NPP Supremo reminds political hawks on J&K constitutional status vis-à-vis Union of India

Prof.Bhim Singh, a senior advocate in the Supreme Court of  India and Founder of National Panthers Party questioned the national leadership, the so-called separatists in Kashmir and political hawks in Pakistan on their counter productive statements vis-à-vis J&K relating to its relationship with the Union of India as well as the status of the so-called refugees who migrated to J&K from Sialkote side in 1947 as refugees when India suffered division. Prof.Bhim Singh reminded the politicians as well as the so-called separatists in Kashmir besides the leadership in Pakistan that the Maharaja (ruler of J&K) acceded to the Union of India and all other 575 states which acceded to the Union of India were admitted into the Union of India. J&K was not merged into the Union of India by the Constituent Assembly and the Parliament of India did not care to merge the State of J&K with the Union of India. Maharaja Hari Singh continued as the ruler of J&K. It was on 20th August, 1952 that the so-called Constituent Assembly of J&K (which was an illegitimate creation of National Conference) passed resolution on August 20, 1952 declaring that Maharaja has been expelled. This was in total contradiction of the resolution of the British Parliament which was adopted to confer relationship to the States before the Constitution of India was promulgated on 26th January, 1950. Maharaja did no wrong and like other rulers he acceded to the Union of India. Sheikh Abdullah leader of the National Conference, the tallest and accepted leader of the Kashmiri Muslims supported and backed the Accession signed by Maharaja Hari Singh.

            It was the Constituent Assembly of India which blundered and ignored the advice of the Chairman of the Constituent Assembly Dr. Bhimrao Ambedkar who was for the complete merger of J&K like other 577 states which joined the Union of India. The two states Hyderabad and Junagarh had never signed the Instrument of Accession even when they were merged with the Union of India. J&K was the only casaulty promoted by the Constituent Assembly.

            Prof.Bhim Singh today told Foreign Office Spokesman Nafees Zakaria of Pakistan that it was Pakistan which violated the United Nations resolution dated 5th August, 1948 refusing to withdraw from the territories of J&K which Pakistan had illegally occupied after Maharaja acceded to the Union of India in 1947. Prof.Bhim Singh said that only Kashmir issue is the vacation of illegal occupation of Pakistan as was forcefully raised by Shri V.K. Krishna Menon, the Indian representative in the United Nations in 1957 and again in 1961. NPP Supremo asked Pakistan to file rejoinder to the statement of Shri V.K. Krishna Menon first. Prof.Bhim Singh questioned the stand taken by the Hurriyat Conference leaders, residing in Kashmir Valley to hold state wide protests and demonstrations against issuing of domicile certificates to the West Pakistani refugees. Prof.BhimSingh expressed shock on the ignorance of the Indian leadership that they have no idea that the bulk of Indian population was forced out of Sialkote/Lahore sectors which was under partition plan and those who were forced to migrate to Indian side from Sialkote into the nearest safe zones from Sialkote were the districts of Jammu and Kathua. Prof.Bhim Singh argued forcefully that all of them were allotted immovable property (agricultural land) by the administration of headed by Sheikh Mohd. Abdullah the then administrator of the border areas appointed by the then Maharaja of J&K. It was under the direction and action of Sheikh Mohd. Abdullah that the migrant families from Sialkote sector were allotted immovable land in the districts of Kathua (included Hiranagar), Jammu (included Districts of Samba and Akhnoor). This allotment was made under the seal and signatures of the administrator of the area, Sheikh Mohd. Abdullah in 1947 itself. Almost all migrants who entered at that time have vanished and their children and grandchildren are settled on those plots (agricultural land). Under the law all those who came and settled in J&K before 1954 have the same rights as the permanent residents of the State of J&K. It is pity that the Congress Party or even BJP lack this information or understanding about the complex situation in the eyes of law that prevails in the State of J&K.

            Prof.Bhim Singh said that the Panthers Party shall take up the matter before the Supreme Court of India regarding the status and political rights of all those who were born in the State of J&K after 1947 and before 1954. They have the right to be settled in J&K as permanent residents of the state according to the law relating to the so-called ‘State Subject’ (permanent residents). Prof.Bhim Singh regretted that the BJP leadership in the entire country has failed to understand the real issues which are being faced by the residents of J&K who happened to be citizens of India even according to the law of the land and international law.

Six months time to Parliament to decide on J&K merger

Prof. Bhim Singh urged on the Parliament of India to decide on the merger of J&K with Union of India which was not done on 26th January 1950 which has created a constitutional crisis. Seventy years have gone and Parliament is setting silent.

Prof. Bhim Singh said in a Press Conference at Jammu NPP headquarters that a contempt petition against the Chief Minister and Deputy Chief Minister of Jammu and Kashmir shall be filed in the Supreme Court for willfully defying the orders of the Supreme Court to pay compensation to Panthers Party leaders namely Ms. Anita Thakur (2 lacs), Mr. H.C.Jalmeria Advocate (1 Lacs) and Mr. P.K.Ganju (1 lacs). The order was passed on August 12, 2016. It was to be paid by J&K Govt. within 2 month. There is an open defiance of the order of the Supreme Court.

On west Pakistani refugees who have been residing in J&K as orphaned since 1947, NPP Supremo accused the Parliament of India for ignoring nearly 85,000 human beings who were forced to migrate from the Indian Territory called Pakistan in 1947. They were settled by the administrator of Jammu and Kashmir, Sheikh Mohd. Abdulla in 1947 on the border district namely, Kathua, Jammu and Poonch. They were allotted land for on the border areas. NPP Supremo said that children, grandchildren and others born in Jammu and Kashmir cannot be denied their right to reside/settled in Jammu and Kashmir. This is International Law and no power on earth can deny them their birth right in J&K.

Prof. Bhim Singh said that reorganization is the only solution to ensure social, political and constitutional rights to all citizens of India residing in Ladakh, Kashmir Valley and Jammu Pradesh.   

NPP Supremo carries mission one India, one Flag & one Constitution through Districts Samba, Kathua, Jammu

The Panthers Party Supremo Prof.Bhim Singh with his team addressed several meetings at several places in the Districts of Jammu, Samba & Kathua (bordering Punjab) today carrying his mission one India, one Flag and one Constitution with provision of fundamental rights to all the residents of J&K enjoying the status of Indian citizenship for the past 70 years. They have remained devoid of fundamental rights till today though the state acceded to the Union of India in 1947 with the signatures of the ruler of the state, Maharaja Hari Singh.

          Prof.Bhim Singh addressing public meeting at historic place of Samba facing international borders with Pakistan and Kathua adjoining to Punjab today expressed deep regrets on behalf of the people of J&K that J&K was the only state which had Muslim majority and which acceded to the Union of India in 1947 with the universal acceptance of the people of J&K. He said Maharaja signed the Accession when people of J&K stood in one voice against the aggression committed by Pakistan on 20th October, 1947. Prof.Bhim Singh said that the Constituent Assembly of India played foul with the people of J&K by keeping J&K out of the list of the States which had acceded to the Union of India before the Constitution was promulgated on 26th January, 1950. Prof.Bhim Singh said that J&K was only state whose ruler had acceded to the Union of India by taking approval of the entire people of J&K yet the leadership of the Constituent Assembly and later the Parliament of India betrayed the people of J&K by keeping J&K away from the list of the States joining Union of India on 26th January, 1950.

          Prof.Bhim Singh said that the Indian leadership irrespective of political affiliation may it be Congress, Communists, Jan Sangh (BJP) or any other political party in Parliament—all of them betrayed the people of J&K by keeping them out of the Union of India. He said J&K has not been integrated till date and the living evidence in this regard is Dr. Karan Singh, the only son of Maharaja Hari Singh, the ruler of J&K who was thrown out of the state on March 5, 1948 by the  dictates of the Congress and no other party in the country stood by the Accession signed by Maharaja. Accession was not approved (till date) by the Parliament of India. Prof.Bhim Singh said that the problem of J&K is the creation of the leadership of India irrespective of ideological affiliation. BJP has also joined the club of the leaders who betrayed the people of J&K.

          Prof.Bhim Singh said that the Panthers Party shall carry this movement from Kashmir to Kanyakumari with mission one India, one Flag, one Constitution and Fundamental Rights for all the residents of J&K so that the children of Kashmir are not smashed like fish by the pellet guns and the youth shall not starve in the prisons as he (Bhim Singh) suffered himself as a prisoner in the state of J&K though he carried National Flag and secular voice throughout.

NPP Supremo calls on Panthers Party activists to take up movement of one Flag, one Constitution & FRs for all

Addressing a strong rally of the Panthers Party leaders and office bearers at Jammu today, Prof.Bhim Singh, Chief Patron of National Panthers Party made it clear that peace in J&K is possible only when the entire country shall have one Flag (Tri-colour), one Constitution and Fundamental Rights for all from Kashmir to Kanyakumari. Peace in J&K is possible only when the people of entire State including Ladakh, Kashmir and Jammu shall be guaranteed all fundamental rights which have not been given to the citizens of India residing in J&K for the past 70 years.

          Addressing senior party activists at Panthers Party headquarters in Gandhinagar, Jammu this afternoon, Prof.Bhim Singh expressed shock on the failure of Modi government on all fronts ranging from the demonetization to Kashmir, he said that J&K has been used by the BJP government as a toy making mockery of the fundamental rights of the people of J&K.

Prof.Bhim Singh also presented detailed report of the situation prevailing in the border areas of Jammu (rural), Rajouri, Poonch, Gool-Gulabgarh, Reasi and other areas which were visited by Prof.Bhim Singh with his team in the past four days.

Prof.Bhim Singh said that J&K can have peace and the people shall live with honour and dignity only when J&K is integrated with the rest of the country and the entire nation from Kashmir to Kanyakumari shall have one Flag, one Constitution and Fundamental Rights to all. He said that people of J&K (Indian citizens) have not been provided Fundamental Rights in the Constitution of J&K as Constitution of India is not applicable in the State of J&K. Prof.Bhim Singh said that Accession by Maharaja Hari Singh in 1947 which was duly signed by Maharaja Hari Singh has not been approved/accepted by the Parliament of India as it was done in respect of 575 other states whose rulers had signed Instrument of Accession. Maharaja signed the Instrument of Accession on 26th October, 1947 but that was not treated and merger by the Constituent Assembly of India.  J&K has not been merged with the Union of India till today as it was done in respect of 577 other states. Though, two states Junagara and Hyderabad had not merged with the Union of India. Prof.Bhim Singh said that Parliament shall have to take a decision without delay and merged State of J&K with the rest of the country so that the people of J&K shall also enjoy the fundamental rights like their Indian brethren. The special meeting was presided by JKNPP President, Mr. Balwant Singh Mankotia. NPP Supremo asks BJP to spell their mission Do they stand for One India and One Flag?

Addressing huge public rallies in Mendhar in District Poonch and Rajouri (border Districts in J&K) Prof.Bhim Singh, Chief Patron of National Panthers Party praised the people of Poonch and Rajouri for their super performance as nationalist who have been suffering from 1947 till date because of discriminatory policy of the Parliament and J&K Government for nearly 70 years still the people of these areas have stood for Indian nationalism and suffered untold miseries, discrimination and assault on their fundamental rights by the Governors of India and State Govt.

          Prof.Bhim Singh on his mission One India with one Flag and one Constitution and fundamental rights to all Indian citizens in J&K who have been facing discrimination, assault on their fundamental rights and have remained denied of justice, equity and equality since 1950. Constitution of India does not guarantee fundamental rights to the people of J&K till date because people of Jammu and Kashmir have been forced to live as slaves under a Constitution called J&K Constitution with no fundamental rights, no civil liberties and without Indian Flag and Constitution. This is the State of J&K. J&K has 10 Members of Parliament, 6 six in Lok Sabha and 4 in Rajya Sabha who have no right to move any amendment in the Constitution to extend the benefits of the Indian Constitution or it privileges to the Indian citizens in J&K. The citizens of J&K though have been defined as citizens of India yet they have no fundamental rights available for them which are carried in the Constitution of India.

          While addressing a people’s rally in Mendhar, Prof.Bhim Singh praised the people living along LoC and carrying Indian Flag though Indian Flag is not available for them. Prof.Bhim Singh also expressed the same sentiments and wishes at Rajouri.

          Addressing the people in Mendhar Ms.Anita Thakur, General Secretary-JKNPP asked Parliament of India to provide the facilities and privileges mentioned in the Constitution of India to the people of J&K with fundamental rights and flag so that the people of J&K shall also feel as citizens of India. Welcoming the Panthers Party leaders, the State Secretary of Panthers Party, Mr. Tariq Khan declared that people of Poonch have made untold sacrifices to integrate with India and they shall fight all those who have been opposing National Flag in J&K.

          In Rajouri, the District President of Panthers Party Mr. Ghulam Mustafa Wani,District Youth President, Mr. Zahid Charak assured that the youth of border Districts of Rajouri and Poonch shall fight for Indian Flag, Indian Constitution and demand that all fundamental rights available in the Constitution of India shall be provided to the people of J&K also. Addressing the gathering Haji Mohd. Fazal Mir at Rajouri declared that the people of the border areas are committed to strengthen secular and democratic India. He assured the Panthers Party that the mission One India–One Flag, One Constitution and fundamental rights shall be delivered to every Indian citizens in J&K.
