He blamed the communal and foreign agents operating at the behest of ISI and other foreign saboteurs who intend to destabilize India because many countries in the West are not happy to watch India growing faster and joining the family of developed countries in the world.

          Prof.Bhim Singh said that all the nationalist forces including Ladakhies, Kashmiries, Dogras, Paharies, Buddhists and all are committed for the development of the state which is possible only by the reorganization of the state which is possible through the amendment in Article 370 of the Indian Constitution.

Prof.Bhim Singh said that Bandh Call given by the Panthers Party with the support and cooperation of several organizations is to ensure justice to every individual and group or groups of people in J&K. He said this Bandh Call, though given at very short notice, yet is highly important to convey to Delhi that the people of J&K deserve justice and equity at all levels.

Prof.Bhim Singh appealed to all the youth, students, political organizations, traders, employees, the media persons and the working class to show unity to slap the enemies of the country to prove that India is one from Kashmir to Kanyakumari.

Governor should dissolve Assembly save parliamentary democracy

Prof. Bhim Singh, Chief Patron of NPP urged Governor of J&K, Shri N.N. Vohra to act in accordance with the Constitution of the state and the mandate which he enjoys under the Constitution. There is no possibility to constitute a government in J&K within the meaning and scope of the State Constitution.  The only way out is ending of the present Assembly and fresh elections so that the people of Jammu and Kashmir may elect the government of their choice.

Prof. Bhim Singh said that BJP and PDP have been running poles apart and do not have any common agenda except loot and plunder.  Prof. Bhim Singh urged the Governor to not to allow the hawks and doves to fly in the same aircraft across desert of power politics.

Prof. Bhim Singh said that entire political system has sunk deep into the Jhelum and the Chenab and the present leadership around the state has no capacity, strength or commitment to invoke political morality in the state.  It is only Panthers Party and some individuals who are committed to morality and rule of truth.

Alarming situation along border areas in Jammu Pradesh

Prof.Bhim Singh, Chief Patron of National Panthers Party with his Panthers Party team with senior NPP leaders addressed several public meetings in Sai, R.S.Pura, Suchetgarh and other areas bordering with Pakistan on International Border. Addressing public meeting Prof.Bhim Singh urged Parliament of India to forego the blunders committed by the Indian leadership and the Parliamentarians since 1947 vis-à-vis Jammu and Kashmir. Prof.Bhim Singh urged Parliament to cure the blunders committed by the Parliament and the Indian leaders since 1947 vis-à-vis J&K.

Prof.Bhim Singh accused the Congress and BJP leadership in particular for the present mess in J&K. He said that Article 370 was the biggest blunder committed by the national leadership in 1950 when Constitution of India was promulgated. He said that Monarchy (Maharaja Rule) was allowed to continue in spite of the fact that the Maharaja was exiled from Kashmir to Bombay in 1948.

Addressing several rallies along the Indo-Pak border Prof.Bhim Singh pleaded for permanent peace from the borders between India and Pakistan as the people of both sides desire peace and intend to live in peace.

Prof.Bhim Singh also urged the President of India to use his constitutional authority and advised Governor of J&K to dissolve the State Assembly which has become irrelevant an extra burden on the state exchequer. Prof.Bhim Singh also accused both BJP and the Congress for misleading the national opinion regarding the actual state of affairs in J&K.

Prof.Bhim Singh gave a call for the establishment of ‘twin states’, Jammu Pradesh and Kashmir Valley state in J&K so that people in Ladakh region may also realize their demand for the status of Union Territory.

Prof.Bhim Singh was accompanied Ms. Anita Thakur, Ashok Randawa (Provincial Secretary), Sham Gorkha (Vice-President PTU) and Advocate Kesar Parveen (Secretary Women Wing Panthers Party).

Prof.Bhim Singh with Panthers Party leaders who started around Jammu Pradesh political movement on 8th March, 2016 reached Batote from Ramban with their strong mission for Reorganization of J&K and establishment of Jammu Pradesh and Kashmir State, addressed Panthers Party meetings in Doda and Bhadarwah.  He invited the Panthers Party activists to participate in the 34th Foundation Day of the Panthers Party being held in Parade Ground Jammu on 23rd March, 2016

Prof.Bhim Singh appealed the people of Jammu Pradesh and Kashmir Valley to support the movement of the Panthers Party for the establishment Jammu State and Kashmir Valley State in the interest of the people of Jammu and Kashmir who have been suffering for want of equity, justice and civil & fundamental rights. He said that Article 370 became dead on August 20, 1952 when the Constituent Assembly of Jammu and Kashmir under the leadership of Sheikh Mohd. Abdullah abolished Monarchy in the state while Maharaja Hari Singh was living in exile in Bombay in 1961. Prof. Bhim Singh said that it was the blunder on the part of the national leadership, who it may be, for keeping the dead body of Article 370 in the shape of a Cobra. He said that Jammu and Kashmir was not merged with the Union of India in 1950 and it merged automatically the day Jammu and Kashmir merged with the union of India on 20th August, 1952 when monarchy was abolished. He said an Article 370 has become infructuous and redundant since then. He said that time has come the people of Jammu and Kashmir should be given benefit of all fundamental rights in the Constitution of India as are enjoyed by rest of the Indian citizens.

The meeting was addressed by several Panthers Party leaders and the Panthers Party Celebration Committee of 11 members was formed. Prof. Bhim Singh also addressed Panthers Party workers meeting in Bhaderwah (34 kms. to the north) which was presided by Ch. Mohd. Iqbal, State Vice-President of JKNPP.  Bhadarwah Panthers Party in a resolution condemned the state government for ignoring the plight of the people of Bhaderwah which is known as Switzerland of J&K, Bhaderwah has produced national famed personality in the field of defence, education and other fields. 

Prof. Bhim Singh declared that Bhaderwah shall be a Mini-capital of Jammu Pradesh which has an international capacity of tourism with its grand surroundings, forests and natural beauty. The local political activists demanded supply of ration, adequate number of teachers in the school, reconstruction of the 29kms. long road from Bhaderwah to Pull Doda. 

The Party General Secretary Ms. Anita Thakur expressed shock that a leader of opposition in the Rajya Sabha, Mr. Ghulam Nabi Azad who belongs to Bhaderwah has not cared a bit for the welfare of this area when he was Chief Minister for two years. He accused Mr. Azad for assaulting, arresting and ignoring the plight of his own home town when he was CM in 2007. This is matter of shame that Mr. Ghulam Nabi Azad could not repair 29 kms. road from Pull Doda to Bhaderwah which is his home town. 

Prof. Bhim Singh and his Panthers Party leaders move from Bhadarwah to Kishtwar, a historic place where Gen. Zorawar Singh held his Dogra Army Training Camp in 1840 and finally snatched Ladakh from the Chinese occupation by 1842 and made them integral part of Jammu and Kashmir. 

The prominent Panther Party leaders who addressed the rallies in Ramban, Batote, Doda, Bhaderwah and other places included M/s. Sewa Singh Bali (State Gen. Secretary PTU), Shakeel Ahmad, (President District Ramban PTU), Abdul Hamid (Ex-ZEO) President District Doda, Neeraj Singh, Imtyaz Ahmad Zonal (President Kishtwar-Doda), Pritam Kumar (District Secretary Doda) etc. 

Prof. Bhim Singh and party left Pull Doda at 4:00 p.m. for Kishtwar where he shall address the Panthers Party district rally and invite the Panthers Party to participate Panther Party 34th Foundation Day at Parade Ground Jammu on 23rd March 2016.
