Governor Rule is only way out in J&K NPP Supremo urged President

Prof.Bhim Singh, Chief Patron of National Panthers Party urged Shri Pranab Mukherjee, the President of India for his immediate intervention in J&K to save the State from further death and destruction. He said that President is the only person in the Indian hierarchy who is competent under Article 370 read with Article 174 of the Constitution of India to dissolve the State Assembly to enable the electorates to elect fresh Assembly in the State to end the present political crisis which erupted due to unfortunate demise of the Chief Minister, Mufti Mohd. Sayeed. Prof.Bhim Singh has urged the President of India that the political crisis in J&K cannot be resolved as long as present State Assembly (87 members) is dissolved and fresh elections are held. He said that the artificial combination of PDP and BJP had sown poisonous seeds of conflict and distortion because of the combination of two parties having political agendas vertically opposed to each other. He said that National Conference leaders offered to join hands with BJP to form the government is equally dangerous and cannot provide a governance at all.

NPP Supremo urged the President of India to immediately amend provision in Article 370(3) of Constitution of India which provides, “That the recommendation of the Constituent Assembly of the State referred to in clause (2) shall be necessary before the President issues such a notification.”

Prof.Bhim Singh said that this provision was valid till 20th August, 1952, the day when the Monarchy (rule of Maharaja Hari Singh) was abolished by the Constituent Assembly headed by Sheikh Mohd. Abdullah. This provision has become infructuous and therefore the President has absolute power to declare that Article 370 shall cease to be operated with an immediate effect.

Prof.Bhim Singh also urged the President of India he may refer this question on law to the Supreme Court if he so desires. He said that this is very important, very urgent to ensure the National Integration which is being threatened by the forces enimical to the Union of India.

Prof.Bhim Singh said that the statement issued by former Chief Minister of J&K, Dr. Farooq Abdullah is sufficient proof that the Modi government is trying to exploit the present political situation which has emerged due to the absence of Mufti Mohd. Sayeed from the political scene of J&K.

Prof.Bhim Singh strongly pleaded that Article 370 had become infructuous on August 20, 1952 when Sheikh Mohd. Abdullah got Maharaja Hari Singh removed as the King of Kashmir with ulterior motive. Sheikh Abdullah’s arrest under the instructions of the then Prime Minister of India, Pt. Jawaharlal Nehru on August 8/9, 1953 is a living evidence that Pt. Jawaharlal Nehru had realized the blunder committed by the Constituent Assembly by inserting Article 370. Article 370 lost its nerves when this was litterally non-plussed in 1952.

Prof.Bhim Singh made a strong appeal to all the Members of the Parliament as well as the political parties which stand by the concept of National Integration to urge the President of India to declare Article 370 as void so that the Parliament of India is declared competent to deal with the constitutional matters vis-à-vis Jammu and Kashmir. The matters enumerated in List-I in the Schedule-VII (Constitution of India) should include all similar matters pertaining to the State of J&K. The matters in the Concurrent List may be kept under the command of the J&K Assembly.

Prof.Bhim Singh urged President of India to direct the Prime Minister of India to hold a meeting of all the political parties including the recognized political parties of J&K to seek their opinion in this regard. He also pleaded with a strong note that J&K should be reorganized so as to establish twin states, Jammu State and Kashmir Valley State so that both the states may have a separate government to run the affairs of the state mentioned in List-II, the State List. He said that both the states should have separate Chief Ministers but with one Governor and one High Court in the state. About Ladakh, the NPP Supremo pleaded that the people of Ladakh may be given choice to choose between a Union Territory status or either of the twin states; Jammu State or Kashmir Valley State.

Prof.Bhim Singh said that this proposition shall be placed before an August Parliament of People of the three regions of the state in the month of February to seek their approval and support. He concluded that dissolution of the Assembly is the only way out at present.
