Governor Rule in J&K is only way out to save J&K from further death & destruction

Prof.Bhim Singh, Chief Patron of JKNPP urged President of India, Shri Pranab Mukherjee to exercise his constitutional power vested in him under the mandate of temporary provision Article 370 of Constitution of India. Though, old yet is the only provision in the Constitution of India which has vested constitutional power in the President of India to intervene in case of Emergency, external aggression or internal disturbance in the State of J&K. Prof.Bhim Singh said that the President of India may be failing in his constitutional responsibility if he fails to intervene to restore peace in the State of J&K as he is the only constitutional authority who is vested with power under Section 92 of the Constitution of J&K (J&K has a separate Constitution as Constitution of India is not applicable to the State of J&K). Under Section 92 the Governor of J&K is empowered to impose Governor Rule and dismiss Assembly of J&K as provided in the Constitution of J&K yet he has to seek clearance from the President of India under the Constitution of J&K also.

          Prof.Bhim Singh reminded the President of India that Kashmir has been bleeding and it was bleeding profusely this afternoon when Chief Minister of J&K Ms. Mehbooba Mufti was meeting with the Prime Minister of India, Shri Narendra Modi, Kashmir police were using bullets and guns against the protesting students in the heart of the city of Srinagar.

          Prof.Bhim Singh said that President of India can advice the Governor straight within the scope and meaning of Article 370 read with Section 92 of J&K Constitution and advice the Governor to dismiss the J&K Govt. and impose Governor Rule in the larger national interest without seeking any opinion of the Union Govt. Prof.Bhim Singh expressed hope that Prime Minister Modi shall keep in mind larger interest of the nation—Bharata, than the petty interest of BJP ministers in the State of J&K who likely to loose their jobs and benefits with the imposition of Governor Rule in the State of J&K. Prof.Bhim Singh hoped that Shri Modi to keep interest of Bharata and not BJP ministers in J&K to save J&K from further death and destruction.

Sr. Advocate, Bhim Singh expresses concern about doubtful journey of digital court in India

Prof.Bhim Singh, Sr. Advocate of Supreme Court, Executive Chairman of State Legal Aid Committee & Sr. Executive Member of SCBA who attended the inaugural session on—a Digital Court which was inaugurated by the Prime Minister of India, Shri Narendra Modi in the presence of the Chief Justice of India, Mr. J.S. Khehar this morning expressed deep concern on the situation of the illiterate clients in the country who have little knowledge of computer science if the digital courts shall be able to bring quick justice to the litigants which have not yet learnt ABC in the literal word in India as more than 60% people in the rural India have not yet learnt even to sign their names in their local alphabets.

            Prof.Bhim Singh who was invited to attend the inaugural session of towards a Digital Court at Vigyan Bhawan, New Delhi this morning where Prime Minister of India, Shri Narendra Modi also delivered an impressive lecture in Hindi. The Prime Minister was, it appeared, addressing the judges, advocates and the members of civil society at Vigyan Bhawan as if he was addressing an election meeting while advocating for a digital court least realizing (there was nobody to question the speakers) that nearly 60% of rural India is without electricity and the computers has no value or utility in the rural areas. Besides, the computer mechanics could not be available according to the needs in the rural areas of the country. Prof.Bhim Singh said that the language in the Supreme Court and in most of the High Courts is English which is not the commonly understood language in the rural areas. Prof.Bhim Singh described it as unfortunate that the national leaders including the Prime Minister should have canvassed for the computers and the internet which is in the exclusive control and domain of the western world. Prof.Bhim Singh said that if the satellites transmitting or controlling internet system get switched off for 24 hours in their display to the third word/India what shall be the situation in the country. Prof.Bhim Singh said that as long as India has no guaranteed power supply of its own around the clock and its means Indian controlled satellites dealing with the scientific control.There could be no security to the system. Prof.Bhim Singh said that the Prime Minister of India and the Govt. should first take steps to ensure the supply of electricity to every person in the country around the clock. Besides, the Satellites controlling the movement and working of the internet system should go under the control of the Parliament of India so that India does not remain dependent on the supply of internet services to the western world.

            Prof.Bhim Singh said that the present internet system which the Chief Justice of India inaugurated today to promote digital courts in the country may not help even 10% of the litigants in the country. This system shall promote only bifurcation/isolation of 80% population mostly the people in the rural India and other living below the poverty line. That will create a vertical division in the country as the law agency/digital courts shall be available only to the privileged/rich class of the litigants whereas the rest shall completely isolated from the system. Prof.Bhim Singh also expressed surprise how this system shall help introduce the litigation in the national and the regional languages as to reach a common man in the country.      

            Prof.Bhim Singh said that he shall shortly convened a meeting of the legal experts/ representatives of all high court bar associations as co-chairman of the coordination committee of the High Court Association.    

            Prof.Bhim Singh urged Chief Justice of India to convene  a meeting of the representatives of all the Bar Associations of all the High Courts, of course, including the Supreme Court Bar Association to assess their views and seek their constructive suggestions in this regard.

NPP Supremo urges President of India to impose Governor Rule in J&K in the interest of National Integration

Prof. Bhim Singh, Chief Patron JKNPP addressing a Press Conference in Srinagar (Kashmir) late last evening urged President of India, Shri Pranab Mukherjee to issue an advice to the Governor of J&K to impose Governor Rule in J&K expressing full confidence that the situation shall return to normalcy and the people shall cooperate with Governor Rule. Prof. Bhim Singh appealed to the Governor to take over the administration without further delay. All the prisoners taken in custody since July 2016 should be released immediately and unconditionally and further demanded that all police raids and assaults on the civilian population should be stopped. Damages caused to the property or to the life of the people should be compensated immediately. A special meeting of the representatives of political parties of J&K including representatives of the Hurriyat Conference (All forms) should be called in special meeting by the Prime Minister of India. So that the confidence in the people is restored.

Any laxity in imposing Governor Rule by dismissing J&K Govt. shall be disastrous

Prof.Bhim Singh, Chief Patron of J&K National Panthers Party urged the Governor of J&K to impose Governor Rule by invoking Section 92 of J&K Constitution without any delay so that the citizens of India in J&K (residents of J&K) could be protected under the present circumstances as the entire situation has been hijacked by politically sponsored elements in the State of J&K.

Prof.Bhim Singh also appealed the Chief Minister of J&K to show her magnanimity at this hour by resigning from the government so that the innocent people of J&K may not suffer any more under the most treacherous circumstances as has happened in the past.

Prof.Bhim Singh said that even the civil rights activists and the journalists have started feeling the heat of the unwanted government which is forcing the police and the agencies to act beyond the control of the limits of law and rule of law. Prof.Bhim Singh expressed sympathy with the lawyers, civil rights activists and the journalists covering the situation created by lawlessness and anarchy in Kashmir because of the collapse of the governance.

Prof.Bhim Singh appealed the Governor Shri N.N. Vohra to exercise his exclusive power entrusted in him under Section 92 of the Constitution of J&K and impose Governor Rule by dismissing the present government. Prof.Bhim Singh appealed to the Prime Minister of India to convene a special meeting of the political representatives drawn from all political parties of J&K including the representatives of Hurriyat Conference (though it is not recognised by Election Commission of India). Prof.Bhim Singh said that Heart to Heart Talk with the representatives of J&K is essential to restore peace in the State of J&K. That is possible only after the Governor Rule is imposed and social security is granted to all elements. He also demanded immediate release of all persons arrested during the disturbances in Kashmir in the interest of reaching out to a common person in Kashmir.

NPP Supremo urges PM Modi to convene National Integration Council Meeting on J&K, North-East

Prof.Bhim Singh, Chief Patron of J&K National Panthers Party, one of the old members in the National Integration Council today urged Prime Minister, Shri Narendra Modi to convene an urgent meeting of NIC to discuss the situation in J&K which is no more in the control of J&K Govt. and also the situation that is growing in the North-East. Prof.Bhim Singh said that he happened to be Member of NIC on behalf of J&K National Panthers Party which is a recognized political party by the Election Commission of India. All the recognized political parties have a legal representation in the NIC. Prof.Bhim Singh regretted that Shri Modi ji as Prime Minister has not been advised by his colleagues in the Govt. to hold NIC meeting of which the Prime Minister is ex-officio Chairman. Prof.Bhim Singh in a letter to Shri Narendra Modi ji, the Prime Minister of India has made a strong appeal to hold a meeting of the National Integration Council which he may revive any day and the framework of the National Integration Council  is already resting in the boxes of the Union Home Ministry.

Prof.Bhim Singh said that situation in J&K is no more in the control of the Govt. of J&K as the governance has completely collapsed which is evident from the fact that Shri N.N. Vohra, the Governor of J&K has to wait for three day to meet the Prime Minister of India for consultation when entire Kashmir is on fire.

Prof.Bhim Singh has urged the Prime Minister of India to convene an urgent meeting of the NIC. In the meantime, Prof.Bhim Singh has reiterated his stand demanding imposition of Governor Rule under Section 92 of J&K Constitution which Governor of J&K can impose after the clearance from the President of India as is mandatory in the Constitution of J&K and Section 92 of its Constitution.
