Supreme Court grants four weeks to UOI In case of Pak & POK prisoners’ in Indian jails

A Division Bench of the Supreme Court of India has directed to list the Writ of Habeas Corpus filed by Prof.Bhim Singh against the illegal detention of more than 1000 Pakistani and POK prisoners after four weeks who have been languishing in different jails of India for over 10 to 20 years.
Prof.Bhim Singh, who is also the Chairman of National Legal Aid Committee besides Sr. Advocate in the Supreme Court of India had filed Writ of Habeas Corpus in 2005 against the detention of over 1000 Pakistani and POK prisoners who had crossed into India misusing the Line of Control, entered into J&K. On the intervention of the Supreme Court of India more than 800 Pak and POK prisoners were released from Indian jails on the writ petitions filed by the Panthers Party, State Legal Aid Committee, J&K and by Prof.Bhim Singh in-person. According to the Union of India there are still about 250 Pak, POK prisoners some of them (about 20 persons) have been declared permanently handicapped. Some of them have not been identified by Pakistan High Commission in 10 years till today. The Govt. of India filed Additional Affidavit yesterday in the course of hearing stating present status of 21 foreign nationals in jails, dealing with present status of 12 persons in jails, the status of 43 persons in different Indian jails and the status of 22 Pakistani nationals who have completed their sentence/acquitted.
The Union of India filed an affidavit before the Supreme Court of India called Annexure-A1 regarding 21 Pakistani prisoners. Some of them have been released and repatriated namely, Harsid@Arsind s/o Mohammad Khan (Mental Hospital Jaipur), Mohammad Amin s/o Ram Maksood (Detention Centre, Alwar), Maksood Ali @Fazal s/o Tawar Ali@Abdul Aziz (Detention Centre, Alwar), Mohammed Khalid s/o Mohammed Yousuf (Mental Hospital Jaipur), Asraf Hussain s/o Ahmed Bux (Mental Hospital Jaipur), Ramzan s/o Matara Khan@Fatiyar Khan (Mental Hospital Jaipur), Mohd. Arshad s/o Mohd. Amir(Mental Hospital Amritsar), Mohd. Sadiq s/o Mohd. Amir (Detention Centre, Amritsar), Shingar Ali s/o Baba Hussain Ali (Detention Centre, Amritsar), Elias s/o Rahim Khan (Detention Centre, Amritsar), Mohd. Mubashir Code Ali Badar s/o Mohd Tahir (C.J. Jodhpur), Shahnawaz Malik @Fouji s/o Kamdar Malik (C.J. Jodhpur and Dilawar Sain s/o Hassan Sain (C.J. Jodhpur.
Nearly 12 prisoners have been shown undergoing life sentence namely Abdule Rashid Gani@Abdul Gani@Abdul Rashid Abdul Kadar Shaikh@Tufil Rajput (Nasik Raod Central Prison), Abdul Rahim @Sayed@Kari s/o Majid Khan (C.J. Tihar), Mohd. Hussain @Abu Julfikar s/o Hussain @Junazir Hussain (C.J. Tihar), Abdul Mateen @Iqbal @Faruq @Munsail s/o Hazi Mohd. Yakub (Central Jail Bikaner) & Mohd. Mohamad Sharif@ Javed @Pavankumar Sharma @ Manzoor Ahmed (Vadodara Central Jail).
Prof.Bhim Singh regretted that no address/home address in Pakistan has been mentioned by the Govt. which shows that the State is not sincere in its dealing.
43 Pakistani and POK persons have been shown as prisoners in Indian jails who have been listed with no offence at all.
22 Pakistani prisoners in Indian jails have completed their sentence and have not been deported till date. They include M/s. Abdul Jabbar @Saiyyed Amr Ali, Ali Mohammad @Ali Ahmed @Alia Ahmed, Asif Khan Code 77, Asima, Faheem Sidique, Hamid Noman Bhat, Javed Alam Sheikh Code Junaid Albadri, Mansoor Ahmed Manhas, Muhammad Abid Sayani Code Asadullah, Muhammad Mubashir Code Ali Badar, Muhammad Qasim, Muhammad Sharif, Muhammad Tariq @Mohamad Tarak Ali, Munawar Hussain @Miya Mithu, Naseem Akhtar, Qari Muhammad Ismail, Sadia Baba, Saifullah Code Surinder Singh, Sarfaraz Ahmed Rana, Soofia Kanwal, Tanveer Masih & Nisar Ahmed Narejo.
There are some prisoners in Amritsar and other jails who have been declared as mentally challenged and whose whereabouts have not been traced. Some of them are in Amritsar jail/hospital and some of them in Rajasthan. Prof.Bhim Singh described this State of Affairs as highly undesirable and cannot be accepted by any Indian jurist or a human being who is associated with Indian culture and sense of humanism. This amounts to violation of international human rights code of conduct established by international commission on human rights.
Prof.Bhim Singh described the inaction of the Union of India highly deplorable and unacceptable when the Govt. has filed a reply before the Supreme Court of India over a petition which is filed 13 years back before the Supreme Court that the Govt. of India is circulating a list of prisoners without providing their addresses, home addresses or even their ages.

Vijayawada Bar Association welcomes Bhim Singh

Several lawyers led by Vijayawada Bar Association President, Mr. Somu Krishnamurthy received Prof.Bhim Singh, Chief Patron of National Panthers Party & Sr. Advocate in the Supreme Court of India and his associate Mr. Rajiv Jolly Khosla, President, Delhi Pradesh National Panthers Party at Vijayawada this morning when Prof.Bhim Singh reached Vijayawada on three-day visit on the invitation of Shri Yog Abhyas Ashram Trust, Vijayawada and Bar Association, Vijayawada. Thanking the Bar Association Prof.Bhim Singh assured his full support to the demand of the Bar Association, Vijayawada for the establishment of High Court as Andhra Pradesh has remained deprived of a seat of High Court. The lawyers’ fraternity accompanying Bar Association President, Mr. Krishnamurthy explained the difficulties which the people of Andhra Pradesh as well as the lawyers have been facing for over four years since the creation of Andhra Pradesh State because of the failure of the Central Govt. to constitute separate High Court in Andhra Pradesh.

Prof.Bhim Singh who has been Sr. Executive Member of the Supreme Court Bar Association and Chairman of International Committee of the lawyers under the Bar Association assured the lawyers’ fraternity of Andhra Pradesh that he shall assist the Andhra Pradesh Bar Association with full commitment so that the general public, the clients and litigants shall not suffer any more because of the failure of the Union Govt. to establish a separate High Court in Andhra Pradesh.

Prof.Bhim Singh assured on behalf of the State Legal Aid Committee that he shall provide full support and assistance to the Andhra Pradesh Bar Association in their just and legitimate demand. Prof.Bhim Singh reminded Prime Minister Shri Narendra Modi that the Union Govt. should redress this legitimate problem of the people of Andhra Pradesh who have remained denied of justice for the past four years. Prof.Bhim Singh has suggested to the Union Law Minister that a permanent bench should be established immediately in Amravati or in Vijayawada on the patron of north eastern states as well as in Jammu and Kashmir. Prof.Bhim Singh also assured the Bar Association that this is the most genuine issue which could be taken in Public Interest Litigation before the Supreme Court of India and he assured the Bar Association his full cooperation.

Prof.Bhim Singh, Chief Patron of National Panthers Party, Chairman of Indo-Palestine Friendship Society & associate of PLO Supremo Yasir Arafat today called the political leadership in India and the intellectuals to study the kind of relationship which Indian Prime Minister, Shri Narendra Modi is building by kneeling before the Zionist State of Israel which has threatened peace in the Middle-East.

Prof.Bhim Singh, an author of several books on Israel and Indo-Palestine Relationship who remained a close friend with Yasir Arafat from 1967 (when Bhim Singh met Arafat on the Eastern Banks of Jordan River). Bhim Singh with his friend Jagdishwar Sambyal was travelling on scooter vespa on peace mission around the world from India. Prof.Bhim Singh wrote several books on Indo-Palestine Frienship. His research work was on illegal creation of Israel by the United Nations in 1948 under Resolution 181 of the United Nations.

Prof.Bhim Singh has described the State of Israel as illegitimate child of the United Nations because he said that United Nations was meant for establishing world peace not for creating new states as it did by creating Israel after vertical disection of Palestine.

Prof.Bhim Singh expressed deep shock on the attitude of the BJP led government in India where Prime Minister Modi has invited Israeli Prime Minister, Mr. Netanyahu as a super star. Prof.Bhim Singh had met Netanyahu several times and he interviewed him on VOM TV Networks in 1992 in Jerusalem. This short 20 minutes interview was telecast by the Doordarshan also. Mr. Netanyahu has been a staunch support of the Zionists’ movement which does not correspond to the United Nations peace mission in the Middle-East. Prof.Bhim Singh said that issues like agriculture, water management, horticulture, desalination are not the part of the mission which Mr. Netanyahu brings to India. The real issue is Palestine, was Palestine and shall be Palestine, which Israel should have been advised by Indian leadership to follow. Palestine was real issue and not the water tanks or agriculture technology. Prof.Bhim Singh wonders what kind of defence deal India is going to sign with the Zionist State? This kind of reception to Israeli Prime Minister in India shall shake India’s 67 years old relationship, friendship and solidarity with 53 Islamic countries. Shall Narenda Modi support United States of America to take over Jerusalem? What shall be the security and protection of Qibla-e-Awwal (first Mosque where Prophet Mohammed performed first prayer (namaz) at Jerusalem after miraj?

Prof.Bhim Singh said that Indo-Palestine relations shall remain unshaken, unaffected and no Modi and no Netanyahu can weaken the friendly ties of the people of India with the people of Palestine and the Muslim world. Prof.Bhim Singh also condemned the press release issued by some news agencies from New Delhi saying that both leaders (Modi and Netanyahu) visited a memorial to Indian soldiers who fought in world war-I to help liberate Israeli city Haifa. NPP Supremo strongly objected to this press release on behalf of the Govt. of India that Haifa was (was) city of Israel. During the second world war Haifa was a town in Palestine as there was existence of Israel. Prof.Bhim Singh cautioned Prime Minister Shri Narendra Modi to beware about the pocket snatchers who have been responsible for distorting the golden words from the history.

Prof.Bhim Singh called on the Members of Parliament to take up this matter in the Parliament and expose the present government for trying to demolish India’s international relations with the people of the world.

NPP Supremo, a Sr. Advocate & Chairman, State Legal Aid Committee, Prof.Bhim Singh has expressed deep shock on the crises in the Supreme Court where four judges have come out against the Chief Justice of India for the first time in the history of Supreme Court since 1950. Prof.Bhim Singh said that he had a chance to study in the universities of London, Cairo and other institutions. Never did he hear or watched this kind of drama which was enacted inside the premises of the Apex Court of the country, Supreme Court of India.

Prof.Bhim Singh said there were occasions when differences arose among the sitting judges of the Supreme Court they are witnessed from the dissenting judgments even in highly important and political cases like Golaknath. There were dissenting judgments while dealing interpretation of Article 368. Never before in the history of Supreme Court we (the advocates of the Supreme Court) witnessed such a naked drama where judges stood up in arms against the sitting Chief Justice of the country.

The Supreme Court Sr. Advocate and four times Sr. Executive Member of the Supreme Court Bar Association expressed shock and appealed the Chief Justice of India to hold a close door meeting of the sitting judges of the Supreme Court immediately and sort out these spoken differences and prayed to the Lords to hold a close door meeting and sort out all differences (problems) procedural or otherwise among the family of the Supreme Court of India which is not only the highest court of law but which has been a center of faith for all democracy loving people of India from the Kashmir to Kanyakumari and Dwarka to Imphal in the country. The Sr. Advocate also cautioned the press (both print and electronic) to not to exploit this unfortunate situation which can trigger the flames endangering 67 years old democracy in the country. The Chief Justice of India is highly matured and the Hon’ble Judges also enjoy the confidence of the lawyers’ fraternity in the Supreme Court. Prof.Bhim Singh also urged the Supreme Court Bar Association to play its positive role so that flames shall not be allowed to go free to endager the credibility of the Hon’ble Judges of the Supreme Court. The chapter should be closed hear and now the Bench and the Bar shall have to play a very positive conscious role to save credibility of the judiciary. Let the Judges of the Supreme Court sort out the matter by themselves by shutting their doors on all sides. Prof.Bhim Singh also appealed the press to not to play the politics of some of the foreign countries who intend to see flames over democracy in India.

Governor Rule in J&K only way out To save J&K from disintegration

Prof.Bhim Singh, Supremo of National Panthers Party & Sr. Advocate of the Supreme Court of India urged the President of India, Shri Ramnath Kovind to invoke Section 92 of J&K Constitution directing the Governor of J&K to impose Governor Rule in the state in the interest of the entire country and well being of the residents of J&K who happened to be citizens of India also in spite of embargo laid by the clouds of Article 370.

NPP Supremo also urged the Prime Minister of India to look for the interest of the people of the entire country from J&K to Kanyakumari who happened to be citizens of India in spite of the betrayal by the Constituent Assembly of India by putting a ban on the legislative power of the Parliament to legislate in respect of all subjects including Defence, Foreign Affairs, Communications and Allied Matters which were signed by Maharaja Hari Singh on the Instrument of Accession on 26th October, 1947. Why, he asked, Parliament has been squeezed of his power to legislate in respect of these three subjects also which Maharaja of J&K offered to the Union of India like other 575 rulers of the mini states now Union of India.

NPP Supremo said what is happening in the so-called Legislative Assembly of J&K and is watched and its proceedings read all over the country is a matter of shame when J&K MLAs represent a Assembly which is not under the control of discipline of Constitution of India. The Assembly has become a liability for the people of the state and does not deserve to govern the state.

He called on the President of India to dismiss the present Govt. of J&K, and advice the Governor or J&K to dissolve the Assembly of J&K which should be followed by special Ordinance under Section 3 of Article 370 as proviso under Section 3 does not exist/no more relevant any longer as the so-called Constituent Assembly of J&K is dead and gone. The President is competent to issue an Ordinance in this regard directing the Parliament of India to legislate, at least, in respect of three subjects which Maharaja Hari Singh has signed under his own seal and signatures on 26th October, 1947.

He also urged the President of India to use his exclusive constitutional power to appoint a committee of highly placed persons (all from Central Services–not from States) to examine the requests/petitions/appeals of the so-called outlawed/dreaded youth in any state who would offer to give up violent approach. This committee should visit those states including Jammu and Kashmir where the youth have been involved in militancy/violent activities and they/anyone of them offers to give up violence/guns and join the mainstream. If Mr. Jaiprakash Narayan could persuade gun wielding dacoits and bring them in the mainstream why can’t we persuade the educated youth to give up bullets and take up ballots.

Prof.Bhim Singh said that he has lot of youth in the country who can play that role to save this great nation from further death and destruction. Neither bullets nor jails are the remedy. The only way out is revival of democracy in the state through popular elections to the Assembly and extension of all Fundamental Rights including Human Rights to the people of J&K who have been deprived of their civil rights by Article 35(A) and temporary Article 370. Article 35(A) must go and the President of India is the only authority to do that. Article 370 needs to be amended that can also be amended by the President in his absolute power under Article 370(3) as proviso attached with this section had become redundant on 26th January, 1957 when Constituent Assembly turned redundant the day so-called Constitution of J&K was imposed in the State.
