SC grants another four weeks to J&K to file counter on minor Faizan illegal arrest

A division bench comprising JJ Mr. R.M. Lodha and Mr. Justice Fakkir Mohamed Ibrahim Kalifulla today granted four weeks time to the State of J&K to file counter to the petition of 12-year-old Faizan, a minor who was illegally arrested by Safakadal (Srinagar) Police on 25th August, 2012. Faizan was kept in police lock-up without food and water for 40 hours without even producing him before any Magistrate. The petition was filed in the Supreme Court through the State Legal Aid Committee headed by Prof. Bhim Singh, Sr. Advocate against the illegal, improper, unconstitutional and discriminatory arrest and detention. The Supreme Court issued show cause notice on 11th March, 2013 to the Union of India, Chief Secretary of J&K, Director General of Police, J&K, SHO, Safakadal among others. The court had directed the respondents to file reply by 15th April, 2013, according to the office report. The service to all the respondents was complete according to the office report itself.
Prof. Bhim Singh, Sr. Advocate appearing in the case submitted before the court that the state has not cared to file reply and there was a delay of seven weeks. Prof. Bhim Singh also urged the court to award reasonable compensation to the minor whose education has suffered and caused agony and torture to the minor as well as to his parents.
On the request of the counsel of J&K state, court granted four weeks to file reply.
It has been submitted in the petition that Jammu and Kashmir has no Juvenile Welfare Board. This board could have handled cases of the juvenile delinquents and has power of adjudication as enshrined in the Act. Absence of Juvenile Courts is also major cause of worry which stops justice to minors.
The petition has urged the court to pay a compensation of Rs.10 lacs to Faizan for his wrongful confinement and illegal detention.

J&K disaster; fit case for Governor’s intervention u/s. 53 & 92

In an urgent communication to Shri N.N. Vohra, the Governor of J&K, Prof. Bhim Singh, Chief Patron of Panthers Party has urged for immediate intervention u/s. 53 r/w Section 92 for the dissolution of the government and the Assembly as the present government has utterly failed to function in accordance with the provisions of the Constitution of J&K. Prof. Bhim Singh has accused Omar Abdullah in person guilty of creating uncertainty, inciting and provoking the innocent people to wage war against the security forces through his hate speeches inside and outside the Legislative Assembly.
Prof. Bhim Singh pointed out that it was Mr. Omar Abdullah, the Chief Minister of J&K who repeated his speech against the security forces, particularly against the armed forces on the floor of the Legislative Assembly which was reported in the national papers. It was the Chief Minister who commented on the floor of the legislature that State Accession to the Union of India was incomplete. It was Omar Abdullah who has repeatedly been reciting in public to provoke the innocent Kashmiries against security forces by shouting loud that any amendment or alteration in Article 370 shall be possible after rolling over his dead body. Sure, he did not mean that but these words are enough to incite Kashmiries against the Union of India and the security forces.
Prof. Bhim Singh said that nine army personnel were killed two weeks back on the national highway by the terrorists who were neither identified by the government nor any follow up action taken to trace them out. The Chief Minister refused to condemn the incident. He only paid tributes to the army for the sacrifices they have been making. This is important that he is being provided security by the BSF and the CRPF. In his communication to the Governor Prof. Bhim Singh has demanded withdrawal of all BSF and CRPF personnel attached to the ministers and the Chief Minister for their security.
Giving account of the incident that took place on 17th & 18th July, 2013 in Gool in the District of Ramban, the senior advocate of the Supreme Court who is also Sr. Executive Member of the Supreme Court Bar Association pointed out to the Governor, according to the government a person at about 10 p.m. was intercepted by the BSF guards in a village near Gool. The same person when released by the BSF goes to the nearby Madarsa/Local Masjid started shouting against BSF on the public address system alleging that the BSF men have desecrated holy Quran. The local people started pouring to the place pointed out on the loudspeakers. What was the role of local agencies, police and the administration following this provocative shouting to raise such slogans? The people continued pouring in and by 7 a.m. more than 800 people had gathered. There was a local police station who registered the mob. The police got no backing from the district headquarter. A policeman fired in defence resulting in the death of a protester. Whereas a BSF personnel was shot in the stomach.
People were still allowed to pour in, gather near the BSF camp and when they were encouraged by the leaders of the ruling party namely National Conference they attacked the BSF camp. The question arises what was the role of the administration from 10 p.m. (17th July, 2013) to 10 a.m. (18th July, 2013). The BSF is not a danda police nor they are meant to play a negotiative role in such situations. The BSF claim that they were forced to fire in defence and for the security of their ammunitions and weapons cannot be rejected in a summary trial at the court yard of the Chief Minister. The greatest tragedy is that Chief Minister who has taken oath of allegiance to uphold the sovereignty and integrity of India started shouting at the top of his voice condemning BSF and the security forces without even trying to find out the facts and the circumstances under which this tragedy took place where four innocent villagers were killed in the firing and 42 injured according to the state agencies.
Thousands of pilgrims to Shri Amarnath Shrine were stopped at various places without application of mind that there were men, women, children and the elderly persons. They were subjected to harassment, insult and humiliation only because of utter failure of the government to coupe with the situation. The situation could have been avoided had the Chief Minister taken appropriate measures between 17th & 18th of July, 2013.
Prof. Bhim Singh said that continuous tirade by the Chief Minister against the armed forces has been projected to a highest pitch by the media and the hate speeches made by the Chief Minister have been responsible for provoking the common Kashmiries against the security forces. There is no governance at the moment. The Chief Minister has no time to attend the public problems and there lies urgency that the Governor of J&K should invoke Section 53  of the State Constitution, dismiss the Omar government, dissolved the Assembly and take over the administration by virtue of the authority vested in him by Section 92 of the State Constitution.
Prof. Bhim Singh warned that he shall knock the doors of the Supreme Court in case full protection and reasonable facilities are not provided to thousands of pilgrims to Shri Amarnath Shrine presently stopped on the national highway. He has also demanded a high power judicial inquiry into the circumstances that led to the tragic death of innocent villagers in Gool.

Delhi Panthers burn Kashmir’s CM effigy, Demand his immediate dismissal to save J&K from further death & destruction

Several Panthers activists of Delhi Pradesh National Panthers Party today held a massive demonstration at Jantar Mantar, New Delhi demanding immediate dismissal of NC-Congress government in J&K which has become security risk for the country for its complete failure to provide security to the citizens and maintain law and order in the state.
Delhi Pradesh National Panthers Party in its strong note addressed to the Prime Minister of India demanded intervention of the Union government in the national interest so that the people of J&K shall not suffer from further death and destruction caused due to non-governance in the state.
Delhi Pradesh National Panthers Party urged the Prime Minister of India to heed to the suggestion of Prof. Bhim Singh, Panthers Party Supremo as to what needs to be done in the state in the present situation. Prof.Bhim Singh has suggested dismissal of Omar government in J&K, promulgation of Governor Rule and institution of high power judicial inquiry into the killing of six villagers yesterday besides killing of 120 youth and students in 2010, brutal assassination of police and army men in the broad-day light in Kashmir Valley among others by a sitting judge of the Supreme Court.
Delhi Pradesh National Panthers Party has threatened to take out Rashtriya Chetna Abhiyan around the country against the utter failure of the Central government to act in J&K and reorganize the State of J&K for the good of all the three regions in the state.

Bhim Singh condemns killing of innocent villagers of Sangaldan in Ramban Distt., demands judicial inquiry

Prof. Bhim Singh, Chief Patron of National Panthers Party and Member of National Integration Council has condemned the killing of more than half a dozen innocent villagers of Sangaldan in Ramban District this morning and demanded high power judicial inquiry by a sitting judge of the Supreme Court so that the law-breakers could be brought to justice without delay.
Expressing sympathy with the families of those killed, the Panthers Party Supremo held the government of J&K responsible for this tragedy which showed that the government has lost control on the situation and what has happened today particularly in the holy month of Ramadan is most unfortunate and unforgiveable. This incident does not leave an iota of doubt that the Omar Abdullah’s government has failed and is not capable to maintain law and order.
In an urgent message to Shri N.N. Vohra, the Governor of J&K, the Panthers Party leader urged for immediate dismissal of the NC-Congress government to save the people from any further death and destruction. He also demanded a compensation of Rs.50 lacs to the families of those killed and Rs.10 lacs to the injured persons.

National Panthers Party in a massive conference held at New Delhi paid richest tributes to the foremost and first freedom fighter namely, Mangal Pandey on his birthday late last evening. The Panthers Party in a resolution urged the President of India for his intervention to ensure that the foremost freedom fighters including Mangal Pandey, S. Bhagat Singh, Jemadar Ishwari Prasad, Chander Shekhar Azad, Subhash Chander Bose, Sukhdev, Rajguru, Ishfaqullah Khan, Bal Gangadhar Tilak  and others should be decorated with Bharat Ratna being the greatest heroes of India’s war for freedom from the Britishers.
Prof. Bhim Singh, Chief Patron of the Panthers Party described martyr Mangal Pandey as one of the first heroes of the freedom movement who smashed the colonial army officers openly. Boldly admitted his war against the British Raj in the Court of law and finally shot himself before being killed or butchered. However, he was put on the gallows on 18th April, 1857, 10 days before the actual date fixed for his hanging.
The Panthers Party in a resolution called on the youth and the students of the country to read the history of the freedom struggle and sacrifices made by our heroes. It regretted that the democracy has fallen in the hands of enemies of the people, criminals and blood suckers who has to be thrown out by the power of the ballot and that is possible only through the popular awakening movement which the youth of the country are capable to do.
The conference was presided over by Shri Rajiv Jolly Khosla, Secy. General of Delhi Pradesh National Panthers Party and several senior Panthers Party leaders addressed the gathering.
