President urged to intervene under Section 92 of J&K Constitution to impose Governor Rule in J&K

Prof.Bhim Singh, Chief Patron of National Panthers Party urged President of India, Shri Pranab Mukherjee to intervene under Section 92 of J&K Constitution (that is his exclusive right) to dismiss the deserted government of the state which is lost its absolute authority and defiance by the civil society has crossed all the limits provided in the domain of the Constitution of J&K. Prof.Bhim Singh who is also Executive Chairman of State Legal Aid Committee & Senior Advocate of the Supreme Court of India urged President of India to exercise his powers vested in him in exclusive terms as he is the only authority who opted his subjective satisfaction can intervene into the affairs of J&K to restore normalcy and bring to an end all actions/activities endangering the security of the state and the life and liberty of the citizens of India residing in the State of J&K.

          Prof.Bhim Singh also urged Govt. of India to understand that there is a grave threat to the security of the state fomented by th enemies of the country to need to be tackled immediately without any further delay. Prof.Bhim Singh said that it is only the President of India who has been vested power to deal with such situation as has arisen in J&K and has reached nearly two months causing a grave threat to the physical survival of the general public because all communications are broke, all public and private institutions including colleges, schools, hospitals even the courts including the High Court have been put out of work and function causing desperate situation for a common man and the public at large. Prof.Bhim Singh said that he had experienced all the situations during his three-day stay in Srinagar, almost in hiding and managed to interact with the people of the civil society placed at different levels in the city of Srinagar.

          Prof.Bhim Singh in his urgent appeal to the President of India hoped that Shri Pranab Mukherjee may be pleased to act at the earliest in the interest of national integrity and national integration. Prof.Bhim Singh said the proposed visit of Members of Parliament from New Delhi to Kashmir shall be futile exercise of the BJP leadership of Delhi to find out a way to save the RSS government in J&K functioning for the first and last time under the PDP cover in the state. He said that President of India has a great responsibility and therefore it is hoped that he shall exercise his power under the command of Article 370 of the Constitution of India.

Bhim Singh calls on leaders of Ladakh, Kashmir & Jammu Pradesh to fight for inclusion of Fundamental Rights in J&K

Prof.Bhim Singh, the Founder of National Panthers Party & Fighter for maintaining the human dignity and civil rights of the people all over the country, particularly in the state of J&K where the fundamental rights have remained denied the people of J&K (India) as well as to the residents of J&K residing in PoK and Gilgit-Baltistan since 1948 in spite of the fact that Maharaja of J&K acceded to the Union of India on 27th October, 1947 yet the Union of India kept J&K far away from the domain of its Constitution and privilege of fundamental rights. Prof.Bhim Singh expressed surprise that the RSS backed rulers led by Prime Minister Mr. Narendra Modi have ditched their own cadre by sticking to the domain of Constitution of India sans fundamental rights. Prof.Bhim Singh made a strong appeal to the new generation, the youth and students in J&K to look forward to ensure the seedlings of fundamental rights grow taller so that benefit may reach every Indian citizen residing in J&K.

            Prof.Bhim Singh expressed deep shock that the RSS Prime Minister has stepped into the shoes of the Congress and National Conference governing the State of J&K with a mission of loot, disaster depriving the people of J&K of their fundamental rights which are available to every citizen of India except in the state of J&K which acceded to the Union of India on 26th October, 1947 under the seal and signatures of State ruler, Maharaja Hari Singh.

            Prof.Bhim Singh called on the people of J&K to ensure that fundamental rights incorporated in the Constitution of India in its Chapter-III is made applicable to the residents of J&K so that the residents of J&K may also share the fruits of democracy and the rule of law which have remained denied to them since 1947. Prof.Bhim Singh said that he himself was the victim of political detentions and jails without trial in separate jails in Kashmir, Jammu and even in Delhi and Aligarh. He spent nearly eight years in prisons in Indian democracy. Prof.Bhim Singh said that High Court of J&K is still called ‘The High Court of J&K’ and has not been constituted as the High Court of Judicature as is the case with all the High Courts in the country. He regretted that the fundamental rights available to the citizens of India have remained denied to the citizens of India residing in J&K for the reason that J&K has not been integrated with the Union of India. Article 370 is the wailing wall between J&K and the rest of the country which does not allow fundamental rights/human rights to flow from New Delhi to J&K. Where students protesting or kept under trial for years for the political movement they had initiated in the state of J&K.

            Prof.Bhim Singh said that after the death of former Chief Minister, Mufti Mohd. Sayeed, there is no person who can carry the message of equality and equal treatment for the people of J&K at par with the people in rest of the country. Mufti Mohd. Sayeed had given the clear message that every resident of J&K is a citizen of India with no bankruptcy or difference when he contested election from Uttar Pradesh (India) and became the first Union Home Minister under the leadership of Mr. V.P. Singh. This message has gone to every Kashmiri youth and there is a occasion that every youth of J&K shall work and fight for securing fundamental rights to all the people in the country from Kanyakumari to Kashmir and Ladakh. Prof.Bhim Singh said that this message has been blocked by the ruling parties of J&K and the BJP government in Delhi is trying to sabotage this message for the reason which can only be explained by Prime Minister Modi.

            Prof.Bhim Singh appealed the youth of J&K to join the Panthers Party in J&K which is the only hope to ensure that the people of J&K shall succeed ensuring the fundamental rights to all the people of J&K.Prof.Bhim Singh said that this mission can be achieved by reorganization the state of J&K so that twin states Jammu Pradesh and Kashmir Province could be organized by ensuring all fundamental rights to the people of J&K with one flag. So-called separate constitution of J&K with no fundamental rights is farce, deception and cannot be accepted in 21st century when man has conquered the moon and the mars.

NPP calls on all nationalist-progressive-secular forces to work out a joint action plan to defeat BJP

Addressing a Panthers activists rally in Jantar Mantar, New Delhi this afternoon, Prof.Bhim Singh, its Chief Patron made a strong appeal to all progressive, secular, nationalist and democratic political groups and parties to hold joint conclaves in all political sectors of India to work out a joint strategy to unite India against the communal, anti-national and reactionary forces which have been exploiting the innocent and illiterate masses in the country to suit personal interest of the sectarian and communal forces which have been misleading the innocent and uninformed masses to grab power and loot the nation.

            Looking at the voting pattern in the Assembly election the five states which has almost been concluded this afternoon, Prof.Bhim Singh expressed shock that the BJP has started blowing trumpets by winning majority of seats in the 126 Member Assembly state. Prof.Bhim Singh said that BJP could not open an account in Tamilnadu in spite spending over Rs.100 crores in the Assembly elections and could get only one seat Kerala where the BJP had used all foul and corrupt means in the election. The Prime Minister election tour on official helicopter and planes must have cost the national exchequer beyond Rs.50 crores. The people of this country have voted against communal and sectarian political party rejecting the Hindutva philosophy of BJP. This is established by the people that BJP got zero (0) in Tamilnadu & Pondicherry, one in Kerala and three in West Bengal.

            BJP, though has got majority in Assam but that majority vote were cost for BJP because utter failure of the Congress and other secular parties to involve the people in the political mission that could have satisfied the people that their problem political as well as economic shall be settled by the political parties. In Assam BJP got majority only because the Congress and other political parties like AGP failed to involve the people of Assam in the progressive and secular philosophy/action plan to settle the problems of the people of Assam mostly created because of illegal infiltration of undesired inflitrators from Bangladesh. NPP Supremo said that Prime Minister Narendra Damodardas Modi has been defeated and he should accept his moral and political defeat. Beating of trumpets and blowing horns in the streets of Assam would not give any credit to the sinking BJP and its leadership in India.        

            Addressing the strong group of students and youth in Jantar Mantar this afternoon, Prof.Bhim Singh proposed that three day national conclave shall be held in New Delhi in the middle of August, 2016 where the leadership of the youth and students from all progressive/secular/nationalist groups and societies shall be invited to participate. This shall be a great effort to organize a national movement in the country from Kashmir to Kanyakumari and Dwarka to Manipur to ensure that there shall be one Constitution and one Flag in the whole of the country. The outdated provision in the Constitution of India and in the civil and criminal laws shall also be amended so that the concept of equity and equality, peace and non-violence and mutual co-existence and disarmament shall be the new manifesto to unite India towards progress and peace.  

            Prof.Bhim Singh also proposed a committee of 20 activists to work out a manifesto for the next national convention in New Delhi in August this year.

Prof.Bhim Singh, Sr. Advocate argues strongly before SC for application of NEET for MBBS students of J&K

Prof.Bhim Singh, Sr. Advocate & Executive Chairman of the State Legal Aid Committee, J&K today made a strong appeal before a three-judge Bench of the Supreme Court of India seeking its clear mandate to allow the NEET application in J&K so that the ruling political weights and high profile bureaucrats shall not use this process for the promotion of their children as it has been happening for the past 60 years in J&K.

          Prof.Bhim Singh was arguing against the IA filed by the State of J&K (comprising of BJP and PDP) made strong submission against the State of J&K demand to keep NEET process out of the doors of J&K. Prof.Bhim Singh submitted in Supreme Court that NEET is a good beginning to introduce the doors of justice and equity for the students of J&K so that they can also get an opportunity to enter into the MBBS and BDS courses throughout the country which has been denied to them for several years. Prof.Bhim Singh submitted before the court that the students and their parents have expressed full faith in the latest system,NEET and hoped that the students of J&K shall get an opportunity to go anywhere in the country for building their bright future as doctors and dentists.

          Prof.Bhim Singh in his arguments strongly opposed the appeal of J&K government to exclude the State of J&K from the applicability of NEET. Prof.Bhim Singh said Article 370 became defunct when Maharaja Hari Singh, J&K was removed by the so-called Constituent Assembly headed by Sheikh Abdullah and supported by the Congress in 1952. Prof.Bhim Singh argued that Article 370 has ceased to exist and could not be relied upon any longer. He said that J&K is integral part of Union of India and no special concession for corruption and illegal action can be given to the State of J&K. He prayed the Supreme Court of India to dismiss IA 20 & 21 filed by the Govt. of J&K before the Supreme Court to ensure that, “I (Bhim Singh) an Indian like all other residents of J&K and entitled the share the benefits and fruits of the fundamental rights incorporated in the Constitution of India under Article 14, 21 and other provisions”. He urged the Supreme Court to dismiss J&K State’s application without delay.     

Supreme Court ordered appointment of a Commission to verify Panthers Party allegations & state counter charge

A Division Bench of Supreme Court of India comprising of JJ Mr. A.K. Sikri and Mr. R.K. Agrawal heard the writ petition filed by Panthers Party senior leaders namely Ms. Anita Thakur, Mr. H.C. Jalmeria, Advocate and Mr. P.K. Ganjoo, Sr. Journalist seeking criminal action against the erring police officials who were guilty of committing barbaric and inhuman acts against the petitioners while the petitioners were escorting a peaceful protest march of the Talwara (Reasi) Jammu Migrants from Reasi to Delhi seeking implementation of the Supreme Court order dated 13.07.2006 to provide relief to the Jammu Migrants at par with Kashmiri Migrants as per judgment of the High Court of J&K dated 2001 and the judgment/order of the Supreme Court of India to provide the Jammu Migrants equitable and same relief as was provided to the Kashmiri Migrants.

The Supreme Court had admitted this writ petition in 2007 and it finally was heard today the Supreme Court. Mr. K. Venugopal, Sr. Advocate and Prof.Bhim Singh, Sr. Advocate argued for the petitioners, Jammu Migrants urging the court for appropriate punishment to the police officials responsible for the assault on the Panthers Party activists including a lady, an advocate and a senior journalist. The Panthers Party has also demanded a compensation of Rs.10 lacs each to the arrested Panthers Party leaders and any other appropriate punishment to the police officials and other government agencies for causing injury for murderous attack on the petitioners.

Prof.Bhim Singh in his arguments submitted before the court that nearly 2000 migrants including women, old and children started their march for justice from Reasi to Delhi as per judgment/order of the Supreme Court of India dated 13.07.2006. The Supreme Court had directed the Union of India and Govt. of J&K to provide relief to the Jammu Migrants as per its direction given on 13.07.2006. He submitted before the court that Jammu Migrants hailing from the districts of Rajouri, Poonch, Reasi, Udhampur, Doda, Ramban, Kishtwar, Kathua and other places were completely ignored and they were not allowed even ration for their survival whereas the Kashmiri Migrants (hailing from province of Kashmir) were provided ration in cash and kind on regular basis by the Relief Commissioner working from Jammu. The Jammu Migrants were only tortured, ignored, sent to jails and their children were bought over by the outsiders. They were forced to sell a child for the survival of the rest of the family members. Prof.Bhim Singh told the court that migrants numbering 2000 including women, old and children were peacefully marching from Talwara on their way to Delhi to present memorandum to the Prime Minister. He told the court that these migrants were stopped by the Armed Police near Katra bridge, beaten, assaulted and not allowed to cross the bridge. He submitted before the court how Mr. H.C. Jalmeria, Advocate was taken into police custody when he approached the police to requesting them to stop beating the children and women on the road. Ms. Anita Thakur followed Mr. Jalmeria. Prof.Bhim Singh presented a film on this tragic incident. The Hon’ble judges screened the film. This film shows how Mr. Jalmeria was dragged into the police brigade, assaulted and attacked by the policemen with their lathies and shoes. His leg was broken. The film shows that Ms. Anita Thakur who went the police camp by herself to inquire about Mr. Jalmeria was pounced by the wolves (police in uniform), beaten, assaulted, attacked and then dragged like gunny bag on the stony road and packed into a police jeep. The film also shows how policemen in uniform were pelting stones against the innocent villagers on the road. The Hon’ble Judges after screening the film directed that, this court shall appoint a commission of inquiry which shall visit the areas and report back to this court within one month.

Mr. K. Venugopal, Sr. Advocate for the Panthers Party petitioners made a strong submission that the Hon’ble Court should take appropriate action against the erring policemen and pay appropriate compensation to the petitioners for their illegal, unconstitutional and undesirable arrest and for the loss they have suffered at the hands of the policemen.

The Supreme Court directed that the case shall be taken up after the vacation.

The other advocates who assisted Prof.Bhim Singh included B.S. Billowria, S.K. Bandopadhyay and others.  Mr. Sunil Fernandes and others appeared for the State of J&K.

Prof.Bhim Singh expressed happiness that this case which was filed by the Panthers Party in 2007 came to the final hearing after nine years by the Hon’ble Supreme Court.
