‘Twin states’ in J&K only way out To end discrimination, chaos & imbalances

“To hold urgent Assembly elections in J&K with a clear message to end discrimination at all levels and end the chapter of imbalances; social, political or economic which has been predominantly witnessed in J&K since 1947.” This announcement was made this morning by Prof.Bhim Singh, Chief Patron of J&K National Panthers Party who has devoted 56 years of his life from school days till this day when he is continuing the battle for justice and for end of all forms of discrimination at all political platforms as well as before the Supreme Court of India.

Prof.Bhim Singh called on the people of all walks of life in the State of J&K to understand that justice shall only be ensured to the people living in different regions of the state, Ladakh, Kashmir Valley and Jammu Pradesh. He said that the state was floated in 1846 by Maharaja Gulab Singh under circumstances which were totally different in 1947 when Maharaja Hari Singh voluntarily decided to join the Union of India along with other 557 states in the Indian continent. Prof.Bhim Singh regretted that the Indian leaders ignored the call of Mahatma Gandhi on partition of India. The biggest blunder committed by the leaders of India by extending Monarchy in J&K. Had Gandhi lived till 26th January, 1950, there could have been no Jammu and Kashmir treachery as he would have never allowed anarchy continuation of Monarchy in J&K. Had J&K been merged like other 557 states of India with the Union of India the so-called problem (issue) of J&K would have never stirred the nation for 100 years, as on today.

Prof.Bhim Singh said that it was Shyama Prasad Mukherjee who dared in 1951 walk over to J&K from Pathankote to Kathua (J&K) by defying the state to enter J&K with a permit. Prof.Bhim Singh accused BJP leadership in the country which claims to be in the foot-steps of Praja Parishad (founded by Pt.Prem Nath Dogra for complete merger of J&K with the rest of the country), which betrayed the people of the country and surrendered before the communal, sectarian and anti-national leadership of Kashmir just to share in loot and power in J&K. He said that the BJP is neither Jan Sangh nor followed of Praja Parishad which is evident from the record that it joined hands with PDP, a Kashmir-based party which believed in the old Kashmiri dogma to rule Jammu and the Dogras. The BJP has betrayed the people of Jammu which is evident from the eight months old government they participated for a joint loot under the leadership of PDP.

Prof.Bhim Singh said that the Panthers Party is the only living political philosophy which can provide justice, equity, equality and end all forms of discrimination in the state. The National Conference movement under leadership of Sheikh Abdullah to demolish ‘Treaty of Amrisar’, 1846 has become a scientific reality and time has come when J&K should be reorganized by establishing ‘twin states’; Kashmir Ghati State and Jammu State. The Treaty of Amritsar is no longer relevant after J&K merged with the Union of India by the signatures of the then Maharaja of J&K, Hari Singh in 1947. Ladakh region which was annexed under the leadership of General Zorawar Singh by 1842 and affiliated with Jammu Pradesh should be given a choice between Kashmir Ghati State and Jammu State. The Ladakhies if choose to be adopted as Union Territory, their choice should be respected. Gilgit and Baltistan which link close to Ladakh shall be declared as part and parcel of Ladakh region after the liberation of Gilgit-Baltistan.

Prof.Bhim Singh said that a convention shall be held soon in February with the participation of the social and political representatives from all regions to give a scientific shape to this proposition. He said that the two states shall continue as ‘twin states’ with separate provincial governments but with one High Court and one Governor. This shall be done after a consensus of the people of the three regions.

Prof.Bhim Singh declared that he shall constitute a committee of social and political representatives irrespective of their political affiliations to mobilize the people’s opinion in support of this movement for reorganization of J&K.

Call on rulers to invoke peace, tolerance, equity message from life of Mohammed Prophet

Prof.Bhim Singh, Chief Patron of National Panthers Party & Sr. Advocate of the Supreme Court of India who has been fighting for equity, justice, tolerance, brotherhood and peace today called on those who are ruling in different parts of the world to practice tolerance, invoke peace and deliver justice with equity wherever they govern or rule.

       Congratulating the people of the world today on the birthday of Prophet Mohammed while addressing a huge rally of advocates, youth and social activists at Jantar Mantar, New Delhi (popularly known as Hyde Park Corner of India), Prof.Bhim Singh, the founder of J&K National Panthers Party said that Prophet Mohammed had given a unique message of equity, equality, brotherhood and universal peace. He said that those who have gone through the practices of the Prophet and life understand that Prophet Mohammed gave a great message of humanity, love and tolerance. He cited an example that a Jewish lady who used to act hostile to Prophet Mohammed did not appear on the way to throw dust etc. on Mohammed Prophet on a day. Mohammed Prophet walked to her house to enquire about her health. The lady was astonished by the great gesture mixed with humanity that the Prophet went to know about the health of the angry lady. The Jewish lady apologised to the Prophet and accepted his message and teachings.

          The Panthers Party Chief Patron urged the thinkers, intellectuals and the rulers of the world to learn from the life and practice of all the Prophets who were sent by God in the East, the West to spread message of peace and equality. NPP Supremo said that he had an opportunity to travel all over the world by road (on motorcycle) for five years and experienced the human love all over the world. He found that all the religions in the world have transcended message of peace, human dignity, tolerance, human love through the messengers of God in the East and in the West. He suggested that all educational institutions should include Torat, Bhagwad Geeta, Bible, Holy Quran-e-Pak, Guru Garanth Saheb and other holy books which bring the message of God. This is the only answer to heal the wounds caused by the power hungry rulers and politicians in the bleeding world of today.

Police assault petition 2007 on NPP activists in SC Ghulam Nabi Azad Govt. accused by petitioners

A Supreme Court Division Bench headed by Chief Justice of India, Mr. Justice T.S. Thakur with Mrs. Justice R. Banumathi after hearing the counsels for the Panthers Party namely, Mr. K.K. Venugopal, Sr. Advocate & J&K Counsel Mr. Puneeth K.G. Advocate in the writ petition of J&K National Panthers Party which filed in 2007 against the murderous attack by the J&K Police at the highway near Katra in Reasi District directed the Counsel of J&K State Mr. Puneeth K.G. to provide a copy of the video filed by J&K to the counsel opposite within two weeks. Prof.Bhim Singh, Sr. Advocate also appeared with Mr. K.K. Venugopal, Sr. Advocate appearing for J&K National Panthers Party leaders namely, Ms.Anita Thakur (General Secretary), Mr. H.C. Jalmeria, Advocate (General Secretary) & Mr. P.K. Ganjoo (Sr. Journalist) whose writ petition was admitted by the Supreme Court in 2007. The Panthers Party activists are demanding criminal proceedings against the J&K Police and others who had assaulted the Panthers Party leaders and other migrants while they were peacefully marching from Reasi to Delhi to stage a dharna in front of the Parliament of India seeking implementation of Supreme Court order/ judgment dated July, 2007. The Supreme Court had directed J&K Govt. after hearing an SLP filed by J&K Govt. against the order of the High Court that the migrants of Jammu province should be given relief at par with Kashmiri migrants. The Supreme Court in its order had also directed the Union of India and J&K Govt. to pay all the arrears (between 2004-2007) to the Jammu Migrants who had not been paid/provided even a penny as relief. The High Court of J&K in its order dated 2002 had directed the Union of India and the State Govt. to pay relief to the migrants of Jammu province at par with Kashmiri Migrants. The State of J&K went in appeal before the Supreme Court. Prof.Bhim Singh represented the Jammu Migrants. The two governments refused to implement the order.

         

J&K Govt. went in appeal against the order of the J&K High Court which was rejected by the Surpeme Court with a clear order to pay a compensation/relief to the Jammu Migrants at par with Kashmiri Migrants. The Supreme Court had also directed that arrears due to the Jammu Migrants should also be paid immediately. The J&K Govt. had admitted before the Supreme Court that the arrears between 2004 to 2007 were calculated to be Rs.21 crores. The two governments refused to pay the arrears admitting that there were 2021 migrant families of Jammu. The matter was taken before the Legislative Council by Prof.Bhim Singh, Member of the Legislative Council and Govt. of J&K had accepted that the arrears due to the Jammu Migrants amounted to over Rs.21 crores. The Govt. of J&K refused to pay any arrears. Till today Jammu Migrants have not been given identity cards as migrants. About 400 families who have been provided some broken accommodation at Reasi Hydel Project, Talwara were not paid regularly since 2007 also. Prof.Bhim Singh informed the Supreme Court in its contempt petition. Aggrieved by unjust and contemptuous approach of the Union of India and State Govt. the Jammu Migrants camping at Talwara camps took a peaceful march on Talwara to Delhi to seek justice from Govt. of India as per directions of the the Supreme Court of India.

          The Govt. of J&K assaulted the Panthers Party activists who were accompanying the Jammu Migrants from Reasi to Delhi. The migrants were assaulted and the Panthers Party activists including Ms. Anita Thakur & Mr. H.C. Jalmeria, Advocate (General Secretaries) and a Sr. Journalist, Mr. P.K. Ganjoo were assaulted, beaten and detained.

          The case has been pending before the Supreme Court since 2007 since the writ petition was admitted and Rule was issued with clear direction to pay all the balance arrears to the Jammu Migrants. The matter had come before a Division Bench of the Supreme Court headed by Justice T.S. Thakur.

          The case was listed for final hearing after about seven years after the Rule was issued in 2007. The Division Bench after hearing Shri K.K. Venugopal, Sr. Advocate for the Panthers Party petitioners directed the counsel of Govt. of J&K to file any document or the film before court within two weeks and provide copies to the petitioners. Shri K.K. Venugopal, Sr. Advocate appearing for the petitioners made a strong plea for the intervention of the Hon’ble Supreme Court to ensure delivery of justice to the Jammu Migrants as well as to the petitioners. The Division Bench headed by the Chief Justice directed the Counsel for J&K Govt. to provide the materials, the documentary films to the petitioners. Shri Venugopal on the other hand presented the documentary films showing brutal attack on the Panthers Party petitioners and other workers while they were requesting the police to allow them to continue their march towards Delhi for the sake of justice and equity.
