Governor Rule in J&K is only way out to save J&K from further death & destruction

Prof.Bhim Singh, Chief Patron of JKNPP urged President of India, Shri Pranab Mukherjee to exercise his constitutional power vested in him under the mandate of temporary provision Article 370 of Constitution of India. Though, old yet is the only provision in the Constitution of India which has vested constitutional power in the President of India to intervene in case of Emergency, external aggression or internal disturbance in the State of J&K. Prof.Bhim Singh said that the President of India may be failing in his constitutional responsibility if he fails to intervene to restore peace in the State of J&K as he is the only constitutional authority who is vested with power under Section 92 of the Constitution of J&K (J&K has a separate Constitution as Constitution of India is not applicable to the State of J&K). Under Section 92 the Governor of J&K is empowered to impose Governor Rule and dismiss Assembly of J&K as provided in the Constitution of J&K yet he has to seek clearance from the President of India under the Constitution of J&K also.

          Prof.Bhim Singh reminded the President of India that Kashmir has been bleeding and it was bleeding profusely this afternoon when Chief Minister of J&K Ms. Mehbooba Mufti was meeting with the Prime Minister of India, Shri Narendra Modi, Kashmir police were using bullets and guns against the protesting students in the heart of the city of Srinagar.

          Prof.Bhim Singh said that President of India can advice the Governor straight within the scope and meaning of Article 370 read with Section 92 of J&K Constitution and advice the Governor to dismiss the J&K Govt. and impose Governor Rule in the larger national interest without seeking any opinion of the Union Govt. Prof.Bhim Singh expressed hope that Prime Minister Modi shall keep in mind larger interest of the nation—Bharata, than the petty interest of BJP ministers in the State of J&K who likely to loose their jobs and benefits with the imposition of Governor Rule in the State of J&K. Prof.Bhim Singh hoped that Shri Modi to keep interest of Bharata and not BJP ministers in J&K to save J&K from further death and destruction.

Who is right & who is wrong? ‘India Today’ must answer

‘India Today’ Channel must satisfy all those who believe in Fundamental Rights including Right of Expression, Speech & Movement. What happened the other day in Kashmir (Srinagar) when a camera team of ‘India Today’ forcibly entered the house of Yasin Malik, noted angry leader in Kashmir associated with Hurriyat Conference.

Have the people in Kashmir any right to privacy as enjoyed all Indian citizens?

Can a media team or a press reporter or a TV cameraman enter the house of any individual uninvited?

Can even a policeman enter a private house of a citizen of India anywhere in the country including Kashmir without any entry permit/permission of the landlord/house owner or warrants of a court?

Has a person no privacy or self respect to rest in his own house or bedroom without being disturbed by an unwanted outsider?

A camera team claiming to be ‘India Today’ and in fact ‘India Today’ owned the responsibility and the patronization of the team forcibly entered the house of a local Kashmiri Leader, Yasin Malik, without seeking  appointment. Could it be justified?

Was that a personal right of a camera/press team to enter anybody’s house at any time with cameras in hand claiming to be assisting so-called NIA?

No person with sense of freedom and dignity could justify this action of a camera team of  ‘India Today’ which forcibly entered into the house of Mr. Yasin Malik. ‘India Today’ with all its might sought to convey what ‘India Today’ felt was in their mind denouncing an Indian citizen without any sanction of law. Was it moral or illegal?

Was it in accordance with the rule of law which the Indian Penal Code follows? Who is right and who is wrong? Let ‘India Today’ answer!

Was it fair on the part of ‘India Today’ to denounce an angry Kashmiri leader using all kind of slang and abuses telling the whole world that Kashmir is difficult and ‘Kashmiries’ are not with India. Was it not insult to the entire people of J&K and abuse of the Fundamental Rights which are also available to the people of J&K.

Bhim Singh hails initial verdict of ICJ on jurisdiction in Kulbhushan Jadhav case

 Prof.Bhim Singh, Sr.Executive Member, Supreme Court Bar Association of India and expert on International Law and ICJ today welcomed the interim verdict of the International Court of Justice at Hague in which the ICJ rejected Pakistan’s arguments challenging the jurisdiction of the ICJ in Jadhav’s case.

Prof.Bhim Singh, a Barrister-at-Law and Postgraduate from London University who appeared in the ICJ in the seventies hailed the verdict of the ICJ this afternoon which the full bench of 11-judges delivered from the Hague seat of the court rejecting Pakistan’s objection to India’s petition it filed before the ICJ. The ICJ verdict on its jurisdiction within the meaning of Section 42 of Vienna Convention and 36 of the Charter of the United Nations, the court made it clear and specific that it enjoys full power to entertain this petition filed by India on behalf of the Indian prisoner namely, Kulbhushan Jadhav who is facing death sentence in Pakistan which was delivered by a military court of Pakistan.

President of International Court of Justice Ronny Abraham said, “International justice is a long-drawn-out affair. Its establishment is an ongoing and gradual process, and always a difficult one. In practice, it is an ideal we seek to attain but where much still remains to be done. We must avoid excessive idealism and naivety, but also too much cynicism. The last few decades have shown that international justice has made genuine progress. On the other hand we must not believe that the stage has been reached where all the major political issues facing the world can be settled in the courts.”

Prof.Bhim Singh had written a letter on 12th April, 2017 to the Supreme Court of Pakistan with a copy of a petition against Jadhav’s death sentence. Prof.Bhim Singh had also declared that he shall move International Court of Justice, if need be or in case Pakistan did not accept his petition challenging Jadhav’s death sentence.

The ICJ ruling also made it mandatory that pending the meeting of the court Pakistan shall not implement its order passed against Mr. Kulbhushan Jadhav. In the meantime, Pakistan had made it clear the time of arguments that Pakistan is not going to implement the order of the court martial before August this year.

Prof.Bhim Singh said that he shall go to the Hague next month to assist the ICJ in Kulbushan Jadhav on behalf of the Legal Aid Committee in the month of June this year.

NPP Supremo urges PM to go for Governor Rule in J&K take last warning of Kashmiri women with serious note

Prof.Bhim Singh, Chief Patron of National Panthers Party who spent more than eight years in the prisons of J&K while fighting for democracy, peace and justice today urged the Prime Minister of India Shri Narendra Modi to understand the silent message of the women of Kashmir who in thousands raised their volcanic voice against the Chief Minister of J&K, Ms. Mehbooba Mufti, a women Chief Minister for the first time in the history of J&K forcing Mehbooba Mufti to retreat from the Sher-e-Kashmir International Conference Hall in Srinagar yesterday.

Prof.Bhim Singh urged Prime Minister Modi to understand the message of the innocent people of Kashmir, of course J&K that they shall not accept the PDP-BJP Govt. in the State of J&K as both the parties have lost confidence of the people of the entire State of J&K. Prof.Bhim Singh urged Modi ji to accept the advice of State Governor, Shri N.N. Vohra who has no personal interest in the politics of J&K. Prof.BhimSingh said that Governor should be consulted and his opinion should be accepted without any delay. He said the only way out is immediate Governor Rule by invoking Section 92 of J&K Constitution in the State of J&K. Dissolution of the Assembly so that the message goes straight to the youth of J&K that next Assembly election shall be opened for the political contest for the new generation so that there is no tension, no conflict and no violence.

Prof.Bhim Singh urged Shri Modi to convene a meeting of all shades of political opinion including the leadership of all factions of Hurriyat Conference so that the people of J&K shall get an opportunity to work out their democratic system of future.

Palestinian President presented Gandhi’s declaration o1 1938, ‘Palestine belongs to the Palestinians’

 A unique declaration of Mahatma Gandhi which he made in his newspaper, ‘The Harijan’ in 1938 declaring that, “Palestine belongs to the Palestinians in the same way as France belongs to French and England to the English.”  This declaration became the international policy followed by India till this day as India stood by the side of the Palestinians. Even during the UN Resolution 181 which was passed in 1948 by the United Nations India, Iran, Yugoslavia and a couple of other countries opposed the division of Palestine. Prof.Bhim Singh, Chief Patron of J&K National Panthers Party & Sr. Executive Member of Supreme Court Bar Association accused all the big powers who supported the division of Palestine and creating State of Israel in 1948.

Prof.Bhim Singh wrote a book on division of Palestine and creation of Israel which he felt that it was a dangerous move of the United Nations and all the 5 big powers were guilty of this blunder.

Prof.Bhim Singh presented a gift, documented with the declaration of Mahatma Gandhi which he made in 1938 declaring that, “Palestine belongs to the Arabs (Palestinians) in the same sense that England belongs to the English or France to the French”. This was only a reminder to the world that India stood by Palestine, stands by Palestine and shall continue to be with Palestine in the interest of international peace, progress and development.

Prof.Bhim Singh met Yasir Arafat the founder of Palestine Liberation Organization and the Founder President of the State of Palestine in 1968 at a Red Cross Office on the Eastern side of Jordan River while he was travelling on motorcycle around the world on peace mission. Prof.Bhim Singh remained in touch with Yasir Arafat and PLO from day one till the death of Yasir Arafat in 2004. Prof.Bhim Singh was the only foreigner to pay last tributes to Yasir Arafat in Ram Allah, Palestine in 2004. Prof.Bhim Singh also met President, Mehmoud Abbas in Palestine couple of years back when he visited Palestine.

Prof.Bhim Singh expressed full solidarity and support to the PLO and its leadership for ensuring for the establishment of full sovereign state of Palestine with Jerusalem as its capital.
