Parliament can save J&K from further death & destruction, President should act now or never

Prof.Bhim Singh, Chief Patron of National Panthers Party has urged the President of India to intervene without any further delay in his capacity as the custodian of Constitution vis-à-vis Autonomy ridden state of J&K which has been passing through the most dangerous period in its history since 1947. NPP Supremo in a strong appeal to the President of India who is literally a Viceroy vis-à-vis J&K within the meaning and scope of Article 370 of the Indian Constitution though this provision was temporary yet it has survived for nearly 70 years thanks to the Parliament of India.

            Prof.Bhim Singh appealed to all the Members of the Parliament from different areas of the country and different political groups and parties to take up the situation in J&K on urgent footing because the situation is taking a dangerous turn which may threaten the unity and the integrity of the entire nation. NPP Supremo appealed to all the political parties in Parliament to go ahead with the process to merge J&K with the rest of the country as was done in 1950 in respect of 575 States to form Union of India. The NPP Supremo said that two states namely Hyderabad and Junagarh had not merged or even signed the Instrument of Accession but they were also included in the List of the States which floated the Union of India on 26th January, 1950. J&K was left out. This is not the time to blame the people who committed this mistake knowingly or unknowingly. It was a blunder. Question rises what a party/parties in power at the Centre have done since they came to power under the leadership of Prime Minister, Shri Narendra Modi three years back.

            Prof.Bhim Singh said that Army is no replacement to maintain public order or law an order in the interiors of J&K. It is police and the police is controlled by the local government what you call state government. He said that there is no trace of local government/civil government in J&K. The Govt. is kept in the shadows only because RSS/BJP has come to power for the first and may be last time in the State of J&K.

            Prof.Bhim Singh urged President of India, Shri Pranab Mukherjee to act in accordance in the power vested in him under Article 370 of the Indian Constitution. NPP Supremo, a Senior Advocate in the Supreme Court and a leading Constitutional lawyer said that proviso in Article 370 was buried in the political grave of J&K the day J&K Assembly was constituted and its own Constitution was applied on 26th January, 1956. The proviso which restrained the power of the President in 370, Clause-3 was buried in the grave of the Constitutional history in 1956 when J&K merged into the Union of India  with its own Constitution which declared that J&K is integral part of the Union of India.

            Prof.Bhim Singh said that President of India has unlimited power because he is holding the powers that the Viceroy of India enjoyed before 26th January, 1950 since the Constitution of India in its totality has not been promulgated in the State of J&K. It is President of India who has unlimited power in spite of the Union Govt. to act vis-à-vis State of J&K. What is happened in Kashmir today a shocking, what happened yesterday was unforgivable but what is going to happen tomorrow can threaten the National Integration. This is President of India to act now or never.

Brutal murder of J&K Police officer proves lack of governance in J&K, Governor Rule is only way out

  Prof.Bhim Singh, Chief Patron of National Panthers Party expressed deep shock on the act of heinous murder of a young police officer, Mohd. Ayub Pandith today in front of Jamia Masjid, Nowhatta in Srinagar when there was no such situation in the area.

          Prof.Bhim Singh urged President of India to act according to the mandate of the Constitution of India without delay as any more delay shall prove a disaster for the unity and integrity of the entire nation—India.

          Prof.Bhim Singh said that some undesirable and unwanted elements from across the border have cross lined into the State with a definite plan to create chaos, disorder and lawlessness in J&K with a dangerous plan to disintegrate India. That needs to be checked forthwith. The only way out, NPP Supremo said, is to dismiss a government in J&K which has no control over the situation which is evident today that a senior police officer was lynched to death in broad day light in the presence of armed policemen and civil society.

          Prof.Bhim Singh also urged Shri Narendra Modi, the Prime Minister of India to think of the Nation, the people and India’s unity and act in accordance to the need of the nation this time. President’s Rule is the only solution.

          Prof.Bhim Singh made a strong appeal to the people in Kashmir Valley, particularly the youth to avoid violence and think of the Eid which is coming only after two days. He strongly urged the youth of Kashmir to wave flowers in their hands to greet their friends and neighbourers. The guns are not to be used on the eve of Eid. He reminded fellow brethren in Kashmir.

NPP Supremo challenges UN Secy-Gen. statement on Kashmir asks UN to enforce UN Resolution first

Prof.Bhim Singh, Chief Patron of National Panthers Party and an expert on J&K Affairs vis-à-vis Resolutions of UN on J&K strongly condemned the UN Secretary-General, Mr. Antonio Guterres on his highly irresponsible, undesirable and unacceptable proposition vis-à-vis a state in the Union of India, Jammu and Kashmir where he proposed a dialogue between India and Pakistan to resolve the so-called ‘Kashmir Issue’.

Prof.Bhim Singh wondered how Prime Minister could start a dialogue in camouflage keeping the entire Parliament and his own party MPs in dark. Prof.Bhim Singh questioned the Prime Minister of India to let the nation know what kind of dialogue he had with  Mr. Antonio Guterres, the Secretary General of UN and what necessitated such a dialogue with the Secretary-General of the United Nations by keeping the Parliament of India in the dark. It is revealing that UN Secretary-General admitted from the floors of the United Nations in New York that he had been meeting Prime Minister of India, Mr. Narendra Modi and Pakistan Prime Minister, Mr. Nawaz Sharief. The UN Secretary-General admitted,

“Why do you think I met three times the Prime Minister of Pakistan (Nawaz Sharief) and two times Indian Prime Minister, Narendra Modi. For someone accused of doing nothing, it is quite a number of meetings,”

Guterres said with laughter here (United Nations), responding to a question whether he is engaged in bringing about a dialogue between India and Pakistan to resolve the Kashmir dispute.

NPP Supremo questioned the credibility of this kind of dialogue which Prime Minister of India has initiated with UN Secretary-General on the so-called ‘Kashmir Problem’.  Prof.Bhim Singh also expressed surprise that Press Trust of India, an Indian news agency has tried to over lap the issue by adding and an unwanted tag in the story which was released from New York, UN Headquarters last evening.

          Prof.Bhim Singh challenged Prime Minister Modi to prove his commitment to the people of India by initiating a constitutional process to amend temporary provision of Article 370 without delay which is a cause for all problems vis-à-vis J&K.

NPP Supremo urges President of India to impose Governor Rule in J&K in national interests

Prof.Bhim Singh, Chief Patron of National Panthers Party urged the President of India to invoke temporary provision of Article 370 so that J&K state is brought under Governor Rule without any delay so that the innocent people in the state including the members of the security forces are protected within the meaning and law as enshrined in Article 21 of the Constitution of India.

          Prof.Bhim Singh urged Shri Pranab Mukherjee, the President of India to exercise his power he is vested with under the Constitution of India to amend any provision in Article 370. Prof.Bhim Singh, a Barrister at Law and Sr. Advocate in the Supreme Court of India who is also an elected Sr. Executive Member of the Supreme Court Bar Association and Chairman of Foreign Relations Committee has urged the President of India that proviso in Section 3 of Article 370 has become redundant when J&K enacted its own Constitution and made it applicable on 26th January, 1956 in J&K. He said that proviso in Section 3 of Article 370 has become dead and gone as the Constituent Assembly in J&K was closed the day Constitution of J&K was promulgated in J&K on 26th January, 1956.

          Prof.Bhim Singh said that President of India enjoys absolute power to amend any of the provision in the said Article which is still a temporary provision on the face of the Constitution of India. He urged the President of India to exercise his absolute power which he enjoys from the domain of Article 370 itself after the demise of the Constituent Assembly of J&K the day Constitution was imposed in the State.

          Prof.Bhim Singh made a strong appeal to the Prime Minister of India also to act in accordance with the Constitution and advice the President of India to intervene in the matter as the only way out today to save J&K from total death and destruction is Governor Rule. He called on the Prime Minister that a dialogue with all sections and factions of the people from different political alignments may be initiated so that the people of J&K may elect the Govt. for their choice. Reorganization of the State of J&K is only way out so that electorates in the Valley, Jammu Pradesh and Ladakh region shall feel secure and safe. A confederation of three states, Ladakh, Kashmir Valley and Jammu Pradesh is the only way out.

Tributes to Justice P.N. Bhagwati

State Legal Aid Committee chaired by Prof.Bhim Singh held a meeting at its Headquarters, New Delhi to pay homage to the former Chief Justice of India, Mr. P.N. Bhagwati who passed away on 15th June, 2017 in New Delhi. Several advocates from Delhi High Court and Supreme Court of India gathered at Jantar Mantar and expressed condolences on the unfortunate demise of leading judicial personality in India who introduced concept of Public Interest Litigation and absolute liability to the Indian Judicial System.

Prof.Bhim Singh, Executive Chairman of State Legal Aid Committee & presently Sr. Executive Member of the Supreme Court Bar Association (SCBA) expressed deep shock on the death of Justice Bhagwati whom he considers as a legal guide and philosophy and a teacher in legal jurisprudence. Prof.Bhim Singh said that it was Justice Bhagwati in 1973 who forced him to come in Advocate’s uniform when he (Bhim Singh) appeared in person in a Public Interest Litigation against the Govt. of J&K challenging the drastic amendment that the Govt. of J&K had introduced in the Ranbir Penal Code (in J&K Indian Penal Code is not applicable). It was Justice Bhagwati who made Bhim Singh to appear in the Supreme Court as a lawyer to take up Public Interest Litigation (PIL).

Prof.Bhim Singh reminded his lawyer friends that it was Justice Bhagwati who made him to constitute J&K State Legal Aid Committee to take up the legal matters in the public interest domain. Prof.Bhim Singh said that he has been fighting for the public interest since 1982 till date and that was only because of the tremendous inspiration he had been drawing from the blessings of Justice Bhagwati. Chief Justice Bhagwati was the Chairman Advisory Board of the State Legal Aid Committee, J&K and it was unique inspiration in this field which made Bhim Singh to fight on legal platform for justice and equity for the helpless and poor sufferers from different parts of the world.

Prof.Bhim Singh also visited the residence of Justice Bhagwati this morning and expressed heartfelt condolences to the wife of Late Mr. Justice P.N. Bhagwati and to his daughters.

Prof.Bhim Singh pledged that he shall continue his legal battle for the helpless and the deprived members of the society at home and abroad and that is the mission which he has inherited from his great legal inspirer in life.
