Goodbye, His Excellency Next, My Lords

Shri Pranab Kumar Mukherjee, the first President of India from the land of Netaji Subhash Chander Bose has done a magnificent service to the country by deleting the colonial borrowed and unwanted adjectives attached with the President of India and the Governors of the state. His Excellency or Mahamahim words were attached while addressing the President of India or the Governors. Shri Pranab Kumar Mukherjee has come true to expectations to take His Excellency of the records from the address to the President of India.

India, the largest democracy in the world has to find an honourable way to minus ‘My Lords’ addressed to the Judges of the Supreme Court and the High Courts. My Lord is too heavy for the honourable judges on the bench to digest. Sometime it turns embracing both for the advocates addressing the court as well as for the judges themselves. There are more than 100 countries in the world including 53 Islamic countries and nearly 50 socialist oriented countries and even in Europe ‘My Lord’ has no relevance at all. India has a Chief Justice with a difference and an in him there lies courage and wisdom both. The proposition which President of India deserves a due consideration by all those who are at the giving end.

Most of the High Courts are facing crisis because of the vacancies of the judges in several High Courts. The past several years have not been very pleasant in the functioning of the highest seat of judiciary. There lies a need to amend Constitution so as to ensure that no retired judge of the Supreme Court or a High Court shall accept any official assignment for, at least, three years. There is need of a scientific methodology to ensure that no criminal case should remain pending before the Apex Court for more than two years and the civil case for five years. The sons and daughters of judges have every fundamental right to practice wherever they wish but for the sake of credibility of the judges themselves no immediate relative should be allowed to practice by the judges. It requires an earnest effort that cases are listed according to the direction of the courts and not at the wish or will of the listing officers. No case should be allowed to linger on in the Registry. Maximum period for the removal of defects etc. has to be fixed in the interest of both the clients as well the Registry.

The Chief Justice has issued a very valuable notification allowing mentioning of the cases. It is expected that fresh breeze of change shall fill the corridors of the Supreme Court and the entire judiciary in the country. Judiciary is the last hope of a wretched of the earth who is the brick in the wall of democracy.

Keep President’s election above party politics

India is going to have 13th Rashtrapati (President) on 25th July, 2012. The political leadership in India has, unfortunately, mixed their political interests to manipulating for the highest place in the largest democratic set-up. It appears as if power hungry politicians shall not feel shy asking reservation for the Presidential candidates in future. Dr. Ambedkar, Chairman of the Constitution Drafting Committee did not recommend reservation beyond 20 years. After 63 years, reservation has become an election manifesto for every political party. They want reservation for women, reservation for so-called backward classes rather reservation has become a slogan of the political parties not for those who are living in poverty and rags but for those who happened to be born in a particular class, tribe or even region. The I-cards of SC/ST/OBC are sold in the open bazaars with the patronage of the politicians, of course, with full connivance of the bureaucrats.

They used to teach us, “Worth not birth shall rule mankind, wait a little longer.”  After 63 years of rule of law in the largest democracy, India, we find slogans everywhere, “Birth not worth shall rule mankind.” Merit is determined on the basis of birth i.e. caste, tribes, region and all that. Worth does not merit any more. 50% reservation have been legalized by the Supreme Court of India. How long remaining 50% shall be added to the existing 50? 60 years was enough time to provide education, social assistance and economic upliftment to the wretched of the earth so that the new generations shall have no unequals.

Sanskriti school is a living example how future generation shall stand divided vertically. Only God given children of high-flying bureaucrats and top political clergymen can dream of entering the threshold of some Sanskriti schools. Ten lacs is just entry donation. A child, in my village, Bhugterian has not even tat (tardy carpet) to sit. One teacher looking after 100 children studying in five classes. The teacher has to cook for his students also. When that child of my school shall match the children of Sanskriti school, nay, that of Central School or a Convent School. 90% children study in the rural/village schools. 50% drop out because of their social and financial circumstances. The remaining turn chauffeurs, cleaners, domestics for those Sanskriti school product. The nation is heading fast for a vertical division and that shall lead to a class conflict within 20 years.

Now the politicians want a pliable President of the country who could be used at the time of need to bend the Constitution even. The thinkers, the ideologues and the men who matter have rightly been advocating that the President of India should be above party politics and who shall represents the voice of the millions. He should be casteless, acceptable to all forms of the society. The tragedy looms longer when the MPs and the MLAs are arbiters to elect the President. In the interest of the largest democracy and future of the greatest civilization which still can claim to uphold the moral values of life, it shall be desirable to elect President of India directly. Less than half percent legislators have their integrity under question themselves. What expectation the nation has from those who are facing criminal trials, some of them are still in jails and several of them are awaiting imprisonment. What kind of choice such persons may have?

Corruption in political life in India has taken cancerous form. Corruption has become part of public life. Those who are most corrupt are shouting against the corruption with equally loud voices. As long as corruption is not eliminated from India’s electoral system, corruption cannot be wiped out from the society. India is heading towards Ultimate Revolution and none can stop it. The right thinking people particularly the youth and students shall do well if they lead the Ultimate Revolution by rejecting all forms of violence in the society. Let the Ultimate Revolution need India towards glory of mankind so that India can play its destined role for peaceful co-existence of the nations. Complete disarmament shall save the world from complete annihilation.

            Worth not birth shall alone rule mankind. Wait for the Ultimate Revolution!
