Supreme Court reserves judgment on Gool killings & Kishtwar riots

A Division Bench of Supreme Court of India headed by Chief Justice, Mr. P. Sathasivam today reserved the judgment on a petition filed by Sudesh Dogra of National Panthers Party seeking independent probe, compensation to the families of the victims and loss of property. The other judges who were sitting with the Chief Justice were Mr. Rajan Gogoi and Mr. N.V. Ramana. The Supreme Court reserved the judgment after hearing Prof. Bhim Singh, Sr. Advocate and Mr. Luthra, Sr. Advocate, Additional Solicitor of Union of India who argued on behalf of Omar Abdullah’s government of J&K.

Prof. Bhim Singh in his forceful arguments sought independent inquiry by outside agency into the human massacre in Gool on 18th July, 2013 and death of three innocent persons besides loss of property worth crores of rupees in Kishtwar on 9th August, 2013. He strongly abused the process of law by the State government on disparity in relief (ex-gratia) to the serving personnel of security service which he said is violation of Articles 14, 21 etc. He said Rs. 5 lacs ex-gratia relief to the local security personnel is very small but it is highly disgraceful that non-resident security personnel on his death is paid only Rs.2 lacs. The Chief Secretary of J&K in his affidavit has defended this disparity and discrimination on the basis that J&K. The Chief Secretary claim that J&K Govt. has a special status to make any law for any person and Articles 14, 21 or Chapter-III was not applicable to J&K.

Prof. Bhim Singh in his arguments strongly rebutted the stand taken by J&K Govt. and submitted that Article 370 had become in fructuous after the termination of Monarchy on 20th August, 1952 when the J&K Constituent Assembly headed by Sheikh Mohd. Abdullah passed a resolution declaring termination of Monarchy. Prof. Bhim Singh contended that Article 370 was inserted in the Indian Constitution in 1950 as a temporary and transitional provision as monarchy was continued in J&K by the Constituent Assembly of India which was a grave blunder though. He read out the temporary provisions of Article 370 which said that President of India had power to make any changes in the provisions of Article 370 or otherwise in concurrence with the government of J&K appointed by the Maharaja of J&K on 5th March, 1948. It said that Maharaja Hari Singh was recognized as a Maharaja of J&K by the Constituent Assembly i.e. by the President of India. He strongly contended in his forceful arguments that Article 370 was meant to contain the power of Maharaja Hari Singh as a Monarch which is obvious from the contents of Article 370. He said once Maharaja’s authority was terminated in 1952 Article 370 became in fructuous. He said that Sheikh Abdullah was no more in power after 1953 even. Neither the Monarch nor the government he appointed was in existence after 1952 and 1953 respectively which is another ground for the court to declare Article 370 as irrelevant. Prof.Bhim Singh while addressing the court said, “My Lords, wisdom lies in daring.” and this is the time that this court takes a decision in the interest of unity, integrity and sovereignty of the Union of India so that there shall be no more discrimination with the people of J&K which was the sole reason for unrest, violence and anarchy in the state.  While arguing on Article 35A, he said it has no relevance with regard to the payment ex-gratia, relief to the ‘Martyrs’ in the ‘war’ and Article 35A is only a tale of Article 370 which was inserted only to bluff the people of J&K by the Parliament.

Going further there is no more concept of ‘State Subject’ in the state after the ‘J&K’ Constitution was promulgated on 25th January, 1957 which has in its Section 3 given a clear mandate that, “J&K is and shall remain integral part of India” and fresh phase has been substituted as, ‘Permanent Resident’ for ‘State Subject’.

He described the payment of compensation to 76% as a fraud on Constitution by fixing upper limit of Rs.5 lacs for those who suffered the loss in property in crores and urged the court for its intervention so that the each sufferer gets justice.

Prof.Bhim Singh described the appointment of retired judge of the High Court as one man commission to probe into the circumstances that led to killing of three innocent persons in Kishtwar on 9th August, 2013. He said that interim report has been submitted as claimed by the State before the court in an affidavit. He said that interim report is missing from the record. He further developed that inquiry commission was appointed only to give a clean chit to the local MLA and Minister, Home as he was removed from the job following the riots in Kishtwar. After the interim report he told the court that the Minister was reinstated and declared as innocent by the Commission least caring for the loss of lives and property. He submitted an affidavit filed by the petitioner which is relevant in this regard. He pleaded for compensation as per loss of the property to each sufferer and punishment to every culprit who try to destroy centuries’ old communal harmony and brotherhood in Kishtwar. He further demanded payment of Rs.50 lacs to the families of those who were killed in Gool or in Kishtwar because of the utter failure of the local administration. He urged the court to hold investigation by an independent agency when there is a serious allegation of the involvement of a Minister/high-ups. He urged the court to monitor the investigation in the interest of justice and rule of law so that people of J&K may also get an opportunity to share the fruits of freedom which is enjoyed by every Indian citizen except in J&K.

 

 

NPP Supremo appeals all sections of society & political activists to support Panthers Party in Lok Sabha polls

Prof. Bhim Singh, Chief Patron of National Panthers Party & Member of National Integration Council while addressing a press conference in Press Club, Jammu made a compassionate appeal to all sections of the society irrespective of their political affiliation or schools of thought to unite and support the Panthers Party in the Lok Sabha polls so that J&K shall fully integrate with the rest of the country.
Prof.Bhim Singh appealed the students, youth, working class, government employees, journalists, ex-servicemen, the women organizations and all to join the battle of Mahabharata which shall start on 10th April and end on 7th May, 2014. He said that Krishna accomplished his task of Mahabharata in 17 days that this mini Bharata shall continue for 27 days in the guise of Lok Sabha election.
Prof. Bhim Singh rebutted the stand taken by the Chief Minister on the floors of Assembly that integration of J&K with the rest of the country was incomplete. He said that it is National Conference and its leaders who have been exploiting the innocent Kashmiri youth and responsible for the death and destruction in J&K for 20 years.
Prof.Bhim Singh disclosed that Panthers Party shall contest both the Parliamentary Constituencies in Jammu Pradesh. He was chosen by the party for Udhampur Parliamentary Constituency six months back whereas Jammu-Poonch Constituency shall have a new a candidate.
Prof.Bhim Singh declared that he shall with the support of 400 MPs in the Lok Sabha shall ensure that Article 370 is amended though it became in fructuous in 1952 when Constituent Assembly under the leadership of Sheikh Abdullah terminated the Monarchy in J&K by a single line resolution. He said that he had convinced Shri Atal Bihari Vajpayee to amend Article 370 so as to empower Parliament to legislate in respect of J&K. He said that J&K stands fully integrated which has been defined in Section 3 of the Constitution of J&K which says that J&K is and shall be integral part of India.
Prof.Bhim Singh appealed the people of J&K to support the agenda of Panthers Party for reorganization of the State so that all the three regions shall get equity and justice without discrimination.

NPP invites applications of Lok Sabha candidates–2014

Prof. Bhim Singh, Chief Patron of National Panthers Party & Member of National Integration Council in consultation of the Working Committee of J&K National Panthers Party has invited the candidates for 16th Lok Sabha election from all the states of the country. Prof. Bhim Singh said that the preference shall be given to the youth, students, journalists, lawyers and other such youthful candidates who are committed to promote and preserve composite culture and strengthen communal harmony.

Prof. Bhim Singh has already been nominated from Udhampur Parliamentary Constituency in J&K. The other candidates from other constituencies in J&K shall be announced after couple of days. Syed Mohd. Rafiq Shah, MLC shall be contesting from Baramullah Parliamentary Constituency in J&K.
