Governor should dissolve Assembly save parliamentary democracy

Prof. Bhim Singh, Chief Patron of NPP urged Governor of J&K, Shri N.N. Vohra to act in accordance with the Constitution of the state and the mandate which he enjoys under the Constitution. There is no possibility to constitute a government in J&K within the meaning and scope of the State Constitution.  The only way out is ending of the present Assembly and fresh elections so that the people of Jammu and Kashmir may elect the government of their choice.

Prof. Bhim Singh said that BJP and PDP have been running poles apart and do not have any common agenda except loot and plunder.  Prof. Bhim Singh urged the Governor to not to allow the hawks and doves to fly in the same aircraft across desert of power politics.

Prof. Bhim Singh said that entire political system has sunk deep into the Jhelum and the Chenab and the present leadership around the state has no capacity, strength or commitment to invoke political morality in the state.  It is only Panthers Party and some individuals who are committed to morality and rule of truth.

Alarming situation along border areas in Jammu Pradesh

Prof.Bhim Singh, Chief Patron of National Panthers Party with his Panthers Party team with senior NPP leaders addressed several public meetings in Sai, R.S.Pura, Suchetgarh and other areas bordering with Pakistan on International Border. Addressing public meeting Prof.Bhim Singh urged Parliament of India to forego the blunders committed by the Indian leadership and the Parliamentarians since 1947 vis-à-vis Jammu and Kashmir. Prof.Bhim Singh urged Parliament to cure the blunders committed by the Parliament and the Indian leaders since 1947 vis-à-vis J&K.

Prof.Bhim Singh accused the Congress and BJP leadership in particular for the present mess in J&K. He said that Article 370 was the biggest blunder committed by the national leadership in 1950 when Constitution of India was promulgated. He said that Monarchy (Maharaja Rule) was allowed to continue in spite of the fact that the Maharaja was exiled from Kashmir to Bombay in 1948.

Addressing several rallies along the Indo-Pak border Prof.Bhim Singh pleaded for permanent peace from the borders between India and Pakistan as the people of both sides desire peace and intend to live in peace.

Prof.Bhim Singh also urged the President of India to use his constitutional authority and advised Governor of J&K to dissolve the State Assembly which has become irrelevant an extra burden on the state exchequer. Prof.Bhim Singh also accused both BJP and the Congress for misleading the national opinion regarding the actual state of affairs in J&K.

Prof.Bhim Singh gave a call for the establishment of ‘twin states’, Jammu Pradesh and Kashmir Valley state in J&K so that people in Ladakh region may also realize their demand for the status of Union Territory.

Bhim Singh expresses solidarity with people residing along border demands ration & other facilities

Prof. Bhim Singh, Chief Patron of NPP along with senior party leaders addressed several public meetings at Poonch border, Mendhar and Rajouri today. Addressing a strong rally of more than 2000 persons in Mendhar (5 kms. away from LoC) expressed solidarity with the residents of residing in the border districts like Poonch, Rajouri etc. this morning. He accused the J&K government for ignoring the plight of the residents in the border districts of Jammu Province. Prof. Bhim Singh urged the Union Home Minister Mr. Rajnath Singh to withdraw the notice to the passport demand on passport problems being faced by the youth of Rajouri and Poonch. Prof.Bhim Singh said that the Election Commission in connivance with J&K government has issued a notification to not to issue passport to the residents of Rajouri and Poonch who have been offered work in the Gulf countries. The ban is on the boys who have not qualified high school.Prof. Bhim Singh opposed this rule urged Union Home Minister Mr. Rajnath Singh to intervene so that the fundamental rights movement is not stooped by the J&K government. 

Prof. Bhim Singh also accused the government of Jammu and Kashmir for ignoring the developmental works in the bordering districts of Jammu and ignoring the educated unemployed youth in the area.  Prof. Bhim Singh also assured the people of Poonch and Rajouri who have been ignored by Central and State governments for 70 years.  Prof. Bhim Singh was accompanied by Ms. Anita Thakur (State General Secretary), Shri Tariq Khan (State Secretary), Shri Ashfaq Rana (District President Poonch), Shri Kuldeep Sharma (District Vice-President), Mr. Saleem Sheikh (General Secretary Young Panthers). A committee of Mendhar Block was also reconstituted.

Others who addressed the peoples rally in Mendhar in spite of rain and shower by Ms. Anita Thakur, who invited the youth in the border district to join the Panthers Party which is the only hope for the people of Jammu Pradesh. She said that the LoC should be made soft so that the people of Jammu and Kashmir could travel across the LoC from either side to meet their divided families and relations. 

       Prof. Bhim Singh struggle strongly pleaded for the Reorganization for Jammu and Kashmir so that two states are established, Kashmir Valley State and Jammu State.  He said both the states can work as confederation with full control over subjects mentioned in the State List of Schedule-VII of the Constitution.  He said that Reorganization of the state is the only solution to restore confidence in the people of both the states who have been used as guinea pigs by both the governments since 1947.  He said that there is an urgent need to amend Article 370 to develop twin states.

Confederation ‘Kashmir’ & ‘Jammu’ States

Constitution of the Union of India was adopted on 26th January, 1950. Federation of State was declared after three years long debate of the leadership of the country from different walks of life. The ruler of Baroda, Gaekwad did not sign the Instrument of Accession by 14th or 15th of August. He, rather signed the Instrument of Accession in 1948. The Constituent Assembly included the state in the List of States which were included in the Union List. Hyderabad and Junagarh did not sign the Instrument of Accession at all. The government of India took over Hyderabad and Junagarh by military intervention. The question that remains unanswered till this day as to why J&K was not acceded to the Union of India, though Maharaja Hari Singh of J&K had signed the Instrument of Accession on 26th October, 1947 in the presence of Shri V.P. Menon, the then Union Secretary. The Maharaja offered his consent to accede at the Amar Singh Palace at Jammu in the presence of Shri V.P. Menon. This was most unfortunate and unforgivable decision taken by the then government of India. There were members from Jammu and Kashmir representing the state in the Constituent Assembly of India. They included Sheikh Mohd. Abdullah, Mr. Mirza Afzal Beg and two others. Article 370 was inserted in the Constitution of India, an unforgivable blunder which has subjected the entire country to chaos and international crisis. This Article vested constitutional authority to the State of J&K headed by Maharaja Hari Singh till 20th August, 1952, the day Sheikh Abdullah was removed from power and put behind the bars. The Indian leadership has never been able nor it shall ever be in a position to explain its conduct vis-a-vis its constitutional relationship between the Union of India and the unfortunate state of J&K.
Article 370 collapsed on the day, Sheikh Mohd. Abdullah was dismissed and the state of J&K was brought under the direct control of Constitution of India. Article 370 was introduced only to give a face shaving to the status of Monarchy (headed by Maharaja Hari Singh). The day Monarchy was abolished, Article 370 became redundant rather was litterally washed away from the pages of the Indian Constitution. Article 370 has been used as a blind weapon to demolish the seedlings of democracy and rule of law in the state of J&K. The state of J&K was formulated in 1946 by Maharaja Gulab Singh signing the Treaty of Amristar with the outgoing East India Company. The Kashmir Ghati State and Ladakh were put together naming the state as Jammu, Kashmir and Ladakh. Today Ladakh is moving towards its autonomous self whereas the people of the Valley of Kashmir have been putting all their resistance seeking autonomous status which it was enjoying before 1846 as a province of Punjab.
Today Assam has been dissected into seven states, even Andhra has been divided and Punjab has emerged into three states; Punjab, Himachal Pradesh and Haryana. The time has come when reality needs to be accepted. It is time when J&K should be reorganized by establishing Jammu State, Kashmir Ghati State with liberty to the people of Ladakh to accede to either of states or take shelter as a Union Territory. The people in POK shall have freedom to join Jammu State and similarly the people of Gilgit-Baltistan may choose Ladakh if they wish. This is the only solution for peaceful resolution of the present state of J&K. No war, no hatred, no bullets, no discrimination and peaceful co-existence.

The J&K National Panthers Party is committed for reorganization of the State by floating ‘Twin States’ doctrine so that Jammu State and Kashmir Ghati State shall grow as sister states with one Governor and one High Court.

NPP Chief Patron demands dissolution of Assembly and fresh elections

While addressing media at Press Club Jammu this morning, Prof. Bhim Singh urged President of India to intervene into the serious crisis developed in J&K and revise the Governor of Jammu and Kashmir to dissolve the State (J&K) Assembly without any delay so that fresh elections may be held this year to elect a new government in accordance with the Constitution of Jammu and Kashmir which differs from the Constitution of India.

Prof. Bhim Singh, a Sr. Advocate and expert in the Constitutional Affairs said that the political situation in J&K is beyond any repairs and new government of the ‘hawks’ and ‘doves’ cannot be constituted only to please the power hungry and corrupt politicians responsible for corruption, militancy, lawlessness and political mess in the state.  He said that the Governor has imposed Governor Rule, though late and that demands immediate dissolution of the J&K Assembly without delay so that fresh elections may be held by the end of this year.

Prof. Bhim Singh also emphasized that the Governor should invoke special powers and introduce delimitation of the Assembly constituencies. Firstly all the reserved Assembly seats in Jammu Pradesh should be rotated without any delay, which have been kept under reservation for nearly two decades.  He also demanded that the Assembly constituencies should be delimited according to the Constitution of new districts in the state as the law does not permit an Assembly constituency to be extended to another district.

Prof. Bhim Singh said that the President of India is vested with power to amend Article 370 and he should end this draconian provision inserted in Article 370.  He demanded that Jammu and Kashmir should be reorganized by establishing twin states, Jammu State and Kashmir Ghati State by giving each state ‘state powers’ so that each state shall act of its own with full control over subjects mentioned in the State List (Schedule–VII).  Prof. Bhim Singh said that the new confederation of states may have one Governor and one High Court with the subjects in the Concurrent List may remain common. He suggested that Ladakh region, if the people there, so decide may be brought under the Union Territory (List).

Prof. Bhim Singh appealed to the people of Jammu and Kashmir to consider this aspect which is the only way to open windows of progress, development and respectable rehabilitation of the people from all the regions.
