SC notice to UOI, J&K on Ramban firing & security of Amarnath pilgrims

Division Bench of the Supreme Court of India comprising Chief Justice of India, Mr. P. Sathasivam & Ms. Justice Ranjana Prakash Desai today issued two weeks notice to the Union Home Ministry, Govt. of J&K, Director General of J&K Police, District Magistrate Ramban and others on a writ petition filed by J&K National Panthers Party. Prof. Bhim Singh, Sr. Advocate submitted that the innocent people in the state have been provoked by the ‘hate speeches’ given Mr. Omar Abdullah, the State Chief Minister inside and outside the legislature against the security forces and state integration with the Union of India. Prof. Bhim Singh also sought intervention of the Supreme Court of India to hold judicial inquiry into the circumstances that led to firing and killing four persons and injuring about 42 on 18th July, 2013 in Gool village of Ramban District. (Ramban is in Jammu region on the National Highway connecting Jammu with Kashmir).
Prof. Bhim Singh prayed in the petition to direct the Govts. of India & J&K to hold high power judicial inquiry into the unfortunate incident. He further submitted that the respondents should be directed to provide full security, boarding and lodging besides all medical care to the pilgrims to Shri Amarnath & Shri Mata Vaishno Devi who are occasionally stranded at different stations on the highway during their journey from Jammu to Shri Amarnath Cave.
Prof. Bhim Singh also submitted in the petition that Chief Minister of J&K has been provoking and inciting the Kashmiries against India, against Indian Army and BSF through his hate speeches. This is the main reason that people were provoked to attack the BSF camp in Gool or elsewhere. He said that BSF has been performing highly sensitive duty to protect the railways-under construction. Attack on the BSF camp was encouraged by the ruling party, he submitted, which led to the situation disturbing peace on 18th July, 2013.
The Panthers Party in the petition has submitted,
“That the most important sector of the National Highway starts from Lakhanpur bordering Punjab with J&K. The length of National Highway is about 400 kms. The Highway runs through the Districts of Kathua, Jammu, Udhampur, Doda, Ramban in Jammu region whereas Districts of Anantnag and Pulwama fall on the route to reach Pahalgam. Similarly, the pilgrims have to pass through the Districts of Anantnag, Pulwama, Srinagar, Gandherbal etc. to reach Sonamarg. The Govt. of J&K by stopping traffic on this national highway without application of mind has caused more hazards and difficulties for the pilgrims than would have been faced otherwise. The local people of Jammu Pradesh as well as Kashmir Valley have always been highly respectful and cooperative to ensure smooth running of the Amarnath Yatra. They have been larger beneficiary of this kind of religious tourism. The Govt. of J&K declared this route closed thus creating difficulties for thousands of the pilgrims. They have been held at various places on the highway where no facilities of boarding, lodging or medical aid is available.”
The petition further submitted that,
“The entire governmental machinery and administration have failed to function in accordance with the provisions of the Constitution of J&K and the Constitution of India.
That the Governor of J&K u/s. 53 of J&K Constitution is vested with absolute power dissolve the Legislative Assembly without seeking any concurrence or opinion of the Union of India.
That the State has been on flames ever since the present coalition government came to power. Several innocent people were killed, the security men from different disciplines were assassinated by unknown group of people who have not been brought to justice because of the failure of the government to bring culprits to justice.
That thousands of citizens/pilgrims on different parts of the country have been stopped at several stations on the 203 kms. long National Highway from Jammu to Shri Amarnath Shrine. This has caused horrifying indignity to the citizens of India, threatening their lives and liberty on their own country only because of the non-governance in J&K.
That the livelihood of the local labourers/shopkeepers in the Kashmir Valley stood threatened because of the failures of the present government to manage law and order and communal tension in the state. This situation was created because of hate speeches and public deliberations by the Chief Minister against the security forces including Army, BSF & CRPF who have been playing most difficult roles for the security of the state and the people.
That the Governor of J&K is obliged to invoke Section 92 r/w Section 53 of Constitution of J&K in such situation.”
The Panthers Party has also demanded judicial inquiry into the killing of security men and the civilians since 2010 till date so that the culprits and their abettors could be brought to justice. Prof. Bhim Singh while welcoming the notice to the Govt. of J&K & the Union of India expressed shock that the agenda of Mr. Omar Abdullah to discourage Amarnath Yatra has been realised by his government by terrorizing the pilgrims. Omar Abdullah’s government is directly responsible for the collapse of yatra this year which has been Omar Abdullah’s agenda to stop such yatras to the Valley.
