JKNPP PROTESTS AT JANTAR MANTER SEEKING IMPOSITION OF GOVERNOR RULE IN J&K

Enraged over the fast deteriorating situation in J&K and failure of state govt. to restore law and order, scores of JKNPP activists today led by Harsh Dev Singh Chairman and Former Minister, Balwant Singh Mankotia State President and Yash Paul Kundal State President Young Panthers held a massive demonstration at Jantar Mantar, New Delhi seeking imposition of Governor Rule in the State. The Panthers activists look out a procession and proceeded towards Parliament House but were stopped by the Police and restrained from proceeding further. The angry protestors raised slogans against state and central govt. and were addressed by several senior leaders of the party.

Expressing serious concern over the breakdown of Administrative and constitutional machinery in the State and attacks on Amar Nath Ji pilgrims, as well as police stations and security forces, Mr. Harsh Dev Singh said that the prevailing situation in the state called for imposition of Governor rule under Section 92 of the Constitution of the state.

Addressing the media persons, Mr. Harsh Dev Singh lampooned the govt. for having failed to respond appropriately to the situation created in the wake of killing of Hizb Commander and the resultant turbulence witnessed in the Valley. He regretted that with over 40 people killed, more than 4000 injured and religious pilgrimage being assaulted, it was virtually a case of anarchy and lawlessness prevailing in Kashmir with no signs of government on the ground. He said that the Ministers who ought to have come out of their hiding and made themselves available to the civil society had deliriously shun their responsibility thus allowing the situation to further deteriorate.

Alleging total collapse of law and order with administration having lost control over the fast deteriorating situation, Mr. Harsh Dev Singh said that the separatists, subversives and anti nationals had virtually taken control of the situation with repeated calls for extensions of violent protests. He said that most alarming was the disarming of the security personnel who were ordered by the BJP-PDP govt. not to use force despite the gravest provocations of the saboteurs or in spite of the violent attacks by them. He said that while use of disproportionate force was always condemnable, the security personnel could not be made fodder to highly violent and aggressive felons and could not be deprived of the right to self defense. He cautioned that the fast deteriorating situation had the potential to revert back to early nineties and said that the unholy alliance between the BJP and PDP was squarely responsible for the same.

Mr. Balwant Singh Mankotia, while holding the appeasement Policy pursued by the incumbent govt. responsible for the prevalent crisis, Mr. Singh said that the govt. had taken several unsavoury decisions at the behest of separatists and others anti national forces which had emboldened such elements. He said that the decision taken for release of 634 stone-pelters reportedly linked to ISI and other terror outfits, consent for opening of Nepal route for return of militants, vacation of land from Army, refusal of Abhinav Gupt Yatra, denial of Sainik Colonies and KP Townships were all under the explicit dictates of separatists thus encouraging them to intensify their fissiparous tendencies. He said that non initiation of action against those waiving Pak flags and ISIS flags and showing disrespect to Indian Flag had emboldened the felons besides dampening morale of security forces.

Mr. Yash Paul Kundal regretted that the tale piece of the sordid state of affairs was the full support of the BJP to the Kashmir centric leadership in the highly egregious decisions which in effect amounted to compromising the national honour and security for the lust of power. While ridiculing the tall slogans of ‘zero tolerance’ against anti nationals given by BJP, he regretted that the saffron leaders had in fact displayed infinite tolerance only to retain the role of junior partner in the PDP govt. He said that it was high time that union govt. and state Governor acted to save the state from ruin and disaster.

JKNPP LEADERS ARRESTED IN DELHI WHILE PROTESTING OUTSIDE PAK HIGH COMMISSION

New Delhi, 19th July 2016:Admonishing Pakistan to refrain from its interference in the internal affairs of India, a strong contingent of Panthers party activists today staged a massive demonstration outside Pakistan High Commission, New Delhi which was spearheaded by Mr. Harsh Dev Singh Chairman JKNPP, Mr. Balwant Singh Mankotia State President JKNPP and Mr. Yashpal Kundal State President Young Panthers along with other leaders against  its overt and covert support to secessionists and terrorists in Jammu and Kashmir. Accusing Pakistan for converting Kashmir into a vortex of violence, the ardent protestors carrying National flags raised pro-India and anti-Pak slogans. The activists amidst the heated exchanges had scuffle with the security personnel following which the heavily armed cops aggressively pounced upon the leaders, manhandled them and arrested and detained them in the Chanakyapuri Police Station. The activists after the release assembled at Tara Mandal Chanakyapuri where the Panthers leaders continued their protest and addressed the gathering. Similar protests were also held at Jammu, Udhampur, Samba and Kathua.

hc-1Addressing the gathering on the occasion at Tara Mandal, New Delhi, Mr. Harsh Dev Singh lambasted Pakistan for its pernicious designs in aiding and abetting militancy in Jammu and Kashmir and elsewhere in the country with utterly malevolent, baleful and ulterior motives. He castigated Pakistan for its highly malicious and mischievous designs in sponsoring militancy particularly in J&K and pushing in proselytized traitors to vitiate peace and harmony on our side of the borders. Castigating Pakistan for its terror training camps, its Hawala deals, its drug trafficking, its moral and material support to secessionism besides its highly rancorous propaganda in the print and electronic media, against India, Mr. Singh lamented that Pak’s notoriety had assumed alarming an unacceptable proportions. He said that recent statement of Pakistan Prime Minister Nawaz Sharif endorsing all kinds of support to the secessionists in Kashmir besides expressing sympathies with the slain militant Burhan Wani should be an eye opener for the international community. Mr. Singh disclosed that PM of Pakistan crossed all  the limits when he recently announced to observe July 19thas ‘Black Day’ in protest against the ongoing Kashmir turbulence while addressing a cabinet meeting at Lahore’s Governor House. He said that was the reason Panthers Party chose the same day to lodge its protest against Pakistan and caution the rogue state to desist from poking its nose in Indian matters. He further divulged that Pakistan’s terror manufacturing antecedents were known the world over and the recent venomous rants of Hafiz Sayeed against India had only unveiled Pakistan being a terror exporting state. Castigating the hostile neighbour for its highly dubious deals, Mr. Singh cautioned Pakistan to break out from the mindset of improbity, deceit and belligerence that it has embarked upon and to stop meddling in the affairs of J&K. He further called for vacation of Pak aggression from the occupied territories of J&K which are very much a part of Jammu and Kashmir. He said that Union Parliament had also passed a resolution in 1994 for liberating POJK as this same fell within the domain of Indian Union. Ridiculing the BJP over its muscle flexing while in opposition, he questioned the Saffron Party that where had its jingoism and chauvinism vanished despite Pak’s brazen support to the Separatism in Kashmir. He said that JKNPP was constrained to lodge a protest as the State government has miserably failed to control the situation in Kashmir besides BJP despite its tall harangues and rhetorical overtures had abdicated its responsibility of questioning the belligerent nation over its misadventures and violent posturing.

Mr. Balwant Singh Mankotia while condemning Pakistan for inciting violence and trouble in J&K called upon the international community to take cognizance of the utter hostility and belligerence of the neighbouring country. He said that Pakistan had created dozens of terror groups in the name of ‘Jehad’ who were resorting to violence and propagating secession and separatism. He said that Jammu and Kashmir is an integral part of India and no power on earth can change this fact. Warning Pakistan to desist from its highly mischievous and hostile conduct, Mr. Mankotia said that the Union Govt. must give a blunt message to Pakistan restraining it from indulging in day dreaming on the issue of J&K. He said that the Nation was eagerly awaiting the tough posturing against Pakistani misadventures as emphatically proclaimed by Prime Minister, Mr. Narendra Modi on scores of occasions. He said that it must be clear to all that the National security is the top most priority and no compromise on the same is acceptable in any situation.

Mr. Yashpal Kundal called upon Pakistan to rein-in its paid agents in J&K and refrain from any further misadventures in the interests of peace in South Asia. He further maintained that increase in the frequency of the cease fire violations besides proxy war launched in the State of J&K by Pakistan called for stern measures against the rogue nation by taking the world community into confidence.

Sub:-Petition to the Hon’ble Speaker to introduce amendment in Article 370 for the safety, security and integrity of the nation.

 

Hon’ble Speaker, Madam,

Jammu and Kashmir National Panthers Party is submitting the following amendment in Article 370 of the Constitution of India to be introduced and carried in the Constitution of India in the interest of national integrity, security and unity of India.

It is submitted that a temporary provision under the name and style, “Temporary provision-Article 370” was inserted in the Constitution of India as a temporary faith at the time of promulgation of the Constitution of India on 26th January, 1950. This Article was temporary and heavily defended by the Chairman of the Constituent Assembly Dr. Bhimrao Ambedkar. This was assured that this provision was temporary and would not continue long.

The blunder committed by the Constituent Assembly cannot be ignored by keeping State of J&K out of the Union of India and the State ruler Maharaja Hari Singh was forced to continue as Ruler. J&K was only state which was not merged into the Union of India by the Constituent Assembly. This blunder has proved a disaster for the national unity and the Parliament has not till date declared the merger of J&K with the Union of India.

That Article 370 has turned out to becancer’ in the heart of the Constitution of India and the responsibility for this tragedy lies on the Parliament of India which has failed to take appropriate action in 67 years or so.

The Panthers Party urged on the Hon’ble Speaker to introduce amendment in Article 370 in the Constitution of India by deleting Clause (3) of Article 370 which bars the supreme power of the Parliament to amend any (a) provision of Article 370.

It is submitted that India is one from J&K to Kanyakumari and therefore one nation cannot be governed by the separate Constitution. The Parliament of India is fully competent to amend Article 370 and extend the domain of the Constitution of India from Kashmir to Kanyakumari with one flag and one constitution.

demo-370The Panthers Party would like to submit before the Parliament that the Parliament should act boldly in the interest of unity, integrity and sovereignty of India from J&K to Kanyakumari. The power of Parliament to legislate in respect of the subjects mentioned in List-I of Schedule-VII should be restored in respect of J&K which acceded to the Union of India under the seal and signatures of the then ruler of J&K, Maharaja Hari Singh. This decision of the ruler of J&K was in accordance with the dictates of the Instrument of Accession. Similar Instruments of Accession signed by 577 Rulers/Maharajas/Nawabs of their respective states were accepted by the Constituent Assembly keeping J&K away but expelled the Maharaja from J&K state for personal vengeance.

            The Parliament of India must exercise its supreme power to amend temporary provision of Article 370 which is possible only by a majority vote as this is an ordinary amendment to amend only a temporary provision. Parliament of India under the leadership of Prime Minister Morarji Desai removed right to property (Article 31) from the Chapter of Fundamental Rights. If Parliament can amend a provision relating to fundamental rights, what stops that Parliament to amend/remove a temporary provision (Article 370) which was inserted into the Constitution for only avenging the ruler of Kashmir for personal vendetta.

            The Panthers Party would like to make a strong appeal to Hon’ble Members of Parliament to take this most needed step to ensure that there is one Constitution and one Flag for the entire Union of India from Kashmir to Kanyakumari and Gujarat to Nagaland. The people in J&K have been suffering for want of fundamental rights which are not applicable to the residents of J&K as the fundamental rights are not available in the so-called Constitution of J&K.

            This is strong submission by J&K National Panthers Party that the residents of J&K being citizens of India may be extended all fundamental rights without any delay. There is a need to dissolve the present Assembly in J&K, dismiss the Government in the state and invoke Section 92 of the J&K Constitution so that the Governor Rule is imposed without any delay to ensure return of peace and fundamental rights to every citizen of India residing in J&K.

Lift dragon siege of Kashmir Valley , Stop massacring human rights of citizens

In a strong communication addressed to Shri N.N. Vohra, the Governor of J&K, Prof.Bhim Singh, Founder of National Panthers Party braving all oppressions and suppressions caused by J&K government for decades urged the Governor to invoke Section 92 of J&K Constitution, dissolve the State Assembly and the Government without any delay as there is no existence of the government and the enemies of the country have infiltrated into the peace zone of Jammu province. Prof.Bhim Singh urged the Governor to take stock of the situation that has been moving towards dangerous turning which is evident from the incidence that has created uncertainty in the Districts of Poonch and Rajouri. Prof.Bhim Singh said that people of Poonch had resisted Pak-invaders in 1947 and suffered a lot. Enemies of peace have been trying to create tension in the borders areas which needs to be checked by the government. He expressed regrets that government in J&K have literally collapsed whereas the enemies of peace aided and abetted by foreign powers have been exploiting the situation which can threaten the peace and stability in J&K.

Prof.Bhim Singh expressed shock that the Govt. of India has no idea about the situation and the circumstances that are emerging in J&K during the PDP-BJP rule. He said that there is no governance in the state and the security has collapsed. The people in Kashmir Valley have been forced to live like prisoner with no security, no protection, no food, no medicine, in other words the situation the people of J&K have been facing for over one week is worst than the prisoners living in prison. The prisoners, at least, are provided food, water and even medical aid whereas the people in the Valley have been forced to live in a situation which can be termed as a hell. Prof.Bhim Singh said that the people of Kashmir have made tremendous sacrifices and the resisted the enemy in 1947 under the leadership of Sheikh Mohd.Abdullah, Mirza Afzel Beg and others. He said that what is happening in Kashmir today is unfortunate, undesirable and unacceptable in a civilized society of India where people have fundamental rights enshrined in the heart of the Constitution of India. Unfortunately, he said, that the people of J&K have remained denied of the fundamental rights enshrined in the Constitution of India under the pretext of so-called Article 370 which has proved to be a wailing wall of Jerusalem segregating the people of J&K from the rest of the country, India though J&K is also an integral part of India.

Prof.Bhim Singh urged President of India, Shri Pranab Mukherjee to exercise his exclusive power enshrined in the Constitution of India in Article 370 and direct the Governor of J&K to dissolve the present Government and the Legislative Assembly so that the entire government shall be taken under the command of Governor within the meaning of scope of Section 92 of the Constitution of J&K.

Prof.Bhim Singh also appealed to the people of Kashmir Valley, particularly to the younger generation to support the Panthers Party stand for the imposition of Governor Rule in the state and the release of all political prisoners and those detained under protective laws. He urged Governor to response to the genuine aspiration and urges of the people of J&K, particularly those who have been suffering for no reason. Prof.Bhim Singh appealed the youth to keep away from any kind of violence whatsoever under all situations and join the cause of ensuring of implementation of all human rights the people of J&K are entitled under the Constitution of India.

NPP Supremo seeks support of Parliament to save J&K from further death & disaster

Prof.Bhim Singh, Chief Patron of National Panthers Party while addressing the media at Jantar Mantar, New Delhi in front of the NPP headquarters declared that the Panthers Party shall launch a campaign withtricolour in hands from Kashmir to Kanyakumari to declare that India is one with one Constitution and one Flag. He accused the ruling parties at New Delhi including the Congress and BJP for exploiting the people of J&K under the pretext of one flaw or the other for 67 years and yet keeping J&K away from the domain of the Constitution of India under the fraudulent concept of Article 370 of the Constitution of India which has been working as a cancer in the heart of Union of India.

          Prof.Bhim Singh declared from Delhi that he shall move the Supreme Court of India for seeking immediate amendment in Article 370 so that the Constitution of India with its Chapter-III on Fundamental Rights can be corporated in the laws pertaining to J&K. Prof.Bhim Singh questioned the Govts. of J&K and their leaders of Congress, PDP, NC and BJP for misleading the people of J&K for 67 years just to quench their bloody power thirst in Jammu and Kashmir in the name of ‘autonomy’, ‘azadi’, ‘referendum’, Pakistan, Article 370 to keep the people of J&K away from realities of political life and keep their doors shut by closing the chapter of fundamental rights for the entire population of J&K. Prof.Bhim Singh said that people of J&K deserved to be treated like Indian citizens by granting them all civil and fundamental rights enshrined in Chapter-III of the Constitution of India. This is the only message which should reach every person in J&K that every citizen of India from Kashmir to Kanyakumari shall enjoy full freedoms enshrined in the fundamental rights in Chapter-III of the Constitution of India which has remained denied to them for 67 years.

          Prof.Bhim Singh declared that the Panthers Party shall resort to fast in front of Parliament of India, the day Parliament starts with a mission to seek direct intervention of the Parliament to extend civil and political rights enshrined in Chapter-III in the Indian Constitution to the people of J&K who have remained denied till day.

          Prof.Bhim Singh called on all the Members of Parliament to take up the issue of J&K directly above the party politics inside the Parliament just with a clear mandate of Parliament to amend Article 370 without any delay so that the Parliament shall have power to introduce all laws included in Central List (List-I) in Schedule-VII without any delay so that the people of J&K shall be free from the serfdom of 67 years under the fast domain of Article 370.

          The Panthers Party demanded imposition of Governor Rule under Section 92 of J&K Constitution without any delay so that the fresh election maybe held with clear mandate that India is one from Kashmir to Kanyakumari.
