BJP, Congress & Kashmir centric parties stand exposed on Panthers Party bill on secularism

This was highly tragic and unfortunate that the ruling party in India namely BJP did not support the Panthers Party MLA’s bill in J&K Assembly last evening to include ‘secularism’ in the preamble of J&K Constitution. The Congress and the Kashmir centric political parties like PDP and National Conference also opposed the inclusion of ‘secularism’ in the preamble of the J&K Constitution. The bill was moved by the Panthers Party MLA and former Education Minister Shri Harsh Dev Singh, Chairman of JKNPP. The bill was supported only by the Panthers Party MLAs namely Shri Balwant Singh Mankotia and Shri Yashpal Kundal whereas 11 BJP MLAs were seen hiding their faces in their sleeves whereas the Congress, National Conference and PDP MLAs stood against the inclusion of word secularism in J&K.

          When the mover of the bill, Shri Harsh Dev Singh, MLA and Chairman of JKNPP stood in support of bill advocating vociferously that J&K is integral part of India which has even been constitutionally incorporated in Section 3 of the J&K Constitution, the word secularism and socialism has to be included in the preamble of the State Constitution. He argued that J&K has been a secular state. It is integral part of India, a secular country and therefore word secularism cannot be omitted in the State Constitution. He argued that without the words ‘secularism’ and ‘socialism’ the State Constitution has no constitutional mandate and therefore it has lost its legality.

          Only three MLAs of the Panthers Party carried the flag of secularism onto the well of the floor of the House and exposed the opponents of secularism.

          Prof.Bhim Singh, former three times legislator, a constitutional expert and Sr. Advocate of the Supreme Court urged Shri N.N. Vohra, the Governor of J&K to invoke Section 92 of the J&K Constitution as the present government is working out of the scope and meaning of the Constitution. When they (ruling parties) failed to accept world secularism which is soul of democracy in India, they are working out of the parameters of the Constitution, hence there is constitutional obligation on the Governor to dissolve the Assembly and dismiss the government of J&K.

          Prof.Bhim Singh also reminded the people of J&K who voted heavily for the BJP in the recent Lok Sabha election to mark this point that both the BJP as well as National Conference plus PDP are deadly against secular Constitution. The nexus between ruling BJP in the Centre and ruling National Conference and Congress in J&K stands totally exposed.

          Prof.Bhim Singh congratulated the four musketeers (four NPP legislators), three MLAs and one MLC for demonstrating their total commitment to the cause of nationalism, secularism and democracy through their continuous efforts to raise public causes inside the legislature. This is the right time for the people of three regions to understand who deserve public support in the coming Assembly election.  


J&K Legislature has no jurisdiction to discuss international relations or defence matters

Prof.Bhim Singh, Chief Patron of National Panthers Party and Member of National Integration Council has challenged the legality and competence of the Legislative Council/Assembly to entertain any matter for any discussion connected with the External Affairs, Defence or International Borders. Prof.Bhim Singh said that State of J&K even under Article 370 has no authority to interfere with any subject mentioned in List-I (Union List) of Seventh Schedule. He said that Army is covered under Item-2 of the Union List whereas Foreign Affairs are covered under Item-10. Item-9 clearly states that all matters relating to Defence, Foreign Affairs or the security of India are the subjects which can only be discussed or interfered with by the Parliament. The State Legislature is no competent to discuss any matter and entertain any resolution relating to any matter connected with International Borders or Defence.

Prof.Bhim Singh said that a so-called private resolution introduced today (27th August, 2014) and projected by a National Conference (ruling) MLC in the Legislative Council is not only obnoxious, illegal or unconstitutional but amounts to direct interference with the boundaries and jurisdiction of the Parliament. Hence it amounts to treason and therefore must be condemned by all nationalists. Neither the Chairman of the Council nor the Speaker of the Legislative Assembly has any competence to entertain such a resolution from any Member whatsoever.

NPP announces first list of 10 candidates from Kashmir Valley, Congress accused invoking BJP ‘Hindutva’

Addressing a Press Conference in Srinagar (Kashmir), Prof.Bhim Singh, Chief Patron of National Panthers Party & Member of National Integration Council today accused Congress for invoking BJP Hindutva to create communal divide in the conflict-torn state of J&K.

He said that J&K Congress leaders out of sheer frustration and panic have started blowing horns on ‘Hindutva’ in J&K demanding a Hindu Chief Minister in the state. The J&K Congress leaders as well as BJP have been exploiting the electorates in Jammu Pradesh under one pretext or the other. A Congress leader from Jammu has started advocating for a Hindu Chief Minister in J&K with an attempt to woo the majority in Jammu Pradesh for the coming Assembly polls. The Congress has started new stunt after their complete rout in the Lok Sabha polls in Jammu Pradesh. The BJP has been exploiting the Jammu electorates on the same slogan for years. On the other hand the Kashmir Valley based political parties have been abetting the BJP to create communal divide in Jammu Pradesh so that the Kashmir based parties shall reap the harvest in Kashmir Valley. This happened during the 2008 polls when a Congress Chief Minister created a ruckus in Jammu by acquiring the land of Shri Amarnath Shrine Board. Now they have again invoked the communal slogan patronized by BJP Prime Minister, Narendra Modi. Realizing the race is tough and Congress ship sinking, it has given new a slogan of a Hindu Chief Minister.

Prof.Bhim Singh reminded the people of the country that National Conference leader Dr. Farooq Abdullah in 2002 had declared support to Prof.Bhim Singh as the next Chief Minister. NC was having 31 seats in the Assembly. It was the Congress which opposed Prof.Bhim Singh’s name and joined Mufti Mohd. Sayeed to keep Prof.Bhim Singh out of the race. He said that Congress is trying to fool the people in the name of Hindutva which amounts to an attack on the composite culture of the state.

Prof.Bhim Singh also announced first list of 10 candidates from the Kashmir Valley. The candidates included the sitting MLC and President Young Panthers, Syed Mohd. Rafiq Shah from Kupwara. The list is as under:-

In the meanwhile, Syed Mohd. Rafiq Shah, MLC, President Young Panthers announced the name of Mr. Adil Mustafa Khan as State Secretary of the Young Panthers Committee.



DM Udhampur threatens peace NPP demands legal action against DM

Prof.Bhim Singh, Chief Patron of National Panthers Party & Member of National Integration Council has communicated to Shri N.N.Vohra, Governor of J&K on the draconian, unconstitutional and mala fide notification issued by the District Magistrate Udhampur commanding to ban all peaceful protests, demonstrations, raising slogans in support of the demands of the public or raising any voice in the district which is absolutely unconstitutional and dictatorial.

Prof.Bhim Singh in his communication to the Governor has demanded immediate legal action against the DM, Udhampur for having resorted to such a notification as no one, even the President of India dare sign such a notification which puts blanket ban on the public to protest/demonstrate or hold public rallies on the ‘public roads’ (not knowing that every road is a public road).

The NPP Supremo who is also Sr. Executive Member of the Supreme Court Bar Association and a known civil rights activist has described this notification as illegal, improper, unconstitutional and an assault on the civil liberties amounting to the infringement of all fundamental rights enshrined in Chapter-III of the Indian Constitution. The notification commands;

Keeping in view the foregoing facts, public of District Udhampur is hereby informed through the medium of this notice that no one shall resort to protest/demonstrations/unlawful assemblies on public roads (lifelines) leading to any blockades. The instigators, perpetrators, violators, abettors of crime, inducers, provocateurs and any habitual offender shall be dealt stringently under law of the land without giving any further notice.”         

Prof.Bhim Singh announced that this authoritarian ‘Public Notice’ shall be challenged in the court of law seeking appropriate remedy and a criminal action against the District Magistrate who has exceeded the limits of her powers as a District Magistrate.


Protests, demonstrations/roads blockades, a public nuisance and cognizable offence punishable under law–Public service delivery.


            It is hereby notified for the awareness/information of the residents/people working in the territorial jurisdiction of District Udhampur in particular and the Law and Order implementing authorities/public service authorities in general that:-

            It has been witnessed may a times that people resort to protests, demonstrations for raising their voice against petty issues and subsequent blockade of public utility highways and other roads (lifelines).

            It has also been observed that people resort to protests, demonstrations outside the public offices thereby crippling the working of the offices which leads to mal-functioning and hampering of public service delivery.

            The roads and the public offices are life lines of public service delivery mechanism and blockade of roads leads to inconvenience, harassment and wastage of precious time, economic & human resources. Moreover, this endangers the Public Safety. As also the irreparable loss of studies to the students and delay/non-providing of emergent healthcare to the ailing patients suffering due to traffic jams. It has causes rail travelers to suffer for want of reaching their respective boarding destinations who many a times miss the train services.

            It has also been observed and notified for the information for the general public that while officers go to meet the public sitting on protests/demonstrations; “the exerting of pressure on officers for conceding to the unreasonable demands of the protestors also amounts to threatening/inducement to the public servant” which is unlawful and a cognizable offence punishable under law. Penal Code 1989 (RPC) and Jammu & Kashmir Public Safety Act, 1978 (PSA). It is further informed that being a member of such protests/demonstrations and unlawful assemblies is also a crime punishable under law.

            It has also been observed that students of educational institutions are also being instigated and involved in demonstrations by vested interests. This is totally illegal and will not be allowed at any rate. The heads of the educational institutions are hereby directed not to allow the students to participate in such activities and focus on the studies and co-curricular activities. In case any illegal activities are allowed to continue, the head of the concerned educational institutions shall be personally liable for penal action as provided by law.

            It is also notified that violent mob leads to destruction of public and private properties which both are cognizable offences punishable under prevention of Defacement of Public Property Act and the Jammu & Kashmir Prevention of Defacement of Property Act, 1985 and other laws.

            It is further informed that such unlawful assemblies and want only giving provocative slogans with intent to cause riot is a serious crime punishable under law.

            However, for public authorities dealing with the public services especially the officers/officials of PDD.

            PWD, PHE & IFC, Health Depts, Municipal Committees, Revenue, RDD, CA&PD, Agriculture Dept, Forest Dept, and others, it is hereby, informed that the issues/complaints/representations/grievances be tackled/redressed promptly ensuring that no cause is given to the public to agitate and resort to unlawful obstructions. The controlling officers shall ensure the strengthening of communication network for speedy information gathering and redressal of grievances. The effective coordination between various agencies is obligatory to avoid any confusion.

            It is hereby informed that to maintain public order, peace and tranquility in the district and to protect the rights and liberty of the citizens, it is imperative on part of citizens and the administration, to ensure providing of hassle free and conducive environment for public service delivery which mandates keeping the life lines (all roads) of District Udhampur open/accessible at all const; The concern of the Government on the issues has already been conveyed to the public through public meeting by the Civil Administration and the Police.

            Keeping in view the foregoing facts, public of District Udhampur is hereby informed through the medium of this notice that no one shall resort to protest/demonstrations/unlawful assemblies on public roads (lifelines) leading to any blockades. The instigators, perpetrators, violators, abettors of crime, inducers, provocateurs and any habitual offender shall be dealt stringently under law of the land without giving any further notice. However, the right of citizens to the public services and its demands/getting delivery through democratic and lawful recourses, representing/complaining before the public authority shall always be protected, and appreciated.
