SC directs J&K Chief Secretary to file fresh affidavit

Division Bench of Supreme Court of India headed by Chief Justice Mr. P. Sathasivam, comprising of JJ Mrs. Ranjana Prakash Desai and Mr. Ranjan Gogoi directed the Chief Secretary of J&K to file a fresh affidavit to explain the issues raised by the petitioner in the Kishtwar riots case dated 09.08.2013.
Prof. Bhim Singh, Sr. Advocate, appearing for J&K National Panthers Party raised a serious objection on defining the citizens of India residing in J&K as ‘State Subjects’ and those serving personnel from outside the state as ‘non-state subjects’. The Chief Secretary in his affidavit has cited Order of J&K Govt. No. 723-GAD of 1990 dated 10.07.1990. In this order the Govt. of J&K has sanctioned Rs.5 lacs for the killed paramilitary personnel if they are ‘State Subject’ whereas in the same order the Govt. has laid the rules that Rs.2 lacs will be given to the dead, killed by terrorists if the dead is ‘Non-State Subject’. Prof. Bhim Singh in his strong objection submitted in the court that he (Bhim Singh) is not a ‘State Subject’ (State Subject) but a citizen of India and so are all citizens of J&K, he submitted. He said that the Govt. of J&K has questioned the State-Centre relations and even committed contempt of the Constitution by describing the permanent residents of J&K as ‘State Subject’. Besides, he submitted that this was a dire discrimination with the citizens of India. He strongly appealed to the court to take a serious note of this apathy on the part of the Govt. of J&K which is a product of Constitution of India. Prof. Bhim Singh also questioned the appointment of SIT (Special Investigation Team) headed by a local SP (Superintendent of Police) in Kishtwar. He submitted before the court that several high-ups and ministers are involved in the rioting on 9th August, 2013. How a junior officer could question the sitting ministers and his senior officers who have been named by the public as the abettors to the riots. He strongly argued that the investigation of the case should be handed over to the CBI or a senior police official of the rank of Additional DG Police. When the lawyers of the J&K Govt. failed to answer these questions, the Supreme Court directed the Chief Secretary of J&K to file a fresh affidavit within two weeks to explain the objection raised.
The Supreme Court also told Prof. Bhim Singh that the judicial inquiry Presiding Officer, as appointed by the Govt. of J&K shall also look after the loss of property during the riots in Kishtwar. The Panthers Party in its rejoinder has deposed that 107 persons/families have lost their properties with crores. He has also filed a list of 92 police constables and head constables who have been indiscriminately transferred or thrown out of Kishtwar District without any enquiry or the reason or explanation.  The case will be listed on 9th September, 2013.

Omar Abdullah facilitating movement of terrorists from & to Pakistan

In a letter addressed to the J&K Governor, Shri N.N. Vohra, Prof. Bhim Singh has urged the Governor to dismiss the Chief Minister, Omar Abdullah from his office as the CM has become a security risk on several accounts. The recent development has revealed that Mr. Omar Abdullah had allowed Pakistani nationals involved in terrorist activities in J&K to enter the State via Nepal and indulged in activities which are highly prejudicial to the security of the State. He has quoted the latest development that Mr. Omar Abdullah allowed several Pakistani nationals designated as ‘surrendered militants’ to enter the Indian Territory via Nepal in violation of International Laws and the Rules under the pretext of the so-called ‘Surrender & Rehabilitation Policy’. This policy also didn’t allow any Pak-national to enter India via Nepal. The Chief Minister had admitted on the floors of the State Assembly that 243 Pak-nationals had entered J&K who crossed over to Nepal from Pakistan. Mr. Omar Abdullah had deployed J&K Police on the Indo-Nepal borders to facilitate the entry of the terrorists coming from Pakistan to Nepal.
A national newspaper namely, ‘The Indian Express’ has revealed in its front page story that “At least three surrendered militants who returned to the Valley last year via Nepal have gone back to Pakistan by the same route over the past one month.”
NPP Supremo in his letter to the J&K Governor has pointed out that the terrorists deployed by ISI have been working to restore their lost contacts with the militants in J&K. The so-called ‘Surrender & Rehabilitation Policy’ has been challenged by the Panthers Party in the Supreme Court as well.
The latest development vis-à-vis the so-called ‘Surrender & Rehabilitation Policy’ is being used by the ISI to implement its agenda of sabotage and violence in the Valley. This is not only surprising but highly intriguing that the entire State even peaceful places like Gool and Kishtwar have been inflamed in communal divide by the J&K Government headed by Mr. Omar Abdullah.
The NPP Chief Patron has demanded dismissal of Omar Govt. and imposition of Governor Rule for a short period to regroup the demoralized administration and activate the nationalist and secular forces in the State.

Panthers activists observe 105th Birth Anniversary of Martyr Rajguru

Several activists of Delhi Pradesh National Panthers Party along with members of the civil society and Bhim Brigade observed 105th Birth Anniversary of one of the greatest martyrs who sacrificed their young lives for the freedom of the country and liberty of her people which the people of the Indian Sub-continent have been enjoying for the past 63 years.
The Panthers Party in its meeting held at Jantar Mantar, New Delhi in its resolution demanded that the greatest martyrs namely, S. Bhagat Singh, Rajguru and Sukhdev may be classified in the annuls of the history of the freedom movement as martyrs. The Panthers Party expressed shock that S. Bhagat Singh and his associates who sacrificed for the freedom of the country have not been recorded as martyrs which included Rajguru and Sukhdev.
Prof. Bhim Singh, Chief Patron of National Panthers Party also administered an oath to the Panthers Party activists that,
“We the people of India from Kashmir to Kanyakumari and Dwarka to Nagaland pledge to uphold the unity, integrity and sovereignty of India. We shall together fight to demolish the roots of corruption, communalism, criminalization and drug menace from our society. We shall work for communal harmony which is a soul of democracy and a road towards development and prosperity of the nation.”

Press Release SC to hear Kishtwar petition on 26th Aug. JKNPP to file Rejoinder to J&K Govt. affidavit

A Division Bench of Supreme Court of India presided over by the Chief Justice of India, Justice P. Sathasivam today expressed the hope that the Govt. of J&K shall attend the local problems of the residents of Kishtwar who have been under siege of curfew for the past 12 years following the unfortunate riots in the town on 9th August, 2013. The Supreme Court division bench comprising of JJ Mrs.Ranjana Prakash Desai and Mr.Ranjan Gogoi headed by the Chief Justice of India fixed the hearing in the Crl.Misc. Petition on 26th August, 2013.
Prof. Bhim Singh, Sr. Advocate submitted that the affidavit filed by the Chief Secretary of the Govt. of J&K has mentioned no details as was the direction of the Supreme Court. He also submitted that no concrete step has been taken except carrying the sermons and assurances to hold inquiry and investigation. He said that the affidavit filed by the Chief Secretary has not mentioned even the FIRs filed in connection with the killings of three persons nor even the names of the persons killed. He also submitted that there is no food and other essential commodities available to the curfew siege residents of Kishtwar town nor medical facilities. The Chief Justice pointed towards Mr. Gaurav Pachnanda, Sr. Advocate for the State of J&K asking him to convey this concern to the Govt. of J&K.
The Court allowed Prof. Bhim Singh to file a rejoinder to the affidavit of the Chief Secretary within three days.
The reports coming from Kishtwar are horrifying as 92 policemen serving in the lower rung have been transferred in discriminatory without assigning any cause or reason. Even the transfers of the Kishtwar DM and SSP immediately after the disturbance have been done without any reason or cause. There is a tremendous demand to hold inquiry into the entire episode by CBI.

Dismiss Omar Abdullah to save J&K from Chaos & Anarchy

Prof. Bhim Singh, Chief Patron of National Panthers Party has urged Mr. N.N. Vohra, the Governor of J&K to exercise his subjective satisfaction about the total failure of coalition government headed by tweeting Chief Minister, Omar Abdullah by invoking Section 92 of the J&K Constitution. This is evident he said that Mr. Omar Abdullah has failed on all fronts and corners to handle administration and law and order in the State. The NPP Supremo questioned about Omar Abdullah’s ability and capacity to win the confidence of the people e.g. in Kishtwar. He was dispatching his outdated, corruption ridden and unwanted ministers to visit the spots which were burning because of the apathy of his administration. He did not visit even Ramban or Gool when several villagers were killed. He failed to visit Kishtwar when entire Kishtwar was demolished by furiated mob on the Eid Day. He has been sending his emissaries and ministers to pacify the agitating public. He has no time to separate himself from his computers, facebook or twitters.

Prof. Bhim Singh has pleaded last week with the Prime Minister of India, Dr. Manmohan Singh that Governor Rule in J&K was only way out to save the state from further death and destruction which has become the rule of law since Omar Abdullah was ‘crowned’ as Chief Minister of the unfortunate people of the state.

Prof. Bhim Singh appealed to the people of J&K, particularly the youth and the students to go for ‘social boycott’ of the legislators of the ruling National Conference and Congress as a reminder about their failures and the commissions and the omissions they have been committing to disturb the social and communal harmony of the state.

Prof. Bhim Singh also appealed to all secular, democratic and nationalist political parties and social groups as well as individuals to stand together to save communal harmony in the state and defeat the forces of corruption, communalism and opportunism.
