Convey Diwali Greetings on behalf of Jammu State Bhim Singh calls on youth, NPP volunteers

Addressing a massive youth and students rally at Jantar Mantar (NPP office in exile), New Delhi, Prof.Bhim Singh the Founder of the Panthers Party called on youth, students, the working class and every NPP volunteer to extend Diwali Greetings to their neighbourers and all on behalf of Jammu State.

Hundreds of youth and students in the meeting took a pledge that they shall work for the establishment of Jammu State and extend full cooperation for the establishment of Kashmir Valley state so that the 68 years old internal conflict and the tension between the two regions shall ease down and the people of both the regions shall continue to live as friends and brothers as they were living before 1846.

Prof.Bhim Singh said that this is the right of in 21st century that Treaty of Amritsar is written off as the situation, circumstances as well as political equations and permutation and combination have undergone a seachange since 1846.

The people of Kashmir Valley shall also live in peace and without the shadows of the guns. They shall not be exploited anymore by the political traders in Kashmir or from outside. He said that the Jammu Pradesh has been passing through a colonial era under the handful of blood sulking political exploiters. The Kashmiries shall be able to elect the government of their choice and so shall the people of Jammu State get back their identity and strengthen the composite culture. In his message to the people living in POK, Prof.Bhim Singh said that the residence of Muzaffrabad to Rawalakote are part and parcel of Jammu State and this is time that we get together once again after half a century.

Prof.Bhim Singh said that Panthers Party was established with this mission to ensure that three identities and entities of Ladakh, Kashmir and Jammu are rehabilitated and restored. He laughed at the statement of Prime Minister Modi in Srinagar that Atal Bihari Vajpayee gave his formula for J&K as Kashmiriyat, Jhamuriyat and Insaniyat which he said was totally misquoted and misinterpreted. Mr. Modi has to understand that J&K has three regional entities; Ladakh (including Gilgit and Baltistan), Kashmir Valley (as it is) and Jammu Pradesh (Muzaffrabad to Kishtwar, Lakhanpur to Pir Panchal).

Prof.Bhim Singh proposed a debate on the issue throughout the state so that the real message shall reach every person in the state and outside.

BJP instrumental abetting PDP & NC In promoting Dixon Plan in J&K

Prof.Bhim Singh, Chief Patron of National Panthers Party accused the BJP-PDP leadership to foment communal conflict in J&K in order to regain the lost credibility of their political victory in J&K. This helps BJP to create a communal divide so that they succeed in their nefarious designs to divert the mind of the majority community in the country to gain lost support in the coming elections in Bihar and elsewhere.

The NPP Supremo cautioned the Panthers Party activists and all other revolutionary groups and parties who have been opposing the BJP for its utter failure to follow their promised agenda in Jammu Pradesh. They have failed to hold delimitation of constituencies to remove political discrimination in J&K. BJP has failed to address the grievances of 15 lacs Pak and POK refugees who have been living a life of wretched of the earth for the past 67 years without statehood, civil or political rights. These refugees or migrants have been victim of Congress for many years and now the BJP is doing the same with the citizens of India as they are. BJP promised to destroy Resettlement Act, provide proprietory rights (Malkiyat) to the allottees from POK and Pak who have been living as allottees on temporary basis in the agricultural land which the people left in J&K while voluntarily migrating to Pakistan in 1947. The Govt. of J&K has enacted a Law allowing all these Pak-nationals (presently) to return and seek full rehabilitation on their lands. This Law has been challenged by the Panthers Party and is still pending before the Supreme Court of India with a permanent stay till disposal. Jammu Pradesh has 37 Assembly seats against 46 in the Valley. The population of the two regions is almost even. The BJP had made a commitment for holding delimitation which they forgot. There is discriminatory recruitment policy in J&K which is opposed by the Panthers Party tooth and nail from the streets to the Supreme Court. J&K government withdrew SRO in this connection on the petition of JKNPP but it reimposed the same discriminatory Law after the JKNPP withdrew petition.

The J&K government under the leadership of Farooq Abdullah as Chief Minister in 1999 grabbed 28000 sq. kms. of forest land in Nagrota sector for the resettlement of Kashmiri Muslim Migrants. The petition filed by the Panthers Party against this communal enactment is pending in the High Court of J&K for final disposal. The State has been playing hide and seek with the High Court.

The BJP betray the people of Jammu Pradesh, surrendered before PDP leadership for the sake of power and money which has been proved beyond an iota of doubt.

A petition was sponsored before Jammu High Court (PIL) to seek an order on the existing Law just to provoke a section of the society. It needs a special care to find out who has sponsored another PIL before the Kashmir Wing of the same High Court. Interestingly, the two wings of the same High Court have issued parallel directions which need urgent attention of the Governor of J&K to ensure that the judiciary is not used for political ends by any individual or group of individuals.

Prof.Bhim Singh said that this being done to create a communal divide in the state to divert the attention of the people from the real issues; chaos, disorder, anti-national propaganda, corruption and the issue of reorganization of the state by establishing twin states in J&K, Kashmir Valley and Jammu Pradesh where lies the only solution. He cautioned all nationalist activists and secular forces in J&K to act very carefully and with caution to defeat the ugly designs of the corrupt, communal and failed government.


Contractual government jobs’ offer One more fraud with youth, scratch it

Prof.Bhim Singh, Chief Patron of National Panthers Party condemned the new contractual jobs’ policy of J&K government which he said is most ruthless assault on the fundamental rights of the youth to work on the principles laid down by the Supreme Court, equal wages (salary) for equal job. He appealed the youth to reject this policy with all their might and strength and oppose, expose and depose the anti-people and anti-youth government in the state.

Prof.Bhim Singh reminded the youth that government of Sheikh Mohd. Abdullah in 1981 passed a Law to provide half of the salaries to the new recruitment in the government jobs. It was this author (Bhim Singh), who opposed the Sheikh’s government on this issue with result he was expelled by the Congress Party which was headed by Mufti Mohd. Sayeed. Prof.Bhim Singh was opposed by all sections of people including the Congress though he was Congress MLA at that time. Prof.Bhim Singh moved the High Court and got the state SRO quashed by the court. The division bench was headed by late Justice Bahuddin Farooqui, Chief Justice of J&K High Court. The government had to pay all the arrears to the employees including the police recruits in both Gazetted and Non-Gazetted ranks.

Prof.Bhim Singh reminded the Panthers Party workers and the youth that the Govt. of J&K repeated the same blunder in 2011 by the State government headed by the grandson of Sheikh Mohd. Abdullah. This time the Panthers Party filed a writ petition in Supreme Court which was transferred to the High Court of J&K. In the meantime, the government had to eat humble pie and reiterated a writ petition was filed by Young Panthers General Secretary, Mr. Vilakshan Singh, Advocate in 2012 for the payment of all arrears to the youth who were recruited between 2011 and 2012.

Prof.Bhim Singh said that it is now PDP-BJP government which has dared defy the rule of law and the decisions of the High Court by its colourable exercise to achieve the same target with mala fide intentions to deceive the youth in the name of contractual jobs. He said the contractual jobs are provided when there is a temporary vacancy or a small project to be accomplished within a short period. He said there are more than 40,000 government jobs in J&K and they have to be filled by a process of law mandated under Article 21 of the Constitution of India which is applicable to the State of J&K by the authority of the Supreme Court of India though there is no chapter on fundamental rights in the Constitution of J&K.

Prof.Bhim Singh has called the Legal Aid Committee of the JKNPP to take up the matter before the Hon’ble Court and file a case against the J&K government for the contempt of the Supreme Court and the High Court without delay. He assured the young man that the Panthers Party shall also fight for full justice to the SPOs, daily wagers, home guards, SSB & NYC volunteers also. A committee headed by Mr. B.B. Kotwal has also been constituted in this regard.

He also called on Panthers Trade Union, Young Panthers, Women Power, NPSU, Farmers Council and the District Panthers Committees to give a befitting reply to the government jointly under the leadership of Panthers Party.   

Justice Dave refuses to preside Constitution Bench hearing petitions against NJAC

The Constitution Bench of 5-judges of the Supreme Court of India headed by Justice Anil R. Dave with JJ Mr. Madan B. Lokur, Mr. Justice J. Chelameswar, Mr. Justice Kurian Joseph & Mr. Justice A.K. Goel was adjourned suddenly when Sr. Advocate, Mr. Nariman appearing for AOR Association objected to the sitting of Justice Anil R. Dave as the President of the Constitution Bench on the ground that he has become a member of the NJAC being among the first two senior judges in the Apex Court.

Prof.Bhim Singh, Sr. Advocate appearing in person in his petition challenging the validity of NJAC deferred from Mr. Nariman submitting that Mr. Nariman did not represent other petitioners and each petitioner should be heard on this issue whether Justice Dave should preside/has authority to preside. He said that a judge is a judge as long as he does’t ceased to be. He further submitted before the court that the court should hear both sides on the objection raised by Mr. Nariman. Mr. Nariman should have addressed the court as any senior advocate should have done. Distributing leaflets in the court and threatening the judges by thumping the desk and asking the Constitution Bench to decide, “Hear and now, now and now alone” repeatedly did not reflect the decorum of the highest court of the country. Ambarrassed presiding judge suddenly announced that he would not hear the matter and adjourned the bench.

Mr. Mukul Rohtagi, Sr. Advocate and Attorney General also strongly objected to the remarks made by Mr. Nariman saying that this was totally misleading and condemnable what was witnessed in the court.

Kashmiri Migrants Rehabilitation must what about Jammu Migrants?

Prof.Bhim Singh, Chief Patron of National Panthers Party reacting strongly for the return and rehabilitation of Kashmiri Pundit Migrants in the Valley, who were thrown out of their houses in January 1990 when Mufti Mohd. Sayeed was the Union Home Minister and J&K was under Governor Rule, questioned the Modi sarkar in the Centre and Mufti-Modi sarkar in J&K on the fate of about 5000 Hindu Migrant families who also were forced to migrate from their homes by the majority community and have been languishing in different areas and stinking camps in Talwara and other places?

He welcomed the initiative for the rehabilitation of the Kashmiri Pundits back in their homes in the Valley with full financial backing and security but asked the Union & State governments why discrimination with the Jammu Migrants? Jammu Migrant (each individual) is given Rs.400 per month relief whereas a Kashmiri Migrant is given Rs.1000/- per month. On the other hand maximum relief to the Kashmiri Pundit family is Rs.4000/- whereas a Jammu Hindu Migrant family is given only Rs.1600/- per month. Each Kashmiri Pundit Migrant is getting all other benefits like medical care, schooling, government jobs and free admission in the professional colleges in the country. Kashmiri Pundit family has been provided some kind of respectable and reasonable shelter wherever they have settled in Jammu or in any other part of the country. The Jammu Migrants, on the other hand, are literally begging in the streets without any job or work. About 40 boys were employed as daily wagers in the police but they were shunted out years back. Not a single Jammu Migrant has been provided free schooling facility nor even free medical treatment and there is no question of any work even as a daily wager.

The Supreme Court of India in a writ petition filed by J&K National Panthers Party had directed the State and the Union governments to pay the relief arrears to the Jammu Migrants in 2007 at least Rs.21 crores at that time. The JKNPP has been fighting this case in the Supreme Court and a contempt petition is pending in the Jammu Wing of J&K High Court since 2009. Both the Union government and the State government have ignored the Jammu Migrants treating them worst than animals.

Prof.Bhim Singh wondered that the Union government particularly the Prime Minister, Modi has directed for creating a separate colony/colonies with full security etc. for the Kashmiri Migrants whereas the governments have not even mentioned a word on the Jammu Migrants though they are not asking for a separate colony or any separate homeland. Nor Jammu Migrants are asking for any land for residential purpose and they were prepared to go back to their homes provided the Central government/State government is prepared to rebuild/restructure their homes/houses which were destroyed by the terrorists. Prof.Bhim Singh declared that the JKNPP shall be filing a fresh petition in the Supreme Court to provide Jammu Migrants the same relief and the same benefit for their respectable and secured rehabilitation in their own villages and on their land which has been denied to them only for the reason that they are Jammu Dogras/Paharies. He held BJP leadership in the Centre and the State responsible for this discrimination with Jammu Migrants.

Prof.Bhim Singh said that JKNPP is not for erecting a Berlin Wall inside the Valley nor in Jammu Pradesh. He said the Kashmiris had rejected the two-nation theory in 1947 and they shall not allow the BJP/RSS government at the Centre to create a communal divide to sow the seeds of separation/divide within the state as that shall be against the interest of the unity, integrity and sovereignty of the entire country.
