NPP Supremo & Sr. Executive Member-SCBA For full solidarity with CJI on Subramaniam episode

Prof.Bhim Singh, Sr. Executive Member of the Supreme Court Bar Association & Chairman of the Sub-Committee on Foreign Affairs/Seminars/ Cultural Affairs has expressed full solidarity with the disclosures made by Shri R.M. Lodha, Chief Justice of India expressing his disapproval of the NDA government to unilaterally remove the name of Mr. Gopal Subramaniam from the Panel of four names recommended for the appointment of judges of the Supreme Court by the collegium headed by the Chief Justice. Prof.Bhim Singh who is also Member of National Integration Council (chaired by the Prime Minister) hailed the concern expressed by the Chief Justice of the Apex Court to convey the message straight to the power that be that no interference of the Executive shall be permitted to keep the independence of the judiciary intact.

Prof.Bhim Singh said that the governments have been trying to interfere with the independence of the judiciary from time to time. It was unfortunate, he said, that the government (Union of India) could not be told so straight and in clear words as has been done by Mr. Justice R.M. Lodha, the Chief Justice of India.

Prof.Bhim Singh said that some of the Union Law Ministers had been exposed earlier for trying to interfere with the independent functioning of the judiciary. He said that there are instances where the Union government has been trying to play hide and seek in the Supreme Court while dealing with sensitive matters. He said several cases have been delayed because of the hide and seek policy of the Central government which may come to light at appropriate time.

Prof.Bhim Singh suggested that the entire Panel recommended by the collegium should have been sent back for reconsideration instead of picking and choosing just one individual who did not suit the present NDA government. Prof.Bhim Singh said that the lawyers’ fraternity feels proud of the wisdom and courage that Shri R.M. Lodha demonstrated publicly while addressing the Supreme Court lawyers and judges on the occasion of giving farewell to Mr. Justice B.S. Chauhan on the day of his retirement after superb innings.
