All set for Dixon Plan in J&K BJP-PDP gets push after HC judgment

Prof.Bhim Singh, Chief Patron of National Panthers Party today urged President of India for his urgent intervention under Article 370 to save J&K as integral part of India because the present coalition government in J&K has been playing in the hands of anti-national and secessionist forces which is evident from hoisting Pak and ISI flags at every public place whereas they did not give peace a chance on the Eid day even.
NPP Supremo said that ceasefire has not stopped because ISI is sending terrorists under the cover of firing. The state government is unable to take any action against the forces hostile to the Union and integrity of India.
Prof.Bhim Singh said that hostile forces, anti-nationals and the terrorists have received a boost from the High Court of J&K which in its judgment dated 16th July, 2015 has come out against the Constitution of India announcing that the Constitution of J&K is over and above the Constitution of India. They have also challenged the authority of the Parliament. In its judgment High Court has held that Constitution of J&K is superior and further added that Article 35(A) (as amended by the Parliament) has given supremacy to the legislature of J&K over the laws made by the Parliament. It is interesting to note that Article 370, though, a temporary provision which has lasted for more than 65 years being temporary and transitional in nature. The High Court judgment has raised the moral of anti-national and secessionist forces.
NPP urged the President of India to exercise his authority vested in him by virtue of Article 370. First he should scrap 35(A) which is illegal, unconstitutional, undesirable amendment which Parliament could have not done as Parliament has no authority to legislate to disturb status quo in the state. The President has the power to amend Article 370 and this is the time that he should amend this Article by declaring that Parliament is competent to make any law in respect of J&K.
Prof.Bhim Singh said that people of Jammu Pradesh who have made unparalleled sacrifices to uphold unity, integrity, sovereignty of India vis-à-vis J&K. They have been treated with discrimination and humiliation both by the ruling parties in the state as well as the successive Central governments. The latest example, he said, is the establishment of AIIMS at Jammu which was declared by Shri Atal Bihari Vajpayee government in 2003. The BJP once again cheated the people of Jammu by persuading them to call of their protest as AIIMS shall be declared on 20th July. What happened today is before the whole country. He appealed all the intelligentsia, civil society, social and political activists from different walks of life to join the platform of the Panthers Party and lead the people of Jammu towards freedom, dignity and for the restoration of their identity which is under threat in the present system. He declared, “Twin states” is the only answer, Kashmir Valley and Jammu Pradesh.

Bhim Singh urged SC to ‘save this temple of justice’ from NJAC as wisdom lies in daring

Prof.Bhim Singh, Sr. Advocate and petitioner-in-person while arguing his petition before the Constitution Bench this afternoon argued vehemently to quash National Judicial Appointments Commission Act as well as 99th Constitutional Amendment in the Indian Constitution to save independence of judiciary in the interest of democracy and rule of law.

He told the 5-judge Constitutional Bench headed by Mr. Justice Mr. Justie Jagdish Singh Khehar and comprising JJ Mr. Justice J. Chelameswar, Mr. Justice Kurian Joseph & Mr. Justice Adarsh Kumar Goel that the independence of judiciary has been threatened by a draconian Act called NJAC in the process of appointment of judges to the High Court and to the Supreme Court. In his brief arguments Prof.Bhim Singh submitted,

“That I, myself was protected and has survived by the mandate of Article 21 of the Constitution of India when this (Supreme Court) even find Rs.50,000 to ask the Govt. of J&K to pay compensation against his illegal arrest and wrongful confinement. The State (the power that be) would like to scuttle the independence of the judiciary which is evidence that the latest NJAC has been empowered to veto the decision of the three-sitting judges of the Supreme Court including the Chief Justice of India by a veto of two ordinary members. He further said that the appointment of two eminent persons is a fraud on Constitution as one of the members has to be from the reserved category which is unknown in the history of judicial appointments. He said that the veto power vested in two members can defeat the entire process of appointing Judges to the higher judiciary including that of Chief Justice of India, Chief Justices of the High Courts as well as Judges of the Apex Court and the High Courts. This is totally unnatural, undemocratic and unacceptable in democracy. He submitted the day people shall loose faith in the judiciary, the democracy will be under a threat and there is a serious threat to the integrity, unity and sovereignty of the nation.

Prof. Bhim Singh appreciated the bold and positive decision of the Chief Justice of India to opt out of the selection committee of the three persons floated by the Government to select two eminent persons. He said this is a mockery that eminent persons have not been defined and they could be Amitabh Bachchan or Ambani or Adani or even Lata Mangeskar as they are among the foremost eminent persons. Shall these eminent persons nominate the next Chief Justice of India, the judges of the Apex Court and the Chief Justice of the High Court. This is an attempt, he submitted, to demolish the independence of judiciary in the country to please the corporate houses as well as money and muscle power.

He urged the Constitution Bench to act boldly and fairly as wisdom lies in daring, to save this (judiciary) from the assault of draconian commission NJAC.

Vinoba Bhave’s doctrine that ’49’ cannot be ignored by ’51’ is relevant today

Prof. Bhim Singh, Chief Patron of NPP while addressing a conclave of lawyers late last evening in New Delhi on the 32nd death anniversary of Shri Vinoba Bhave, veteran Gandhian, made a very important revelation that Shri Vinoba Bhave who had expressed deep concern on the future of the parliamentary democracy of India when Prof. Bhim Singh met him in his Ashram in Maharashtra in 1979.  Prof. Bhim Singh disclosed that he with his journalist friends called on Shri Vinoba Bhave and sought his advice for the young generations involved in active politics.

“Shri Vinoba Bhave asked me a question, if ‘49’ could be completely ignored at the pleasure of ‘51’. He asked that by attaining a majority of ‘1’, the entire opposition as they call it cannot be sacrificed or kept aside when you are dealing with issues of development, nation building projects and India’s foreign relations. Can you give entire power to deal with the issues facing the countries to ‘51’ at the cost of ‘49’. He emphasized that a party which gets ‘51’ becomes absolute in parliamentary democracy whereas ‘49’ are rendered irrelevant and non-functional. He said that participation of ‘49’ in the process of nation building is essential for the growth of democracy in India. He forcefully argued that as long as the present system does not make ‘49’ as active participants in the functions of the state, there could be no smooth sailing.”

Prof. Bhim Singh in his tributes to Acharya Vinoba Bhave admitted that it took him years together to understand the depth of this jurisprudence and political philosophy of Acharya Vinoba Bhave. The present coalition system cannot dilute the doctrine of Shri Vinoba Bhave to strengthen the roots of parliamentary democracy in India. There is a need to reread and rewrite the Constitution so for as the parliamentary democracy is concerned.

DPNPP holds emergency Working Committee Meeting Call for Ultimate Revolution against corruption, communalism

An emergency meeting of the Working Committee of Delhi Pradesh National Panthers Party is held in New Delhi under the Chairmanship of Chief Patron, Prof. Bhim Singh. In his address to the Panthers Party activists, the NPP Supremo invited youth and students to join the Ultimate Revolution to demolish the seedlings of corruption, communalism, criminalization and drug menace so that the democracy shall survive and India may take leap towards its international role for the establishment of lasting peace and complete disarmament.
The Panthers Party also reconstituted the Delhi State Committee with induction of several fresh activists.
Prof. Bhim Singh, Chief Patron of National Panthers Party on the occasion of the meeting of the Working Committee of Delhi Pradesh National Panthers Party, held at NPP Hqrs. New Delhi is as under:-
“Dear most invaluable friends of the Panthers Party, I would like to recall that the Panthers Party was founded on the day of martyrdom of Shaheed-e-Azam S. Bhagat Singh, 23rd March, 1982. The purpose and the aim to give birth to a new political movement was to create a movement to seek justice and equity for all human beings on earth. Since India is our motherland, naturally ours was the first responsibility and commitment to the people of India. After my return from five years around the world tour on motorcycle for peace mission, I had been realized that, “My religion is humanity and goal is justice for all………………”.
It was this mission that the Panthers Party was founded which has a commitment to all human beings and every person. This is the only party in India which stands for justice and equity (nyay va adhikar). This party has proved by its action and oppressions that it is the only party in the country which stands for justice to all irrespective of religions, regions, castes or creed.
Friends, the time has come when the Panthers Party should knock every door in the capital of India being a Delhi State Party and convey the message to every person particularly the youth and the students that the Panthers Party is the only living voice of the voiceless and the helpless persons.
I call on the Panthers Party activists to move to every college, every university, every working place, every worker and lawyer, youth and student with the message of the Panthers Party to join the movement to carry forward the Ultimate Revolution. Ultimate Revolution is inevitable and this is the only source of inspiration to all needy people in the country.
After travelling around India on Rashtra Chetna Yatra, we came to establish Rashtra Chetna Abhiyan which will continue spreading the message of human love, human dignity, justice and equity to all. The winds of Rashtra Chetna Abhiyan shall carry the message of the Ultimate Revolution (Samool Kranti).
The greatest tragedy of the times is that India’s political freedom is sinking down the bottom line because of corruption by the politicians in the country. India needs reorganization of the States, may it be in the North-East, Telangana, Harit Pradesh, Uttar Pradesh and of course J&K.
I call on you, my young friends in the Panthers Party to join the Ultimate Revolution to demolish the seedlings of corruption, communalism, criminalization and drug menace. They are a serious threat to our democracy. We have to face the challenge of the time to ensure that a new India is established with the real freedom and democracy which was dreamt by the great freedom fighters like Mangal Pandey, S. Bhagat Singh, Lokmanya Tilak, Subhash Chander Bose, Rajguru, Chandra Shekhar Azad, Sukhdev, Ishfaqullah Khan, Lala Lajpat Rai and others as they are the real Bharat Ratanas in the history of freedom of India.”
