Where Modi blundered while addressing public rally in Srinagar on 7th November, 2015

The people of this country were eagerly waiting for the message of the Indian Prime Minister when he addressed a public rally on 7th November, 2015 this year from Srinagar, Kashmir. Not only the people of India but people of Pakistan and POK in particular were betting on Modi’s message to strengthen Indo-Pak ties and continuation of talks as were agreed in the Shimla Agreement in 1972 signed by Mrs. Indira Gandhi and Jenab Zulfiqar Ali Bhutto. Clause 6 of the Agreement has laid down that the Prime Ministers of the two countries shall meet frequently to seek final resolution of the situation.

Prime Minister Modi used his rhetoric voice trying to raise emotional surcharge but without touching the substance or the existing realities. His announcement at the end of speech that he had brought Rs.80,000 crores for J&K was received by artificial cheers, naturally so, because half of the audience were hired or the serving employees in different departments. This was so that the people wanted to attend Prime Minister’s rally dared not come out of their houses because entire Valley was curfew bound. The trains from Banihal to Qazigund, Qazigund to Baramullah were stemmed off for two days. There was no surface transport available for a common man. All offices and educational institutions were shut. I remember that a call for Hartal in Srinagar was even by angry Kashmiri leaders during the visit of the then Prime Minister, Dr. Manmohan Singh. I and many other invitees drove from the Airport to the Guest House to attend the meeting chaired by the Prime Minister. The government was instructed from Delhi that the Prime Minister would not allow a state curfew to help the boycott. It was a different story which was carried by every media person and newspaper that entire Valley was shut because of the state action. It was state sponsored bandh in other words.

The Prime Minister failed to congratulate the Indian Army which has been playing a most constructive role, manning the borders, making sacrifices by laying down their lives for the sake of the nation. The Prime Minister forgot to say a word about the Indian Army which is taking care of the snow covered hills and Siachin glacier. The other blunder Prime Minister committed was his failure to congratulate the people of J&K for showing resistance to the militants and the terrorists. These were the people of J&K who resisted Pakistani aggression in 1947 and defeated terrorism through their constant and consistent resistance for nearly 25 years.

The Prime Minister’s another blunder was to ignore Jammu Pradesh and the problems the people of Jammu Pradesh have been facing right since 1947. He failed to mention the plight of the Jammu Migrants while he did mention the Kashmiri Migrants in his Ramban speech, though casually. The Jammu Migrants have been suffering on the roads, not given any relief by the Central or the State government since 2000. The High Court of J&K and Supreme Court of India ordered J&K government and Govt. of India to pay relief to Jammu Migrants at par with Kashmiri Migrants. It never happened. The Prime Minister promised these migrants during his election campaign in Jammu Pradesh that he shall redress their problems if they voted for him. They voted and the Prime Minister did not care even to mention their plight.

Besides there are nearly 15 lac POK and Pak refugees rotting, sulking and starving in different parts of Jammu Pradesh. The Pakistani refugees nearly one lac have not been given any fundamental rights in J&K because they are not citizens of J&K though born in J&K since 1947. The POK refugees were promised comprehensive settlement. 68 years are over. Third generation is continuing in the same pain and agony. Prime Minister could not find even a word to express his sympathy with them. Entire Jammu and Kathua are facing wrath of Pakistani shelling from across international border with Pakistan. Thousands of people have become shelterless. The children have no schools, the farmers cannot go their fields. They have no shelter to keep their families. Prime Minister could not remember them as well. Prime Minister promised about Rs.5,000 crores for the roads, good paved roads for the Indian and foreign tourists going to the Valley. Prime Minister could not remember or was not informed that there are unknown destinations, most beautiful, attractive where the people do not have shoes to wear or food to eat. They live on ‘sattoos’ (barley) and these places are known to everybody—Marwah, Dachhan, Warwan. There are no roads to reach there. The human beings live a life of cattle. And these places are in Jammu Pradesh in Kishtwar district. The Prime Minister should have been informed that there is a sensitive area in Jammu Pradesh, Poonch which is nearly 250 kms. (west) from Jammu. It takes more than 10 hours to reach there. When Prime Minister declares Udhampur-Banihal road leading to the Valley, why and how he forgot the plight of people of Rajouri and Poonch. They also needed road. They are also citizens of India and facing continues shelling and threats from across the LoC. Was it not blunder on the part of Prime Minister to ignore Poonch-Rajouri.

The most political issue confronting the people of J&K is delimitation of the Assembly constituencies. Kashmir Valley has 46 seats whereas Jammu Pradesh has only 37. The area of Jammu Pradesh is 28,000 sq. kms. as compared to the Valley which has its area of 13,000 sq. kms. The number of electorates in both the provinces is almost same. Delimitation was held throughout India after 2001 census. Why J&K was ignored? Is it not integral part of India? Why Prime Minister ignored this issue?

The Prime Minister yet committed another blunder that he failed to congratulate the people of Jammu, Kashmir and Ladakh for their unique spirit to live in mutual co-existence. The people of J&K are wedded to the composite culture for thousands of years. The Prime Minister did not spare a word to congratulate the people. It is Jammu and Kashmir which is a Muslim majority state yet we have got great holy places like, Shri Amarnath Cave, Mata Vaishno Devi Shrine, Kheer Bhawani, Chhati Badshahi, Shankeracharya Temple, Hazratbal. The Prime Minister failed to appreciate the existing situation and the aspirations of the people of Jammu Pradesh, Kashmir Valley and Ladakh regions. Prime Minister should show his wisdom and courage by declaring let the people of Jammu Pradesh have their state, so Kashmir Valley and Ladakh.

Alas! The Prime Minister Modi dared not say ‘Jai Hind’ after his speech and that was an unfortunate message.

Two states formula is only way out for lasting peace in J&K

Addressing a meeting of Advocates, in New Delhi, Prof.Bhim Singh said that 50% problems in J&K shall be resolved when J&K shall be reorganized into two states, Kashmir Valley and Jammu Pradesh. He also appreciated observations made by Dr. Bhimrao Ambedkar, Chairman of the Constitution Drafting Committee in 1949 on the issue of merger of J&K with the Union of India. Dr. Ambedkar opposed a permanent bar on the issue of merger and word ‘temporary’ with Article 370 was inserted only Dr. Ambedkar said that this provision (Article 370) shall not lost beyond Monarchy in the state. Prof.Bhim Singh questioned the wisdom of those who wanted Monarchy to continue in J&K after promulgation of the Constitution of India. Prof.Bhim Singh questioned the real intention of the Congress party at that time and asked why Monarchy in J&K was allowed to continue beyond 26th January, 1950 when nearly 556 states including Baroda, Hyderabad were merged into the Union of India.

This blunder was realized by Pt. Jawaharlal Nehru in 1953 when he got Prime Minister of J&K, Sheikh Mohd. Abdullah dismissed and arrested for opposing the merger of J&K with Union of India.

Prof.Bhim Singh questioned the wisdom of Parliament of India to ignore this aspect by let Article 370 continue like snake in the manager after January 1957 when J&K Constitution was promulgated on 26th January with clear mandate in Section 3 of J&K Constitution thatJ&K is and shall be an integral part of India. He told lawyers’ fraternity that this constitutional aspect was also ignored by the Parliament of India. He argued that Article 370 became infructuous the day Monarchy was abolished by the Constituent Assembly of J&K on 20th August, 1952 and it became dead the day government appointed by the last Monarch, Maharaja Hari Singh, was dismissed on 8th August, 1953 by the command of Pt. Jawaharlal Nehru.

Answering several questions on the status of J&K constitutional relations with the rest of the country, Prof.Bhim Singh said that Article 370 is dead and gone and the face saving device for the PDP-BJP and the so-called left is only amend it with a proviso that Parliament is competent to legislate on all the subjects listed in List-I of Schedule-VII of the Constitution of India. Parliament needs no consultation or approval of the Govt. of J&K as is the interpretation drawn from the script of Article 370 of Constitution of India.

He appealed to the lawyers’ fraternity all over the country to read Article 370 as it is applied today by the Union of India and the State government. This Article is a real mishap and continuing blunder which must end today which shall help eliminates the anti-national and anti-Union forces inside and outside the State of J&K.

He emphasized on Heart to Heart talks among the political representatives and the members of the civil society at the Intra-J&K, as it existed in 1947. This includes representatives of Gilgit-Baltistan, entire POK and that of J&K. He said that he convened two meetings in 2005 and again in 2007 during the prime minister ship of Dr. Manmohan Singh with a great success and emphatic response from both sides. He assured the lawyers’ fraternity that they shall also be invited in the third Intra J&K Heart to Heart Talks so that peace returns to the state and foreign agents are washed away so that people of the Valley as well as Jammu Pradesh may live in peace, dignity and without fear of the guns.


NPP Supremo urges Governor to dissolve J&K Assembly to end further anarchy, chaos & horse-trading in J&K

“The smokes of disillusionment, uncertainty, chaos and anger have started shooting out of curtains in the political corridors of political parties aspiring to share power and loot in the state. Some busybodies from outside the state have, on the sponsorship of the vested agencies have started pouring fuel to the fire to add to the prevailing confusion. The present situation created power hunger in the central ruling party by Prime Minister Modi’s hunting slogan for 44+ as his mission Kashmir. The political parties aspiring to share power have forgotten their manifestoes, commitment to the people, development and sufferings of the youth, employees, working class and particularly the 15 lacs refugees from POK and Pakistan. Any attempt to forge unholy alliance between the wolf and the lamb shall be disaster for the already suffering people of three regions namely, Ladakh, Kashmir Valley and Jammu Pradesh. The Governor, Shri N.N. Vohra is most experienced bureaucrat and knows the inns and outs of J&K’s complicated politics. He shall do best for the people of the state and for the people in the rest of the country to advice President of India for immediate dissolution of the State Assembly hold fresh election in accordance with the mandate of the Supreme Court judgment dated 08.10.2013 by using ‘paper trail’ with the EVMs so that the manipulation of the EVMs shall be minimized.” This was the reaction Prof.Bhim Singh, NPP Supremo dispatched to the press after reading the statements of Mr. Ali Shah Geelani, Mirwais Moulvi Farooq and PDP’s hot man, Muzaffar Hussein Beg.

            Prof.Bhim Singh reminded the Kashmiri leaders that there shall be no solution to any inner conflict within the state without delimitation of Assembly Constituencies, comprehensive, humanitarian and legitimate resolution of the problems of the Pak and POK refugees as well as honourable, secured, safe and swift return of Kashmiri Pundit Migrants backed to the Valley without delay. He added that those aspiring to form government with PDP must remember that Mufi Mohd. Sayeed had signed agreement with him (Bhim Singh), Mrs. Sonia Gandhi, Dr. Manmohan Singh in the presence of Muzaffar Hussein Beg as well as Mr. Yousuf Tarigami in Delhi on 26th October, 2002. The CMP signed by all of them had put first agreement for holding delimitation of Assembly constituencies, secondly it was the comprehensive settlement of border refugees by allotting them minimum possible land for residential purpose besides bringing PSA regime to an end among other things. He asked Mr. Beg to tell the truth as to what happened to this CMP which was signed by his leader. It was Mr. Muzaffar Hussein Beg who opposed the bill moved by Prof.Bhim Singh in the Legislative Council to end death sentence from the Ranbir Penal Code in the state. It was PDP, he reminded Mr. Modi, which wanted to throw the state married daughters out of their homes and property by enacting a criminal law with the support of the Congress and National Conference. Prof.Bhim Singh questioned Mr. Modi and Mr. Beg to come out clean on the issues people of J&K have been confronting for the past 64 years. He said reorganization is only way out to end the heterogeneous composition of the state founded in 1846 by Maharaja Gulab Singh as the times and history demand today.

J&K Governor urged to provide relief to the border migrants as per direction of SC

“The Supreme Court in writ petition no. 498/2001 filed by J&K National Panthers Party had directed the Govt. of India as well as the State government to provide immediate relief to the migrants forced to run away from their homes along international border during indiscriminate shelling from Pakistan side in 1999/2000. The Supreme Court had also fixed the scale that,

(a).   free Ration @9 kgs (7 Kgs atta and 2 kgs rice in Jammu Division and 7 kgs rice and 2 kgs atta in Kashmir Division) per person per month;

(b).   free Kerosene oil @10 liters per family per month;

(c).   cash amount @Rs.200/- per person per month;

(d).   free medical aid to all the displaced persons;

(e).   Rs.200/- per animal rearing family per month for fodder in those areas which have been mined as identified by respective Deputy Commissioners; and

(f).     free ration at sanctioned scale at the place of residence in case any of the migrants wish to return.”

Panthers Party Supremo urged Shri N.N. Vohra, the Governor of J&K today to remove the confusion created by bureaucracy on the quantum of relief. Prof.Bhim Singh, Sr. Advocate of the Supreme Court also mentioned that the cash relief was raised later. He said that the Govt. of India was directed to provide tents to the shelter-less families. Rs.10 crores was ordered to be invested in this regard.

Prof.Bhim Singh said that keeping in view the weather conditions and temperature below zero it is essential to provide them reasonable bedding facilities, blankets etc. Prof.Bhim Singh also demanded immediate free medical treatment to all such migrants who have been forced to run away from their houses due to heavy shelling from across the border in the districts of Jammu, Samba, Kathua etc. In his communication to Shri N.N. Vohra, Prof.Bhim Singh said that all the records pertaining to Supreme Court directions and orders are available with the Civil Secretariat/ Department of Law of Govt. of J&K. He also demanded that migrant families should be provided free residential plots in the safe zones as was agreed in the CMP signed by Mrs. Sonia Gandhi, Dr. Manmohan Singh, Mufti Mohd. Sayeed and Prof.Bhim Singh in October 2002.

Hundreds join Panthers election campaign in Gulab Singh land Hail Jammu Dogra Pahari State

Prof.Bhim Singh, Chief Patron of National Panthers Party with his high power team visited several areas in Chhamb sector, Akhnoor, Pargwal along international border in the District of Jammu seeking support of the electorates for the Panthers Party which has recently declared formation of Jammu Dogra Pahari State. Prof.Bhim Singh was accompanied by Shri Gunwant Singh, Provincial General Secretary, Shri Pushvinder Manhas, Working President, Young Panthers, Shri Sewa Singh Bali, General Secretary, Panthers Trade Union, Shri Janak Raj@ Ashok Kumar. Shri Pushvinder Manhas is contesting from Akhnoor Constituency against the Congress Minister, whereas Shri Janak Raj is contesting in reserved constituency against the sitting Dy. Chief Minister.

Prof.Bhim Singh accused NC-Congress government for betraying the people residing along international border and reminded that Mrs. Sonia Gandhi, Dr. Manmohan Singh and Mr. Mufti Mohd. Sayeed had signed a CMP on October 26, 2002 to provide free land to each family

residing within the shelling range so that each family can have social security to live. He said that Congress, NC and PDP were the mother of Bill no.9 (Resettlement Act) which provides permit to nearly 5 lac Pakistanis to return to Jammu and resettled. He reminded the people that it is Panthers Party which is fighting this case in the Supreme Court against the draconian Law whereas Congress, NC, PDP and BJP have been opposing the petition of Panthers Party.

Prof.Bhim Singh declared that the state organized by Maharaja Gulab Singh between 1820 and 1842 (Jammu State shall be revived as Jammu Dogra Pahari State). He said that Article 370 is dangerous to the National Integration and has to be amended to provide power to the Parliament to legislate in respect of J&K for complete integration of the State.

Prof.Bhim Singh appealed the youth, farmers, the working class, the women and the students to join the movement of the Panthers Party for the reorganization of the state so that every citizen of India including Pak refugees, POK refugees, the migrants shall enjoy equality before the law, full citizenship and right to live with human dignity.
