Prof.Bhim Singh, Sr. Advocate argues strongly before SC for application of NEET for MBBS students of J&K

Prof.Bhim Singh, Sr. Advocate & Executive Chairman of the State Legal Aid Committee, J&K today made a strong appeal before a three-judge Bench of the Supreme Court of India seeking its clear mandate to allow the NEET application in J&K so that the ruling political weights and high profile bureaucrats shall not use this process for the promotion of their children as it has been happening for the past 60 years in J&K.

          Prof.Bhim Singh was arguing against the IA filed by the State of J&K (comprising of BJP and PDP) made strong submission against the State of J&K demand to keep NEET process out of the doors of J&K. Prof.Bhim Singh submitted in Supreme Court that NEET is a good beginning to introduce the doors of justice and equity for the students of J&K so that they can also get an opportunity to enter into the MBBS and BDS courses throughout the country which has been denied to them for several years. Prof.Bhim Singh submitted before the court that the students and their parents have expressed full faith in the latest system,NEET and hoped that the students of J&K shall get an opportunity to go anywhere in the country for building their bright future as doctors and dentists.

          Prof.Bhim Singh in his arguments strongly opposed the appeal of J&K government to exclude the State of J&K from the applicability of NEET. Prof.Bhim Singh said Article 370 became defunct when Maharaja Hari Singh, J&K was removed by the so-called Constituent Assembly headed by Sheikh Abdullah and supported by the Congress in 1952. Prof.Bhim Singh argued that Article 370 has ceased to exist and could not be relied upon any longer. He said that J&K is integral part of Union of India and no special concession for corruption and illegal action can be given to the State of J&K. He prayed the Supreme Court of India to dismiss IA 20 & 21 filed by the Govt. of J&K before the Supreme Court to ensure that, “I (Bhim Singh) an Indian like all other residents of J&K and entitled the share the benefits and fruits of the fundamental rights incorporated in the Constitution of India under Article 14, 21 and other provisions”. He urged the Supreme Court to dismiss J&K State’s application without delay.

Sayeed about 100 days’ back at Jammu.

Comprehensive settlement of nearly 15 lacs refugees from Pakistan and POK by providing them equitable rights, (2). Delimitation of Assembly constituencies which was barred by changing the rules in the State Constitution by National Conference with the support of Congress and BJP in 2002 putting a seal on the delimitation till census after 2026, (3). Equitable development of all the three regions in the state, (4). Setting up AIIMS at Jammu as promised by the Govt. of Shri Atal Bihari Vajpayee in 2003, (5). Provision of granting Dogra Certificate to the Dogras in J&K, (6). Ensuring relief and concessions to the Jammu Migrants (because of the rise of militancy in Jammu region at par with Kashmiri Migrants) as was directed by the Supreme Court of India, (7). Inclusion of fundamental rights in the Constitution of J&K, (8). Amendment in Article 370 of the Constitution of India bringing residents of J&K at par with citizens of India, (9). Ownership rights to all the allottees from POK or otherwise over the evacuee land who have been living as temporary tenants for the past 67 years thus protection of all Dogra heritage including Mubarak Mandi and other sites, (10). Discrimination with the B.Ed. colleges of Jammu region, (11). Discriminatory recruitment rules threatening the future of the new generation of the state, (12). Discrimination with the ex-servicemen mostly in Jammu, (13). Regularization of services of all government employees including SPOs, contractual employees, casual labours and others. It appears that Prime Minister Modi has cancelled his proposed visit to the Valley on 17th July, 2015 so that he can interact with his own party leadership to give them gurmantar.


Contractual government jobs’ offer One more fraud with youth, scratch it

Prof.Bhim Singh, Chief Patron of National Panthers Party condemned the new contractual jobs’ policy of J&K government which he said is most ruthless assault on the fundamental rights of the youth to work on the principles laid down by the Supreme Court, equal wages (salary) for equal job. He appealed the youth to reject this policy with all their might and strength and oppose, expose and depose the anti-people and anti-youth government in the state.

Prof.Bhim Singh reminded the youth that government of Sheikh Mohd. Abdullah in 1981 passed a Law to provide half of the salaries to the new recruitment in the government jobs. It was this author (Bhim Singh), who opposed the Sheikh’s government on this issue with result he was expelled by the Congress Party which was headed by Mufti Mohd. Sayeed. Prof.Bhim Singh was opposed by all sections of people including the Congress though he was Congress MLA at that time. Prof.Bhim Singh moved the High Court and got the state SRO quashed by the court. The division bench was headed by late Justice Bahuddin Farooqui, Chief Justice of J&K High Court. The government had to pay all the arrears to the employees including the police recruits in both Gazetted and Non-Gazetted ranks.

Prof.Bhim Singh reminded the Panthers Party workers and the youth that the Govt. of J&K repeated the same blunder in 2011 by the State government headed by the grandson of Sheikh Mohd. Abdullah. This time the Panthers Party filed a writ petition in Supreme Court which was transferred to the High Court of J&K. In the meantime, the government had to eat humble pie and reiterated a writ petition was filed by Young Panthers General Secretary, Mr. Vilakshan Singh, Advocate in 2012 for the payment of all arrears to the youth who were recruited between 2011 and 2012.

Prof.Bhim Singh said that it is now PDP-BJP government which has dared defy the rule of law and the decisions of the High Court by its colourable exercise to achieve the same target with mala fide intentions to deceive the youth in the name of contractual jobs. He said the contractual jobs are provided when there is a temporary vacancy or a small project to be accomplished within a short period. He said there are more than 40,000 government jobs in J&K and they have to be filled by a process of law mandated under Article 21 of the Constitution of India which is applicable to the State of J&K by the authority of the Supreme Court of India though there is no chapter on fundamental rights in the Constitution of J&K.

Prof.Bhim Singh has called the Legal Aid Committee of the JKNPP to take up the matter before the Hon’ble Court and file a case against the J&K government for the contempt of the Supreme Court and the High Court without delay. He assured the young man that the Panthers Party shall also fight for full justice to the SPOs, daily wagers, home guards, SSB & NYC volunteers also. A committee headed by Mr. B.B. Kotwal has also been constituted in this regard.

He also called on Panthers Trade Union, Young Panthers, Women Power, NPSU, Farmers Council and the District Panthers Committees to give a befitting reply to the government jointly under the leadership of Panthers Party.   

Justice Dave refuses to preside Constitution Bench hearing petitions against NJAC

The Constitution Bench of 5-judges of the Supreme Court of India headed by Justice Anil R. Dave with JJ Mr. Madan B. Lokur, Mr. Justice J. Chelameswar, Mr. Justice Kurian Joseph & Mr. Justice A.K. Goel was adjourned suddenly when Sr. Advocate, Mr. Nariman appearing for AOR Association objected to the sitting of Justice Anil R. Dave as the President of the Constitution Bench on the ground that he has become a member of the NJAC being among the first two senior judges in the Apex Court.

Prof.Bhim Singh, Sr. Advocate appearing in person in his petition challenging the validity of NJAC deferred from Mr. Nariman submitting that Mr. Nariman did not represent other petitioners and each petitioner should be heard on this issue whether Justice Dave should preside/has authority to preside. He said that a judge is a judge as long as he does’t ceased to be. He further submitted before the court that the court should hear both sides on the objection raised by Mr. Nariman. Mr. Nariman should have addressed the court as any senior advocate should have done. Distributing leaflets in the court and threatening the judges by thumping the desk and asking the Constitution Bench to decide, “Hear and now, now and now alone” repeatedly did not reflect the decorum of the highest court of the country. Ambarrassed presiding judge suddenly announced that he would not hear the matter and adjourned the bench.

Mr. Mukul Rohtagi, Sr. Advocate and Attorney General also strongly objected to the remarks made by Mr. Nariman saying that this was totally misleading and condemnable what was witnessed in the court.

Jammu migrants ‘outrage’ against the Modi-Mufti Sarkar

The following is the statement made by Ms. Anita Thakur, State General Secretary JKNPP, Incharge Jammu Migrants Affairs and Chairman, Talwara Migrants Action Committee Mr. Balwan Singh in a Press conference in Jammu Press Club today 11th April, 2015.


“More than 2000 Migrant families has admitted by the state government on the floor of the Assembly have been completely ignored, discriminated with, completely forgotten and treated like wretched of earth by the Central and State Governments”.

We feel grateful to Prof. Bhim Singh, Chief Patron of Jammu Migrants Committee for taking up Migrants struggle for justice and equity from the streets, to the floors of the Legislature and to the Supreme Court.  We also express our gratitude for Panthers Party veteran leaders Late Shri Kamal Goria for winning the first writ petition for Jammu migrants in the High Court which was opposed by the State Government through appeal in the Supreme Court.  The J&K High Court had held that Jammu migrants should be given all relief to the Jammu migrants at par with the Kashmiri migrants. Prof. Bhim Singh fought against J&K Government for six year in the Supreme Court and the SC accepted Bhim Singh’s arguments and dismissed  J&K Government appeal directing further to pay all arrears amounting to 21 crores to the Jammu migrants, most of them camping in Talwara (Reasi).  This order came in July 2006.

This is the tragedy that the Congress led Government by Mr. Ghulam Nabi Azad and the Central Government completely ignored the SC judegment.  Migrants march to Delhi seeking implementation of Supreme Court ordered was foiled by Mr. Ghulam Nabi led government and hundreds of Talwara Migrants including old, women and children were brutally attacked by the police under the instructions of DGP police Mr. Kuldeep Khoda on the instructions of Congress-PDP government on 7th August, 2007 on the main Reasi-Jammu road near Katra. The three senior leaders of the Panthers party leading peaceful procession were assaulted, beaten and dragged to police custody.  They included Ms. Anita Thakur, H.C Jalmeria Advocate and P.K Ganju (Sr. Journalist), Mr. Balwan Singh, Chairman Talwara Committee, Jagdev Singh Vice-Chairman and others. The Supreme Court of India admitted a writ petition by JKNPP leaders, which is pending for final hearing in the Supreme Court. Hundreds of migrants were beaten and assaulted. Many migrant families were forced to sell their children to the strangers just for saving the rest of their families.

In 1984 BJP Government in Delhi raised relief for Kashmiri Pundits migrants from Rs. 400 to 1000 (per person per month), 1600 to 4000 (per family per month) where as Jammu migrants were completely kept out of this package.

The Central and the State Governments released a special package for Kashmir Migrants for their rehabilitation in Kashmir Valley with sanctions of full expenses of their new houses and exclusive Kashmir Migrants Colony in Kashmir Valley. The Jammu migrants were ignored again though they were persuaded by Prof. Bhim Singh to return to their homes and resettle on their own land in their native villages in the districts of Rajouri, Reasi, Udhampur, Ramban, Kishtwar, Doda and other places. The Government of India and Government of J&K State refused even to provide them financial assistance to rebuild their houses which were destroyed by terrorists during terrorists’ attacks against them from 1998 to 2002.

On the appeal by the Panthers Party the Parliament constituted a Parliamentary Committee where Mrs. Sushma Swaraj (at present foreign minister of India), Mr. Venkiah Naidu (at present Union Minister, Parliamentary Affairs) and several others were Members of the Committee. This committee also accepted Panthers Party recommendations for the rehabilitation of Jammu and Talwara Migrants. Nothing happened till this day.

There is another tragedy that a contempt case in the Supreme Court against the Central & State governments filed by JKNPP was referred to the Chief Justice of J&K High Court in 2007. The High Court of J&K directed the Union and State Governments to clear all dues (arrears) of the Jammu migrants and provide relief at par with Kashmiri migrants. This order has not been implemented in six years and the case never came for hearing for more than two years in spite of several mentionings before the Court.

The Panthers Party with the Talwara Migrants shall hold one day dharna in front of Raj Bhawan, Jammu. It shall announce its action plan, “do or die” for justice to all Jammu migrants and for a special package to Jammu and Talwara Migrants also at par with Kashmiri Migrants for their rehabilitation in their native villages. The Jammu (Talwara) migrants do not ask for separate home land as they are committed to uphold the dignity and values of their centuries old composite culture and mutual co-existence. They have every right to get similar package for their rehabilitation on their own land. We also appeal all the political parties, Legislators to standby Jammu and Talwara Migrants in the interest of justice and equity”.

  1. There is no mentioning of Jammu Migrant families in the common CMP of alliance partner, BJP-PDP.
  2. There are about 62,000 registered Kashmiri Migrant families, scattered all over the country including in Jammu. On the other hand there are 2200 Jammu Migrant families from Doda, Udhampur, Rajouri, Reasi, Ramban, Kishtwar, Udhampur and other places as admitted by the State government on the floor of the Legislative Council.
  3. The financial package for Kashmir Migrant families include all expenses to build/rebuild the new colonies/houses for Kashmiri Pundit Migrants with continuation of relief in cash and kind for five years (minimum). There is no such relief package for Jammu Migrants.

The Jammu and Kashmir government on Tuesday approved 3,000 supernumerary posts to Kashmiri Pandit migrants under the Prime Minister’s package in the Valley.


“The state government has approved 3,000 supernumerary posts for KP migrants under PM’s Package in Valley,” a senior officer of the state government said. Minister for Law, Justice and Parliamentary Affairs and Relief and Rehabilitation, Syed Basharat Bukhari on Tuesday held extensive discussions on relief and rehabilitation of Kashmiri migrants.


In this regard, Bukhari directed the Relief Commissioner to collect data of migrant unemployed youth who are registered as Kashmiri migrants in Jammu or outside the state besides enjoining the youth to submit their details within a period of 20 days. While taking stock of the relief and rehabilitation measures for Kashmiri migrants, the minister directed the reconstitution of the Apex Advisory Committee (AAC), an apex body of representatives of Kashmiri migrants, who migrated from the Valley.


“Creation of 3,000 supernumerary posts for providing employment to migrant youth in the Valley under PM’s package for return and rehabilitation of Kashmiri migrants was also decided in the meeting,” he said. It was informed in the meeting that presently 18,589 families are drawing relief of the 41,117 migrant families. District wise, Srinagar has the maximum number of migrant families at 13,491 followed by Anantnag which has 9,291.


During 2014-15, an amount of Rs 127.28 crore has been incurred on cash assistance, food grains, building infrastructure facilities in camps and on civic action programme for migrant families. The facilities and living conditions in various camps including Purkhoo, Muthi, Nagrota and Jagiti were also informed in the meeting.


The minister said that he would carry out on spot inspection of these camps in due course of time to have a first-hand experience of the living conditions. In order to address various issues of the migrant families, the minister directed the Secretary Revenue for constitution of a grievance cell in the office of Additional Secretary Revenue.
