17 years knocking at J&K High Court by NPP, light shines from corridors of justice, migrants get relief

Prof.Bhim Singh, Chief Patron of National Panthers Party congratulated his lawyer-colleagues in the High Court of J&K who have been working for years and making untold sacrifices to ensure the delivery of justice to the suffering people in the state. Prof.Bhim Singh congratulated the lawyers fraternity in J&K saying that the High Court of J&K under the leadership of present Chief Justice Mr. N. Paul Vasanthakumar has unleashed a glittering light flowing with justice for all which is evident from the judgment he delivered with Justice Dhiraj Singh Thakur this week on the payment of compensation to the militancy affected migrants from the hilly areas of Jammu Pradesh immediately after Pak-aggression on Kargil in 1999.

Prof.Bhim Singh said that the judgment which came after nearly 17 years of legal battling by the Panthers Party lawyers from the High Court to the Supreme Court and back from the Supreme Court to the High Court is a history which needs to be written on the Red Books of Legal History of J&K. This judgment has delivered a message to all the residents of J&K that justice is possible with the power of pen if the battle is fought with reasons, patience and faith before the court of law. This judgment of Division Bench of J&K High Court on 19th April, 2016 and finally settled on 20th April, 2016 shall remain a history in the legal world not only in India but all over the world. Justice delivered after 17 years.

The High Court finally ordered the State of J&K to pay compensation of Rs.9 crores with an interest of 9% from the date of default in 2004 to the migrants of Jammu hilly terrain. The Jammu Migrants were paid much less than the migrants from Kashmir Valley. The Jammu Migrants did not receive enhanced amount of compensation as was delivered to the migrants from Kashmir Valley. The politicians ruling the state did not raise a single voice. Prof.Bhim Singh, though, associated with the ruling group from 2003 to 2005 raised a banner of revolt against the ruling parties like Congress, PDP and others. The Panthers Party filed the petition through its General Secretary, Kamal Gauria in 1999 before the High Court of J&K at Jammu. The judgment was delivered by Justice T.S. Doabia and Justice S.K. Gupta  (High Court of J&K on 06.09.2009) allowing the petition of the Panthers Party directing the State of J&K and Union of India saying, “The policy which has been framed by the Union of India for the migrants would be made applicable to all the migrants irrespective of the region from where they have migrated. Let the benefits be released in favour of these migrants within a period of one month.”Prof.Bhim Singh, though, stated that the Panthers Party shall continue the battle to ensure full compensation to the Jammu Migrants according to the affidavit made by the State government and a reply submitted by the government inside the Legislature in reply to a question of Prof.Bhim Singh that the government owes the arrears of Rs.21 crores to the Jammu Migrants. He said that the government of J&K mischievously and fraudulently changed their commitment and the affidavit saying there were only Rs.9 crores of balance towards Jammu Migrants. Prof.Bhim Singh said that the Panthers Party shall continue the battle to ensure justice to every person who has been denied justice by the state government.

The Govt. of J&K (with NC as government) moved SLP before the Supreme Court. The Panthers Party contested and got the order from the Supreme Court on 13.07.2006 directing the State government to release arrears in favour of Jammu Migrants at par with Kashmiri Migrants as was ordered by the High Court of J&K. The Supreme Court rejected the appeal of J&K Govt. in 2006. The Supreme Court justified the direction of J&K High Court that the policy adopted by the Union of India for the migrants would be made applicable to all the migrants irrespective of the regions from which they belong.

The Govt. of J&K headed by Congress Chief Minister, Ghulam Nabi Azad dumped the order of the Supreme Court into the dustbin leaving an open challenge to the Panthers Party to continue their battle for justice and implementation of the orders of the High Court and the Supreme court.

In 2007, the Panthers Party led a huge procession of Jammu Migrants from Talwara Camp (Reasi) which was led by Ms. Anita Thakur (General Secretary), Mr. H.C. Jalmeria, Adv. (General Secretary) and Mr.P.K. Ganjoo (Sr. Journalist and Media Advisor of JKNPP). The police under the direction of the Chief Minister, Ghulam Nabi Azad acted with brutal hand, smashed the Panthers Party leaders, cracked their legs and heads and finally dumped them in police stations in Katra and Jammu. (The case against police brutality and suppression is pending before the Supreme Court of India).

A contempt petition was filed by the Panthers Party in the Supreme Court of India on the judgment delivered by Justice K.G. Balakrishnan, Justice Tarun Chatterjee & Justice D.K. Jain dated 13.07.2006 as this direction of the Surpeme Court was rejected by the power that be in J&K. The Supreme Court referred this contempt matter to the High Court of J&K directing the Chief Justice of J&K to take action as warranted by law.

Division Bench of Chief Justice of J&K, Justice Barin Ghosh and Justice Sunil Hali in their order dated 11.11.2009 directed, It goes without saying that in the event, upon verification, it transpires that the family on whose behalf such approach has been made to the Deputy Commissioner is entitled to relief in terms of the policy discussed above, the said family and the members thereof shall, in order to honour the judgment of the Hon’ble Supreme Court, be given relief to which they are entitled to.”   

In spite of all this the successive governments in J&K refused to pay a penny to the Jammu Migrants. The biggest tragedy on earth, which many may not believe, was that many starving migrant families sold their children to the outsiders who came from Mumbai and other cities. The believe that by selling one child they might be able to save the rest of the family. This is separate tragedy which Prof.Bhim Singh shall be writing in his coloumns. This time Prof.Bhim Singh is concentrating only extremes of administrative cruelty by the ruling clique in J&K who have been treating the innocent people like pigeons. The silence of the political leadership except Panthers Party cannot be forgiven. They shall be made answerable to the next generation someday.

Prof.Bhim Singh expressed deep appreciation to Shri H.C. Jalmeria, Advocate who continue the legal battle to ensure delivery of justice in the High Court. Prof.Bhim Singh also expressed thanks to the junior Jalmeria and Mr. Bansi Lal Sharma for their continuous affective assistance to Mr. Jalmeria who has been fighting since 2007 after he faced brutal attack from the J&K police during the bloody rule of Ghulam Nabi Azad of the Congress Party in J&K.

The State Legal Aid Committee shall be filing a fresh petition before the Supreme Court ensuring the return of all the children of the migrants which were sold under tense situation in the monsters’ rule.

NPP calls on the world thinkers to join hands for global peace & humanity

Addressing a huge gathering of youth and intellectuals of different parts of country (India) who had gathered at India’s Jantar Mantar identified with Hyde Park Corner in London, Prof.Bhim Singh, a human rights lawyer of international repute and political activist in India called on the Secretary-General of the United Nations to convene an urgent meeting of the representatives of the global NGOs, preferably in India, to work out a global strategy to defeat the menace of international terrorism and spineless violence to curb the seedlings of global violence so that the peace shall conquer over all forms of violence and hatred in the world.

            Prof.Bhim Singh who travelled around the world for five years on motorcycle on peace mission (1967-1973) under the banners of world peace council of Indian students called on the world leaders and members of the United Nations to join hands to promote global peace so that the seedlings of hatred and violence are destroyed particularly in the backward pockets of the world where violence has dominated the human race and peace stands threatened.

            Prof.Bhim Singh said that he has visited Iraq several times, made films on the contribution of the Iraqis in the field of science, sports and international friendship under the leadership of President Saddam Hussain. He accused the power hungry leadership in the western world under the control of USA and UK which has been responsible for spreading the seeds of hatred and igniting the flames to perish the human race.

            Prof.Bhim Singh called on all peace loving people of the world in the East and the West to condemn the highly heinous crimes like executing 250 girls in Iraq only a day back. Iraq was a great civilization, a holy seat of Karbala which transcends the great message of sacrifice for the truth and human justice has this most horrifying message to the world. The Arabs, Bhim Singh said, he knew personally who has spent nearly 10 years in the company of the Arabs from Baghdad to Morocco and Khartoum to Palestine and is convinced that Arabs belong to one of the greatest civilizations which has been fighting for peace and justice for centuries. The only tragedy they are contronting is the imposition of Zionist State of Israel since 1948. Prof.Bhim Singh said that these are the enemies of peace, humanity and global co-existence of humanity who have been killing peace by sacrificing the innocent children and people wherever they get a chance to challenge the humanity.

            Prof.Bhim Singh warned that the United Nations shall meet the same ends that the League of Nations in forties if the United Nations fails to discharge its compassionate duty towards peace and humanity. He also called on the great religion and religious heads in the world to hold an international meeting, preferably in India, to condemn the international brutalism and join hands to spread the global message for international peace and human welfare.

            Prof.Bhim Singh declared that he shall constitute a committee of 21-members from different parts of the world who shall work jointly for the promotion of humanism, peace and tolerance so that world shall survive longer.

PM Modi fails to deliver at Mata Vaishno Devi Shrine conclave in Katra

“It was all anti-climax at the end of PM Modi’s speech at the Mata Vaishno Devi Shrine University conclave this afternoon as Prime Minister Modi failed to mention a word about the PHE daily wagers numbering about 30,000, failed to address the sufferings and miserable plight of the hills of Mata Vaishno Devi now called as ‘baridars’ and have been literally turned as beggars in their own land. These baridars and their ancestors have been looking after the shrine for centuries without any benefit or gain.

          Several hundred Katra activists including their panches and sarpanches of Katra areas surrounding the university have been kept away under the threats of handcuffs by the police who have been protesting peacefully for their causes.”

          This was the reaction of Prof.Bhim Singh, Chief Patron of National Panthers Party from New Delhi camp office about PM Modi’s visit to Katra and his conquest of the peasantry and the Vaishno Devi owners who have been suffering for decades and demanding justice and equity.

          Prof.Bhim Singh wanted to know from Prime Minister Modi why he failed to mention the plight of the people who have been suffering at the hands of his half-a-partner with PDP in the state. Prime Minister could not mention a word about the suffering daily wagers in PHE, he could not mention a word about the miserable situation the masters of Vaishno Devi Shrine have been facing since their humiliating ouster. Prime Minister also could not address the open meeting and had to direct the security forces to prepare a security covered up hall in the Katra University  ground costing more than, as estimated, Rs.20 crores.

          Prof.Bhim Singh wanted to know from Modi about the plight of the labourers working on different projects for the shrine and for the service condition of the Shrine Board employees. He wanted to know the benefit of the latest hospital to the Katra division and the poor people. He also expressed surprise that Prime Minister could not open the Stadium by travelling about 500 meters ahead from the Shrine Board camp. He said that Prime Minister pressed the switch to open to perform the inauguration of the stadium. Was it due to the security risk?

          Prof.Bhim Singh expressed surprise that Prime Minister of India could not say a word to appeal the students of Baba Ghulam Shah Badshah University in Rajouri which was closed a few days back because of students unrest. The Prime Minister failed to say a word giving call to the students and youth in the Valley who have been staging demonstration against the state. Prof.Bhim Singh wondered whether Prime Minister Modi had any faint idea about the situation that has developed in different areas of J&K?

          Prof.Bhim Singh hoped that Prime Minister shall call an open meeting of the representative of all the recognized political parties in J&K including the representatives of the national parties functioning in J&K so that justice is done to all residents of J&K from all three regions. He said that Article 370 is a stumbling block in the way of integration of J&K with the rest of the country. He wondered why Prime Minister Modi is silent on this subject?

Prof.Bhim Singh, Chief Patron of National Panthers Party expressed heartfelt condolences on the sad and unfortunate demise of Mrs. Yaqooti Begum (85), mother of DPNPP General Secretary, Mr. Dildar Hussain Beg. Prof.Bhim Singh visited the graveyard near I.T.O., Delhi Gate and expressed heartfelt condolences to the bereaved family. He was accompanied by several Panthers Party leaders including Delhi Pradesh President, Rajiv Jolly Khosla.
