NPP Supremo urges Governor to declare J&K election null and void, hold afresh poll

Prof.Bhim Singh, Chief Patron of National Panthers Party and an expert on Electoral Laws has urged Shri N.N. Vohra, the Governor of J&K to use his extraordinary power conferred on him by the Constitution of J&K to declare the recently held election for J&K Assembly as null and void and issue a fresh Ordinance hold Assembly elections afresh in the interest of democracy, rule of law and to keep the faith of the electorates intact in democracy.

Prof.Bhim Singh said that there are several reasons to dismiss the recent polls;

i).       That the election was neither fair nor free as it was rigged by reprogramming the EVMs bought from public sector manufacturing units in Hyderabad without tenders.

ii).      That the EVMs were purchased exclusively for their use in J&K from Hyderabad and taken to Gujarat for preparing them to be rigged by manipulation. This matter was brought to the notice of the CEC who admitted that these EVMs were purchased from Hyderabad and processed in Ahmedabad.

In his queries dated 20th August, 2014, Prof.Bhim Singh had raised pertinent questions;         

1).      Why Gujarat manufacturers have been chosen for this purpose and that too for J&K which has a history of rigging elections and manipulation of EVMs? 15000 EVMs are being utilized for nearly 10,000 polling stations. 5000 extra EVMs could be utilized to manipulate the entire election.

2).      Who are these manufacturers/exporters of EVMs from Gujarat to J&K?

3).      Are the services of these Gujarat manufacturers are being utilized in other states like Maharashtra, Haryana and other during the forthcoming Assembly elections?

4).      Were these particular Gujarat manufacturers of EVMs were chosen/selected by a unilateral decision without inviting tenders as has been the policy to avoid corrupt practice?

5).      What is the guarantee that Gujarat EVMs shall not be misused or manipulated to rig polls to accomplish the dream of the Prime Minister to secure 44 + Assembly seats in J&K, knowing well that J&K has no appeal to the voters?

6).      The BJP in the normal times could not secure even one Assembly seat in 1983 when the JKNPP managed to get one seat against all odds created by the Congress Party.

7).      The JKNPP is strongly opposed to the use of EVMs at least in J&K so that the confidence and faith of the voters is not lost and the people could be involved in the democratic process in the state.

8).      The JKNPP would like to lodge its protest against the use of Gujarat made EVMs which have added fuel to the fire in the state as the rumour are high that these EVMs have already been charged/ rigged in favour of BJP candidates.

9).      This is high time that EVMs are dismantled from the electoral process as has been done by the most of the countries in the world. The EVMs have been adjudged as faulty and manipulative so dangerous for the largest democracy of the world.

iii).     The Election Commission of India admitted the facts but kept silence on the issue of purchase of EVMs without tenders.

iv).     That the results in the election have shown enormous variation of votes favouring BJP in Jammu Pradesh where BJP managed 25 out of 37 seats.

v).     Prof.Bhim Singh in his communication with the J&K Governor said that the percentage of voting pattern as shown in most of the constituencies situated on hills and jungles is unbelievable and impossible. This has been brought to the notice of Election Commission of India.

vi).     Finally no party has peoples mandate to form a government in J&K. Besides no two parties have the mandate to form a coalition government. For example National Conference stands for Greater Autonomy and PDP self rule as both of these slogans stand for the implementation of Dixon Plan to create an Islamic Republic of Greater Kashmir. On the other hand BJP claims to be a nationalist which stands for one Constitution, one flag and full integration with Union of India. Any combination shall be disastrous for the principles of natural justice, rule of law and democracy.

Prof.Bhim Singh has urged the Governor to exercise his power he has in his authority as a Governor of J&K to declare entire poll process as null and void. Impose Governor Rule in the state and hold election afresh under the supervision of all party Parliamentary Committee so that free and fair elections could be held in the interest of democracy and rule of law.

Prof.Bhim Singh said that this is also necessary in view of the judgment of the Supreme Court in Subramanium Swamy’s case dated 08.10.2013 where the court has held that ‘paper trail’ was an indispensable requirement of free and fair election. This election in J&K was held in defiance of this judgment. The court had held, “From the materials placed by both the sides, we are satisfied that the ‘paper trail’ is an indispensable requirement of free and fair elections. The confidence of the voters in the EVMs can be achieved only with the introduction of the ‘paper trail’. EVMs with VVPAT system ensure the accuracy of the voting system. With an intent to have fullest transparency in the system and to restore the confidence of the voters, it is necessary to set up EVMs with VVPAT system because vote is nothing but an act of expression which has immense importance in democratic system.”

PM Modi mission 44 + failed, EVMs manipulation washed out JKNPP

“This was a most tragic incident in the history of J&K election that Prime Minister Modi succeeded in washing away most upright, secular and fearless opposition, JKNPP from the legislature of the state by manipulating the EVMs.” Commented Prof.Bhim Singh, the founder of JKNPP in the state.

Prof.Bhim Singh said that the BJP was terribly scared of the JKNPP leadership both inside and outside the Assembly which has been exposing the corrupt, communal and opportunist leadership of the BJP in J&K Assembly. The JKNPP Supremo had written a petition to the Chief Election Commissioner on the last evening demanding high power probe by an expert committee into the manipulation of votes where polling was recorded 80% or above. He said that polling could not reach that mark in the hills and mountains where half of the population is away into the working areas in Punjab or elsewhere. He accused the ruling party of Delhi, BJP, which was hell-bent to liquidate the Panthers Party from the floors of the legislature so that the BJP is not exposed of their corrupt, communal and opportunistic acts of omissions and commissions.

Prof.Bhim Singh said that he has constituted a team of five-Supreme Court lawyers to collect the facts and figures about rigging, manipulation of EVMs and its reprogramming by the BJP government at the Centre particularly in Jammu region so that the truth is out and the enemies of democracy are brought to justice at the earliest. He further pointed out a finger on the so-called victory of Mr. Davinder Rana (NC) from Nagrota (Jammu) Assembly constituency only because his brother Dr. Jitendra Singh was a Member of the EVM manipulation team in the PMO.

Prof.Bhim Singh said that Prime Minister Modi had chosen only Jammu Pradesh to reprogramme EVMs. Had he chosen Kashmir also the game plan would have been exposed in public. The manipulators chose an ex-BJP man from Udhampur contesting as an independent and NC candidate from Nagrota to create an impression that the election was free and fair. He counselled the party men to get prepared to save democracy and fight for reorganization of the state with Jammu Pradesh as a state free from the serfdom of the Kashmiri rulers and exploitation of Central political parties.“Nothing shall deter us from carrying of mission, reorganization”. Bhim Singh declared.

Prof.Bhim Singh accused Prime Minister Modi for the murder of democracy in Jammu Pradesh and declared that battle for the preservation of democracy in J&K shall start from the street to the Supreme Court.

J&K has witnessed rigging and fraud by the power that be in Delhi or in J&K since 1951 when Assembly elections were introduced. The rise of militancy was also the product of rigging in elections. Assembly elections in 1987 were rigged on the face of it by the Govt. headed by Dr. Farooq Abdullah. Most of the young boys who participated and lost because electoral fraud committed turned militants and took up the guns. J&K have to go without elections till 1996.

It is sad that the power that be never learnt a lesson from the blunders of the past and continued playing fraud with the electoral system. People of J&K remained deprived of free and fair polls.

The recent elections which were concluded on 20th December, 2014 have raised bundles of doubts about the credibility of the polls. The Election Commission has been informed regularly on the situation that was created because of PM’s unscheduled rallies leading to curfew like situation in the districts wherever his meetings were organized in the state. It was first chance in the history of J&K rather in the electoral history of the country that the Prime Minister organized nine election rallies in 2014 in J&K leading to chaos, disorder, political anarchy thus depriving all opposition parties to hold their respective rallies in the districts where Prime Minister addressed/organized his helicopter-borne rallies in utter violation of all the election rules, laws thus shredding all the norms in the Model Code of Conduct.

However, the Election Commission of India, had framed several rules for a re-check of the polling stations where poll percentage rises above 80% or abnormal. In several Assembly segments e.g. Bandipur, Sonawari (Kashmir), Udhampur, Bani (Kathua) and other places the polling percentage crossed 80. It is for the information of the Hon’ble CEC that half of the male population of the area go out of their homes to Punjab or Uttar Pradesh for work during the winter. Same is the case with Bani and Basohli constituencies in Kathua District.

The functioning of EVMs has always remained under question. Manipulation of EVMs and programming it to the convenience of the interested parties having absolute control over the machine and its physical handling suggest that it is only because of this reason that poll has been recorded over 80%. On the other hand Jammu City has three constituencies and the polling did not exceed 66%. Rather there was 60% poll in Gandhinagar (Jammu City) Assembly constituency where the road communication is 100% perfect as compared to Sonawari or Bani. Bani Assembly segment is on the top of hills. The voters in several stations have to walk for miles to cast their votes. Same is the situation in Billawar, Basohli (Kathua) and Bandipur (Kashmir).

My election in a bye-election to the Lok Sabha in 1988 experienced the same catastrophe when I won in 13 Assembly segments and was made to loose in two Assembly segments where polling was shown 90% or above. My election petition was allowed yet I could not enter the Parliament because that particular (10th) Lok Sabha stood dissolved by the date the judgment was delivered by Mr. Justice K.K. Gupta of J&K High Court.

In several countries of the world, they have discarded use of EVMs in sensitive polls. The use of EVMs has discredited the parliamentary democracy particularly when the ruling class is a party to the polls.

May I urge the Hon’ble Election Commission of India to set up an expert committee to probe the polling trends in the constituencies where the poll was 80% or above. It shall be a great contribution by the Election Commission of India to save faith of the people in democracy in J&K.

500 Congress activists join NPP Secular & democratic forces invited to join Ultimate Revolution

More than 500 Congress activists including Subhash Chandra Boss, Mahi Chauhan, Harsha, Asma, Sonia Chaudhary, Abdul Razak, Reshma, Shyam Sunder Sharma, Kali Ram Tomar, Deepanshu, Ramnath, Mohd. Shafi and others were welcomed at the headquarters of NPP. Prof.Bhim Singh, founder of the party garlanded several activists, men, women, youth and prominent leaders from the minority group in New Delhi this afternoon. Prof.Bhim Singh welcomed every new entrant with garlands and flowers. He also declared Mr. Subhash Chandra Boss as General Secretary of Delhi Pradesh Panthers Party.  Delhi Pradesh Panthers Party President, Mr. Rajiv Jolly Khosla presided over the joining ceremony.

subhashchandra3Mr. Subhash Chandra Boss, a prominent Congress leader declared that he has resigned from the Congress party after his valuable 40 years in Congress and joined Panthers Party under the leadership of Prof.Bhim Singh only because this is only party in the country which stands for Haq-Insaaf for all and is committed to secularism. He said that he and his colleagues were convinced that it is only the Panthers Party leadership which can lead the Ultimate Revolution in the country against corruption, communalism, criminalization and authoritarianism which have become the order of the day.

He said that the Panthers Party is the only hope for the future of minorities, Dalits and the weaker sections of the society.

Bhim Singh bravos Jammu journalists, accuses Prime Minister Modi for manipulating EVMs

Prof. Bhim Singh, Chief Patron of National Panthers Party congratulated the journalists and media persons in Jammu for their fearless reporting elections news in spite of some newspapers adopting ‘money for news’ ethics during the polls.

Prof. Bhim Singh accused Prime Minister, Shri Narendra Modi for the misuse of his position and encouraging corrupt practice in the polls to benefit himself.  He said more than Rs.50 crores were spent by the state exchequer to facilitate PM’s election campaign in Jammu and Kashmir. He also wondered the kind of democracy Mr. Modi is promoting in India as he has promoted only himself and his persons and the cost of BJP which stands completely diluted during his elections campaign. He has reminded his own party leaders the way Hitler promoted himself at the cost of his own party.

Prime Minister Modi has committed another blunder by adopting the undesirable and anti-national elements as his candidates in the Valley and gave them mandate to contest elections from BJP in the Valley.

Prof. Bhim Singh prophesied that the money and muscle power and join patronage of Prime Minister Modi shall bring a disaster for the largest democracy in the world. He questioned the credibility of Election Commission of India and its independent functioning to conduct polls in J&K and elsewhere the way it suited the business class and their agents. He said that if this trend is not reversed immediately, the vestige of democracy can be destroyed as it happened in many countries of the world.  It shall result into anarchy and bloody revolution against the capitalist and the criminal class which has almost taken over the Parliament.

Prof. Bhim Singh expressed no surprise on PDP Chief’s bundles of praises for Prime Minister Modi which leaves no doubt about the hidden agenda of Modi and Mufti in J&K.  Mr. Mufti may be the first and last Chief Minister in J&K to form his government with RSS in the State. He laughed at the demonstration of heaps of opportunists including businessmen, bureaucrats, black money holders joining Mufti camp to share the benefits of power.

Prof. Bhim Singh asked Prime Minister Modi to answer the question which he has raised in Kashmir Valley by putting a separate map of J&K sans rest of the country by promising this as his mission 44+. What does Prime Minister Modi means by his missions sans map of the Mother Land?  He said that amendment in Article 370 and reorganization of the State are the urgent needs to protect and preserve national integrity, unity and sovereignty which is the principled mission of Panthers Party. The EVMs is threat to parliamentary democracy and needs to be replaced without any delay.
